The meeting was called to order at 7:30 p.m. in the Council Chambers, 217
North Maim Street. Roll Call was answered By Councilmen Royal E. Hubbard,
Harry H. Ea~¥ey, Henry II. Schlueter, and Mayor A. Allen Hall. Councilman
James Gilmore was absent. Following ~he Pledge of Allegiance to the Flag,
the Invocation was ~elivered By the Reverend Hal Edwards, First Methodist
Church.

By reclassifying from the A 1 to the C 2 district, property on the south
side of Fairhaven between Lincoln and Glassell.
James Guthrie, 1023 Wo 17th Street, representing the applicant, stated that
the property is presently used as a rest hc~e, but when the area was annexed
to the City it was prop~se~ that the host use was a service station; that
a lease is ready for signing with ~hell Oil Company if rezoning is approved.
The Planning Director stated tha$ the Pls~ C~-~t~sion recommended denial
of the application~ as it has against all ~ 2 ~plicatiens em Gr~md~
because of the proposed u~e~ but because the C.-~;~t~si~ felt development
should be by variance. ~r. Guthrie stated tha~ t2~ applicant wished the
property rezoned rather than develop un~ler var~me procedure.

PETITION a Referendum Petition was filed protesting
the adoption of Ordir~nce NS-729 and.

or submitted to the voters; thmt the Registrar of Voters had filed a Certificate
with the Clerk declaring that on the date of filing of the pebitlon there were
46,244 voters registered in the City. The Clerk suhmitted a Certificate
declaring that the petition was signed by not less than 10% of the voters
the City.

addressed the Council regarding access
rights at the southwest corner of Fairview
and McFadden° Mr° Villelli explained that a building permit had been obtained
and plans approved, subject to the Council's quitclaiming access rights and
that escrow on the property could not be closed until the City granted to
Wilshire Oil Co. these access rights.
It was moved by Councilman Hubbard~ seconded by Councilman Schlueter~ that a
resolution be adopted authorizing execution of a quitclaim deed for access
rights at the southwest corner of Fairview and McFadden~ subject to the condition
that it first be approved by the City Manager and City Attorney. On roll call
