The Clerk opened and read the following bids for legal advertising for fiscal year 196~-65: Free the Orange County Reporter, rate per inch, first insertion, SB.00; for subsequent insertions, $2.65; reprints of all Notices, $.02 each. Free The Register, rate per inch, first insertion, Satur~ ~nly, $2.10; other days, $2.25; subsequent insertions, Saturday only, $1.80; other days, $1.8~5. On motion of Councilman Hubbard, seconded by Councilman Earvey a~d carried, C~,~cil awarded the c~ntract to The Register and rejected all other bids. NEARING - A.A. 499 Mayor Eall opened the continued hearing on DIEBRICN AmenSment Application 499 filed by R. A. Diedrich to amend Sectional District Map 6-5-9 by reclassifying from the R i to the R ~ district, property on the east side of Santa Fe Railroad between 17th and Santa Clara, on which Planning C .... ~ssion recommended denial. Warren Proctor, 115 W. 15th Street, agent for the applicant, stated that a meeting had been held with representatives of the opponents, but all the problems had not been resolved. He quoted frc~ a University of California- Berkeley Study which indicated that famtlies with children occupy only one unit in seven a~d abomt one third are occupied by single persons. Mr. Proctor presented new plans to the Council which had been discussed with the Plaa~ing Director, in which Nathaway Street ended in a cul-de-sac, and which provided a buffer area of six h~-es, which builder would agree to construct on the same lot sizes and to be of equal value with adjacent hemes. He would also either place a six foot block wall to the rear or concrete block garages which would abut the R 1 hemes. Mr. Proctor stwa~arized the benefits provided as threefold: no through traffic except for an emergency crash gate; almost cmaplete privacy; and no auto traffic between the apartments and the R 1. Ne gave supporting statements to his ccatenticm that R 4 was warranted because of sufficient precedence, the plan was not detrimental to the area, and was not opposed to public policy. Ne note~ that R 1 development was not practical a~Jacent to the railroad. Ne oonclu~ed by saying that the developer was willing to make smae changes, provided the cost was not e~cessive. Nathan Tart, ~02 E. Avalon, representing the Northeast ~amta Ama Residents Association, stated the Santiago re~.ening should not be considered a precedent since in that case all a~m~istrative proceedings were exhausted Before Council's action. He maintained that since the property was owned By the Schroeders, they should have filed the application insteed of Diedrich; that sufficient precedence he~ not been established; au~ that one street for ingress ami egress, with only an additional emergency gate, would not be sufficient for the traffic generated by 266 units. He asked the C~ucil to wait for the General Plan before making a decision, amd that more time be given for study of the revised plA~ presented by the applicant. Ernest R. ~qie~fried, 1202 E. Avalon, suggested that the matter be continued. Mr. Proctor stat~ this woul~ place applicant in hazardous position as he is in escrow. Walter Newbrander, 1202 E o Bmffalo, stated that most people were not aware of all the facts. There being no further testimony, the hearing was close~. CIT~ COUNCIL - 417 - June 15, 196~ At Councilman Harvey's request, the Director of Planning explained that the Public ~tilities Commission would not permit access across the railrea~ tracks, an~ his department w~uld not recvmmend it anyway; that the thirty foot road is contingent upon the Senior Citizens development; that R ~ traffic will be about the same volume as that created by an R 1 development. Mr. Proctor stated that the project woul~ not be undertaken until plans for the access were worked out in the event the Senior Citizens building was not constructed. ~ark E. Sherman, 2014 N. Flower, agent for the Senior Citizen Project, stated that financing is being sought at present and that the Board of Directors had no objection to the thirty feet being used for a street, nor to the proposed project. It was moved by Councilman Gilmore, seconded by Councilman Harvey and carried, that a decision in the matter he postponed to the meeting of July 6, 196~. HE~RING - A.A. 501 Mayor Hall opened the hearing on ROSA Amendment Application 501 filed by Joseph Rosa to amend Sectional District MaP 5-5-9 by reclasSii~ying fram the A 1 to the R ~ district~ property on the east side of Wright between Catalina and Santa Clara. Planning C"mmfssion Resolution 5686 recummended approval. The Clerk reported that notice of the hearing was published in The Register on May 23, 1964 and that no written c~unications or objections had bean receive~. There being no response to the call for testimouy, the hearing was closed. In rebuttal, Mr. Heinly cited as precedents several Variance Applications which ha~ Been granted in other areas, stating that a property right was being denied his client.
