Roll call was answered by Councilmen R~yal E. Hubbard, Harry H. Harvey, James Gilmore, Henry H. Schlueter, and Mayor A. Allen Hall. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Garland Lacey, Wilshire Presbyterian Church. APPROVAL OF MINUTES On motion of Councilman Hubbard, seconded by Councilm-~ Narvey and carried, the Minutes of the Re~Alar Meeting of October 19, 1964 were approved as mailed. BID AWARD - RADIO UNITS The City Manager reported that the low bidder for eight Police Radio Units, Spec. 65~-8, did not meet specifications. On motion of Councilman Hubbard, seconded by CounciLman Schlueter and carried, Council ordered filed report of bids received; approved award of contract at unit prices to Radio Corporation of America; and rejected all other bids. RID AWARD - PICKUP TRUCEB On motion of Councilman Hubbard, seconded by Councilmau Harvey and carried, Council ordered filed report of bids received for four Pickup Trucks, Spec. 621-~7; approved award of contract to George Dunton Ford, Inc., in the amount of $6,838.79; and rejected all other bids. AMEND. APP. 512 - TODD 36--~-10 by reclassifying from the A 1 Mayor Hall opened the continued hearing on Amendment Application 512 filed by C. W. To~d, proposing to amend Sectional District Map to the C 4 district, property on the east side of Bristol between Memory ?~e and the Garden Grove Freeway. Planning C~ission Resolution 5697 recommended denial. The Clerk repurted that a letter in favor of the application had been received fro~Myers Brothers Construction Company, Los Angeles, and the following letters received were in opposition to the application: Irving and Sally Weisberg, 715 W. Mayor Hall asked how many were in opposition and approximately 25 hands were raised. CITY COUNCIL - 84 - November 2, 196~ W. W. Morningstar, 2749 ~. Flower, and Ralph Crum, 2733 N. Flower, objected to postponement. Robert Gardner, 10~8 %;. Fairbrook Lane, stated that approximately 61% of the people in the Villa de Flores area favor the C 4 zoning and a continuance o On motion of Councilman ~[ubbarcl, seconded By Councilman 8chlueter and carried, Council continue~ the hearing on Amendment Application 512 to January 4, 1965, at 7:30 p.m. in the Council Chamber. In answer to Mr. Morningside's question of another possible continuance, Mayor Nell stated he, personally, would not be inclined to postpone the matter again. Cou~cilm~l Gilmore recummended that ~-~erent in the motion be the understanding that Mr. Todd will make every effort to get in touch with people in the audience to answer questions so there will he no request for a continuance at the January meeting. Mr. Todd requested a showing of hands of those in favor of continuance, and about seven hands were raise~. Raymond C. Ball~ 2755 No Flower, submitted a petition with approximately 109 signatures of those in opposition to the application. On motion of Council-~. Hubbard, seconded by Councilman Schlueter and carrie~, Council ordered the petition filed. APPEAL 141 - Mayor Hall opened the hearing on Appeal V.Ao 2020 141 filed by The Meredith Company fr~a the Planning Commission's denial of Variance Application 2020 to permit deviation from the R ~ procedure requirements at 1812 Eo Santa Clara. The Clerk reported that notice of the hearing was mailed to adjacent property owners on October 27, 1964, and that no communications or objections had been received° Dale Heinly, 611 W. 8th, representing the applicant, stated he would ~e a presentatio~ on Appeal 141, and if it were granted he believed there was no problem on Appeals 142, 143, 1~4 and 145 as far as the Staff and Commission were concerned° Mr. Heinly stated the variance application was unique because the city has no zoning providing for construction of duplexes for sale on an individually owned lot. He reminded Council that at the time of rezoning the property, Council and the Planning C;....;~ssion were advised that a 4-plex tract map would probably be submitted. Mr. Heinly displayed drawings of the project, pointing ~mt the advantages of the p]~ which was designed to make the 4- plexes look like single family residences. He stated that the main issue ia whether or not the Council should permit 4-plexes within the R 4; that there was no valid reason for not being able to build it in the R ~ provided sufficient green space is provided; that to the east is R 4, to the south some R 4 an2 smae 4-plexes which have been sold, to the west a park site on which an R 1 map will be filed if City does not buy it. The Planning Director stated that if the private patios were eliminated, the open area would exceed the required 50%, but it was felt By staff that a private patio for each occupant was more important than meeting this requirement. Noel Conway, 1521 Catalina, requested those in opposition to stand, and about 17 arose. Re complained ~bout Lusufficient notice to homeowners; proposed channeling of traffic through R 1 area; and the barrack-type design. Mrs° Sally