HomeMy WebLinkAbout2002-008 - Streets and Highways Code Section 1810RESOLUTION NO. 2002-008 RESOLUTION SEEKING JURISDICTION PURSUANT TO CALIFORNIA STREETS AND HIGHWAYS CODE SECTION 1810 FROM THE COUNTY OF ORANGE TO ACQUIRE PROPERTY WITHIN UNINCORPORATED COUNTY BOUNDARIES DHY: 1/23/02 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: Pursuant to California Streets and Highway Code section 1810 a city may acquire, by purchase or eminent domain, property outside its boundaries in the unincorporated area of the county in which the city is located, if it is necessary to connect or widen the existing streets of the acquiring city and if the county consents to the acquisition. The City of Santa Ana has undertaken the project of widening 17th Street and Tustin Avenue in the City of Santa Ana to improve the vehicular traffic-carrying capacity and movement efficiency for these heavily traveled arterials. As part of the widening of City streets it is necessary to acquire private property located within the boundaries of unincorporated County of Orange. Acquisition of the property is necessary so that City streets can be effectively widened in a comprehensive manner allowing the project to improve the vehicular traffic-carrying capacity of the arterials. It is therefore necessary to request from the County of Orange the requisite grant of jurisdiction so that the City of Santa Ana may seek to acquire under eminent domain laws property along 17th Street and/or Tustin Avenue. Section 2. The City Council of the City of Santa Ana hereby requests that the County of Orange grant jurisdiction to the City of Santa Ana to initiate eminent domain proceedings to acquire property located in unincorporated County boundaries. Jurisdiction is needed for all land located in unincorporated County areas along 17th Street and/or Tustin Avenue as identified in Exhibit A. Section 3. The City Council of the City of Santa Ana hereby declares that such actions are necessary to allow the widening and connection of city streets. Resolution No, 2002-008 Page 1 of 2 Section 4. The portion of any acquired property used to connect or widen a city street shall be deemed a city street for all purposes. Section 5~ This Resolution shall take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution. Section 6. Moreover, the Clerk of the Council is authorized and is hereby directed to transmit to the Board of Supervisors of the County of Orange a certified copy of this resolution.
