HomeMy WebLinkAbout2002-109 - Approving Conditional Use Permit No. 2002-29RESOLUTION NO. 2002-109 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 2002-29 AS CONDITIONED FOR THE PROPERTY LOCATED AT 812 NORTH SYCAMORE STREET Kdo/12/11/02 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: Conditional Use Permit No. 2002-29 came before the City Council of the City of Santa Ana for a public hearing December 16, 2002. Conditional Use Permit No. 2002-29 has been filed with the City of Santa Ana seeking to construct a five-level parking structure within the Civic/Professional District of the Midtown Specific Plan (SP3) District. A conditional use permit is required to construct a parking structure in the Midtown Specific Plan area. The Planning Commission of the City of Santa Ana held a duly noticed public hearing on December 9, 2002, on Conditional Use Permit No. 2002- 29, and voted by a vote of 7:0 that the City Council approve Conditional Use Permit No. 2002-29. Santa Ana Municipal Code Section 41-638 authorizes the City Council to grant a conditional use permit upon making certain findings. That the granting of a Conditional Use Permit is necessary for the preservation and enjoyment of one or more substantial property rights. The proposed parking structure will provide an additional service to the community by increasing the parking available to residents and visitors from the surrounding area. Resolution No. 2002-109 Page 1 of 6 Will the proposed use under the circumstances of the particular case be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity? The proposed parking structure will not be detrimental to persons residing or working in the area because the use, as conditioned, will not create any negative or adverse impacts. The addition of available parking to the surrounding neighborhoods will enhance the safety and general welfare of persons residing or working in the area. Moreover, conditions are imposed to mitigate any potential impacts to those in the vicinity. Will the proposed use adversely affect the present economic stability or future economic development of properties surrounding the area? The proposed parking structure is located within the Civic/Professional District of the Midtown Specific Plan. The land use for this site has been designated for a parking structure within the Specific Plan. The development of this facility will increase accessible parking, thereby enhancing the profitability of the business and identifying the use and site as economically stable and viable for the surrounding properties in the area. Will the proposed use comply with the regulations and conditions specified in Chapter 41 for such use? The parking structure has been designed to be in compliance with the regulations and conditions identified in the Midtown Specific Plan, Chapter 41, for parking structures and all other applicable design standards. Will the proposed use adversely affect the General Plan or any specific plan of the City? The proposed structure will not adversely affect the General Plan, as parking structures, designed to be compatible with the surrounding environment, are consistent with the goals Resolution No. 2002-109 Page 2 of 6 -- and objectives of the District Center (DC) General Plan designation. In accordance with the California Environmental Quality Act, the proposed project has been determined to be adequately evaluated in the previously prepared Midtown Specific Plan Environmental Impact Report. Section 2. The City Council of the City of Santa Ana hereby, approves Conditional Use Permit No. 2002-29 as conditioned in Exhibit "A" attached hereto and incorporated herein. Date: Clerk of the Council City of Santa Ana Resolution No. 2002-109 Page 4 of 6 Conditions for Approval for Conditional Use Permit No. 2002-29 Conditional Use Permit No. 2002-29 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the dghts conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A. Planninu Division The applicant must comply with all conditions and requirements from the Development Review Committee for the development project (DP No. 2002-73). Any amendment to this conditional use permit must be submitted to the Planning Division for review. At this time, staff will determine if administrative relief is available or the conditional use permit must be amended. 3. A lot line adjustment shall be applied for and tentatively approved. The parking structure is designed per design guidelines of the Midtown Specific Plan. The architecture of the parking structure will be designed incorporating a Mission/Spanish Revival style, which would be compatible architecturally with the adjacent YMCA building. The design will also include a cornice cap bordering the top edge of the structure, and the exterior walls will be painted to match the architectural color of buildings in the area. Landscaped vine pockets for Boston Ivy must be installed at ten-foot intervals along the Sycamore Street elevation adjacent to the sidewalk. Design and Development Standards for parking structures apply to this project, and shall be incorporated into a signed landscape agreement between the City and applicant, including: a) Boston Ivy vines shall be planted in ten locations in the City right-of- way as noted on Exhibit B and maintained with a drip irrigation system. The vines shall be protected with 1/2-moon wrought iron grates per City Standard No. 1129. EXHIBIT "A" Resolution No. 2002-109 Page 5 of 6 b) The Boston Ivy shall be irrigated, maintained and replanted, if necessary, in each location. c) The Boston Ivy shall be irrigated and maintained in a trained and well-groomed condition. d) Failure to comply with the maintenance obligations of this condition shall be deemed to be a public nuisance. The proposed cimulation pattern within the structure will allow for a turnaround at ground level. The turnaround design configuration will allow adequate opportunity for a vehicle to reverse direction. The existing Environmental Impact Report (EIR) for the Midtown Specific Plan includes a mitigation-monitoring program for parking structures. The mitigation-monitoring program will be implemented to regulate design and construction of the parking structure. Per the access study completed in October 2001, the design must include two access points to be located at the south elevation and along Sycamore Street of the parking structure. Both access points will allow for on-site vehicle stacking. Additionally, both access points will provide two- way ingress/egress by use of ticket dispensers and card readers to allow for an uninterrupted ingress and egress traffic flow and accessibility to all vehicles.