Rosen, 1~4 E. 21st, quoted frou the Government Co~e regarding growing residential areas, and asked Council to consider the effect on surrounS~g acreage and homeowners. She c~amented that this was the sixth appearance regar~ingthe matter; that Mr. Meredith knew of the restrictions of R 4 at the time of rezoning; that the residents desire retention of garden type apartments; commenting also that Mr. Meredith should not be given special consideration when other builders had to adhere to conditions; and requested a continuation so that the homeowners could get together with Mr. Meredith to discuss a solution. Mrs. Rosan concluded by stating that she felt the Code's requirement of notification within ~00 feet was mea-ut to include inhabited land and residents; therefore, they felt they should have been notified. Heinly stated that the present plan is nors desirable than a~y R ~ that would be conStructed there; and he outlined such advantages as more square footage thA~ mini~u~ stand~rd required, ~ud space between apar~aents. He stated the issue as Being whether or not Oouucil will per, it ~-plexes in R ~ zo-~. The Planning Director stated that the purpose of R ~ regulations is to create a ~ulti-fa~ly project that most nearly resembles single family residences; that by eli~inatt~ s~ae of the units it would be possible to c~nform to all provisious of the R ~ except for a few m~nor details. He explained that the P]A~i~g Cc~aission und staff had not envisioned a typical subdivision when I~ ~ was written; but if in Council's Judgment this type of develolmaent is acceptable in R ~, then only ~inor differences frc~ R ~ exist o Howard Stanley, 1~5 E. Catalina, stated that ~ families would Be living in one cul de sac causing congestion with autos ond children; that unsightliness will exist because of trailers, ca~pers and other parke~ vehicles. ~a~es Czach, 1672 Santa Clara, owner of property directly to the east of the develo~ent, stated that the ~ere~ith project would surroun~ hi~ on three sides a~d he would be ~a~dlocked, and asked for access to the street. The P~-ing Director noted that the project had been redesigned to bring a street by his property. Nr. Conway c~ented that there was a logical extension of the street through Catalina and he disapproved its use as an access road for this type of develol~ent. Royal J. ~aeller, 2~7 Loretta Drive, Orange, owner of property to the east of ~r. Czech's, requested access to Santa Cl&ra. ~rs. Willia~ E. York, 1~22 E. Catal~% protested the variance, say~ that two school shifts would be required if there were more pupils; and that the two Buses are already over-buttoned. She read the P~a~-£ C~lssion's evaluation which said the proposed develol~aent appeared mere like an R 3 than an R ~ develolment; ~ requested a continuation so Mr. ~. Wright, an attorney~ could ~e present and so h~aeowners could set further t~or~ation. The Pla~uing Director stated the ~evelol~aent would not affect the ense~ent Mr. ~Aeller and Mr. Cmack have been using for access; that even if all the area were developed R 1 there w~mld be need for another elementary school. Mrs. Rosen handed to Co~ucil a traffic repc~t showing how ~-y accidents had occurred at Santa Clara an~ Tustin in the last few months~ explaining the hazardous conditions at Santa Clara ~n~ ~right. She requested a delay in or~er to further research the ~atter. There hetn~ no further teotl~ny, the hearing was closed. Santa Clara in the R ~ district; - to coustrnct 2 story (30' high) dwellings within 1~0' of the R 1 and A 1 zone districts at 1812 E. Santa C~a~a in the R ~ district; - to eliminate required fences except around rear yard and to allow balconies and covered patios to be constx-Acted at applicant's option ~ud not be - 86 - ~ove~ber 2, APPEAL i~5--V.A. 2015 considered as open space at 1812 E. Santa Clara in the R 4 district; to permit redmction of the side yar~ setback requirements at 1812 E. Santa Clara in the R 4 district. The Clerk reported that notice of the hearings was mailed to a~Jacent property ~wners on October 27, 196~ and that no written ccmmm~uications or objections had been received. Dale Heinly, 611 W. 8th, attorney representing the appellant, stated that the appeals all related to Appeal 1~1 and woul~ not arg-Ae them further. James Czach, 16752 Santa Clara, stated his property would Be affected By the rear and sideyar~ setbacks which are no more than two feet from his property; construction of 2-story dwellings would affect two sides of his property, and elimination of fences would be intrusion of privacy. There Being no further testimony, the hearing was closed, It was moved By Councilman Hubbard, seconded By Counc~- Schlueter that Council overrule the action of the Planning C.---~selon and instruct the City Attorney to prepare a resolution granting Variances 201~, 2019, 2017 and 2015. Councilman Gilmore asked for expla-ation of Mr. Czach's objection regarding elimination of sideyards and fencing and the 2-story development. Mr. Heinly stated there would Be wall surrounding his property. The Planning Director noted that even with approval of the variances, the applicant still ~Ast submit development plans, that the waiver of fence requirement was requested for lines Between applicants lots and the periphery of develolmaent would still be fenced. The motion to overrule the action of the Planning Ccmzaission and instruct the City Attorney to prepare a resolution granting Variances 201~, 2019, 2017 and 2015 was carried. APPEAL 1~6 - Mayor Hall opened the hearing on Appeal V.A. 2025 WRIGET 1~6 filed By Norms J. an~ FrA~W E. Wright frc~ the Planning Ccmmission's denial of Variance Application 2025 to permit an off-street parktng lot in the R 1 district at 1715 N. Flower. The Clerk reporte~ that notice of the hearing was mailed to adjacent property owners on October 27, 196~ an~ that no written c~mications or objections had Been received. Frank Woodland, 13132 Fairmont Way, representing the appellant, referred to a petitian previously submitted with approximately 13 signatures of adjacent property owners, indicating their approval of the variance. He described the area, noting the subject property was unsaleaBle as such next to the commercial area; that the developer proposed to Build a six foot Block wall to protect the property ~mmediately north and a planter A-~ wall on Flower ~treet. He showed photographs to Council revealing the parking problem, stating the lot would take about 30 automobiles off the street, would not Be a co~aercial lot, But for employees and customers of nearby Businesses. Conrad Schultz, 1~11 N. Flower, nearby property owner, asked that integrity of the residential area Be protected, stating that the proposed lot was needed by the Metropolitan Life Building as the result of their failure to provide parking when building. Patrick J. Partes, 1722 N. Flower, a~lded his protest, stating also he was authorized to speak for the following: Mrs. Frances 1808 N. Flower, Nolle Earpster, 1816 N. Flower, Fra-w Cannon, 180~ N. Flower, and Lloyd Rrogan, 1812 N. Flower. There Being no further testimony, the hearing was closed. It was moved By Councilman Gilmore, seconded By Co-~ucilman N~rvey and carried, that the Council uphold the action of the Planning C~ission an~ instruct the City Attorney to prepare a resolution denying Variance 2025. CIT~' COUNCIL - 87 - November 2, 196~ RECESS At 9:18 p.m. a five minute recess was declared. The meeting was reconvened at 9:30 p.m. with all Councilmen present. RES. 64-1~5 RESOLUTION 64-1~5 OV~iR~LING THE FA~JLARO DECISION OF '£~ PLANNING CO$$~SION AND GRANTING A VARIANCE ON APPLICATION NO. 1998 FIT.~ BY A. H. FAMULAR0 AND s,n.W~A FAMULARO SUBJECT TO CONDITIONS was before Council for consideration. Mayor Hall and Councilman Schlueter were disqualified from discussion and action in this matter because of a conflict of interest and left the Council table; Vice Mayor Hubbard, ass,,mtng chairmanship of the meeting. Noel G. Conway, 1521 E. Catalina, requested those present in opposition to stand, and about 50 arose. M=. Conway stated that the variance is illegal because the owner or certified agent of the owner did not sign the application; that the Council did not, in his opinion, have a quorum voting. He objected to the expense of a court action, when the hearing was illegal, and requested a delay so certified evidence of ownership could be submitted. Mr. Miller objected to any further hearing unless a complete hearing was held. Mrs. Sally Rosan, 1534 E. 21st, asked that the hearing be reopened, since Council had not been aware of the illegality of the application. Councilman Gilmore asked the City Attorney what conditions would be required to reopen the hearing, and was told that the same notice would have to be given as before. Mrs. Roean stated that of the ten people notified of the hearing, only seven lived in the district; but that about 60 persons were present to protest. Upon question fr~a Council, the attorney advised that if the Council were to accept evidence satisfactory to them that the applicant was not the owner of the property, Council could then refer the matter back to the Planning Corem1 ssion or could terminate the proceedings. It was moved by Councilman Narvey, seconded by Counc~lm-n Gilmore and carried, that Council reopen the hearing on December 7, 196~ at 7:30 p.m. in the Council Chamber; notices to be sent under the usual procedures and action on the resolution be postponed to that time. Mayor Hall and Councilman Schlueter resumed their places at the Council table. ~F~ARING - Mayor Nall opened the hearing on Appeal APPEAL 14~7, V.A. 2031 147 filed~ by Bo W. and Patricia G. Robinson from the Zoning Administrator' s approval of Variance Application 2031 filed by Rehlco Developers, Inc. to construct a 20 ~nit apartment complex in the C 1 amd R 1 districts at 1601 N. King. The Clerk reported that notices of the hearing were mailed to adjacent property owners on October 26, 196~. The following ccmm~mications in opposition were ordered filed on motion of Councilman Hubbard, seconded by Councilman Schlueter and carried: petitiou containing approximately 20 signatures and representing approximately 13 properties; letter frmm Mr. and Mrs. john NcFarlane, 2015 W. 15th. William Robinson, 1515 N. King, requested those supporting his appeal to stund, and about 25 persons stood. He then reviewed previous Council actions in the area, and stated that since the new owner of the property was aware of the cir- cumstances when he bought it, there was no case of hardship; and that the Master Plan made no provision for R 3 in the area. Walter Brooks, 2002 W. 15th, showed pictures of the area to Council, stating that about 600 cars would be added, and that because of limited access, congestion already exists; stating also that about 250 more petitioners could be obtained; and requested a continuance in order to obtain additional support. Don Robertson, 18262 Leafwood Lane, represeuting Rehlco Developers, Inc., stated that plans had been submitted prior to expiration of the original variance, but they had not gone through to planning Department. The Planning Director reviewed the past actions, stating that present pl-~s were apparently same as the original application approved by Council in ~a~,,a~y, 196~, but in amy event a condition of approval would require they he identical. Cl~ CO%~NCIL - 88 - November 2, 196~ Mr. Robinson spoke briefly in rebuttal, stating application defies laws, sets ~a-gerous prece~lent, and asked if it was Council's intentiom to c~a~e the area from R 1 to R 3o There being no further testimony, the hearin~ was closecl. It was moved by Councilman Hubbard, seconded by CouncJ~ma~ Schlueter and carried, that Council uphold the actiem of the Zoning A~ainistrator and instruct the City Attorney to prepare a resolution grunting Variance Application 2031. STRm~£ ~qPROV~E~TS The City M_~-~ger commented that various cc~plaints had been received regarding lack of street improvements am~ city water in southwest Santa Ans. He stated that when the area had been annexed to the city, officials had indicated to the Directors of the Mutual Water System their wi~ingness to purchase the system; that they were informed that the Directors were not interested in selling; whereupon the city surrounded the area with its own water system for fighting fire. The Nanagar remarked that in the tragic burning of a hame in the area with loss of life, the length of time before applying water was not a result of the distant water lines, but rather that the first firemen to arrive were engaged in trying to save lives o He added that the City was still willing to p~rchase the water system. As to the street improvements, he revealed that at least three attempts had been made by residents to establish am assessment district, but that they had never been able to obtain the 60% of signatures required. The alternative was to have the City, under state laws, initiate an assessment ~istrict and proceed with the hearings; stating, h~wever, that such pressure methods had never been used by the City. Mayor Eall explained that the City would cooperate fully, and urged the residents to ~e another attempt to s~aster the necessary signatures. MrS. Jane Nurray, 1702 S. ~arine, describe~ the deplorable condition of the streets where the children from three schools were forced to walk; declar~-~ that She would make another attempt to help start an assessment district. Arthu~ Snell, lOB1 W. St. Andrew, Principal of Diamond School, also ~eacribe~l the area, stating he ha~ consulted with the Assistant Director of Pablic ~orks who suggested HO PARXING signs an~ asking property owners to remove same of the obstx"Actio~; that this would help as a stop-gap measure. The Nayor asked him to meet with the City Namager on this. Mrs. Leo Eazel~ 1829 So Sullivan, asked for a man~atory assessment district with the cost prorated over the City. Esther Gordon, 2718 Wo St. Andrew, declared that mazy people in the area were unreasonable, but that she would try again with an assessment ~istrict petition. Nayor Nell expressed the Council's understanding, and stated that the matter would receive the attention of the Council an~ staff. APPEAL 1~ - Mayor Hall opemed the hearing on Amendment HALL Application 1~ filed By Clarence L. Hall fron the P~n8 C~ission's denial of Variance Application 1999 to construct 37 four unit apartments with less than required front amd side yard setbacks in the A 1 and C 1 ~istricts at 317 N. Euclid. The Clerk reporte~ that notice of the hearing was mailed to adjacent property owners on October 26, 1~, and that no written c~unications or objections hsd been received. The appellant displayed a map of the area, point~-g out the proposed 160 units to be ~uilt as ~-plexes on ~0 lots, stati~ that access to lan~locke~ areas was planned; that no more density than required was aske~ for; and that improvements would be in character with the neighborhood. Pictures were passe~ to the Council showing the oldest and newest homes in the area. A petition was presented fram six property owners in favor of the application~ and seven persons in favor in the audience arose. On motion of Councilmau Hubbard, seconded by Councilman Schlueter and carried, Council ordered the petition filed. CITY COUNCIL - 89 - November 2, 196~ Dale Neinly, 611 W. 5th, attorney representing Tanaka ~ros., owm~n~ several properties in the area, requested that in ox~ler to protect his client's property, proper ~rainage an~ a redwood fence should be provided; that the mc~otony of the construction was the main objection, and there would be no ob~ecticm to 2- story buildings. Del l~ichael, President of the Hc~eowners Association, expressed oppositicm to apartments, and stated that if built, they should be the best type available. In rebuttal, ~r. Hall agreed to a berm being built on the south side for ~rainage and construction of a grapestake fence; that monoto~ could be avoided by four elevatic~s; a~d since one person w~ld own a ~-plex~ he would malntaim its upkeep. C. L. Burnett, ~18 W. 5th, spoke in favor of the project 0nly if one story buildings were built. The Planning Director state~ the area was a difficult one to develop; that the plan~t~_~ Ccmmission had dome a special study of the area to resolve the questions presented; that the lots were of such size that they could not be developed as one family dwellings, and would be difficult to develop as R ~; thereby concluding to zone the area R 2 an~ approve by variance development to a density of about one unit per ~,500 square feet on those properties that coul~ not be subdivide~. The Plaguing Department had worked with the subdivider amd had arrived at a street pattern that will allow circulation to the south, and he detailed the necessary street requirements; also noting that requirement to compl~v with con~itions of tract map should be made. There being no further testimo~y~ the hearing was closed. The appellant offered to eliminate four lots, which would bring the lot coverage to 51%, meeting ~ ~ standards. The play area would be separated frcm vehicular access and chamges in elevations would reduce monotony, to which Mr. Heinly replied his client would have no objection with this plus development to R ~ standards. The p~an~_!n~ Director s~ggested density be set by figure such as one ,~-~t to B~00 square feet to which Mr. Heinly replied that one to 2700 or 2500 square feet was all the appellant could live with. On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, the matter was referred back to the Pl---ing Cc~mission for further study in light of the comments made, to see if something can be worked out. ~J~NG - Mayor Hall opened the hearing on. A.D. 220 Resolution 6~-1~1, declaring the (BOLSA-EUCLID) Council's intention to order certain sewer construction in Assessment District 220 (Bolsa-Euclid) and also providing for a hearing on whether public convenience and necessity require such improvement without application of the Special Assessment Investigation, L~m~tation and Majority Protest Act of 1931. The Clerk presented Affidavit of Publication of Resolutio~ of Intention, Certificate of Mail~ Notice of Hearing, Certificate of Posting of Notice of rmprovemant, and Affidavit of Publication of Resolution proposing exclusion of territory from Assessment District and approval of revised map. It was move~. by Council~_ Hubbard, seconded by Councilman Bchlueter and carried, that the documents be filed with the Clerk. Franklin T. Hamilton, 611 ~ilshire 3oulevard~ Los Angeles, special counsel for the City, briefly explained the hearing. Ronald E. Wolford, Director of Public WOrks~ described the proposed improvement and also the b~u~a~les of the assessment district, as originally proposed by Resolution of Y~tention, Resolution No. 6~1~1, and as proposed to be revised by Resolution No. 6~-1~6; stating that in his opinion the territory proposed to be excluded from the district will not be benefited by the proposed improvement and that all lands included within the proposed assessment district, as shown on "Revised Map of Assessment District No. 220" will be benefited by the proposed improvement. The Clerk reported fha2 no written protests had been filed. C-TX COUNCIL - 90 - November 2, 196k C. L. Burnett, 4118 W. 5th~ asked if the Boundaries could Be moved up to include only 160 feet of his property which is 235 feet deep so he would not have to pay extra assessment and have lines going across private property in the event he sells the front portion. The Director of Public Works stated the method of assessment had not yet been determined but normally was on a front foot Basis if lots are equal. ~r. Hamilton advised Mr. Burnett that if his property can Be drained into this sewer by gravity, it must Be included in the district to that depth.
