Main Street. Roll call was answered by Councilmen Royal Eo Hubbard, Harry H. Harvey, James Gilmore, Henry Ho Schlueter, and Mayor A. Allen Hall. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Jay Weener, Parkview Reformed Church. APPROVAL OF MINUTES On motion of CounciLman Hubbard, seconded by Councilman Schlueter and carried, the Minutes of the Regular Meeting of November 16, 1964 were approved as mailed. BID AWARD - 17th On motion of Councilman Hubbard, STREET RAMP seconded by Councilman Schlueter and carried, Council ordered filed report of bids received for construction at 17th and Valencia, Project C-102; approved award of contract to Coxco, Incorporated at unit prices, and rejected all other bids. BID AWARD - On motion of Councilman Hubbard, A.D. 220 seconded by Councilman Schlueter RES° 64-191 and carried, Council ordered filed a report of bids received for the construction of sanitary sewers in Assessment District 220. Bids were received from the following: Orange County Pipeline, Inc. Ralph De Leon Constr. Famco Constr. Co. AoA~A. Constr. Coo Card Constr. Co. City Constr. COo Charles L. RESOLUTION 64-191 OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA~ AWARDING CONTRACT FOR WORK OR IMPROV~ ORDERED BY RESOLUTION NO. 64-159 was read by title. It was moved by Councilman Hubbard, seconded by Councilman Harvey that further reading be waived and Resolution 64-191 be adopted. HEARING - APPEAL 136 V.A. 1998 - FAmm O N~yor Hall and Councilm-n Schlueter were disqualified from discussion and action in this matter because of a conflict of interest, and left the Council table. Vice Mayor Hubbard opened the rehearing on Appeal 136 filed by Ao H. and Helena Famularo from the Planning Commission's denial of Variance Applicatic~ 1998 to construct a hospital for the care and treatment of geriatrics, psychiatrics and alcoholics in the R i district at 1420 E. Santa Clara° The Clerk reported that notice of the hearing was mailed to adjacent property owners on November 30, 1964, and the following ccmmunications had been received: Certificate from Ernest R. and Nora Io Machander dated November 18, 1964, stating they were owners of the subject property and that Ao H. and Helena Famularo at all times throughout the proceedings had been their duly appointed agents; letters in opposition from Esther and Martha Sexlinger, 16412 E. Santa Clara; Louis and Helene Yung, 16281 Eo Santa Clara; Oo Wilbur Fix, 2121 N. Grand; and The Sierra Parent ~Teacher Association. On motion of Councilman Harvey, seconded by Conncilma~ Gilmore and carried, the co~m~unications were ordered filed. The City Attorney ruled that inasmuch as the certificate from the property owners was not filed with the application as required by the Municipal Code, the application was invalid and the Council had no authority to act upon it. In view of the City Attorney's ruling, Vice-MAyor Hubbard declared the proceedings terminated. Mayor Hall and Councilman Schlueter resumed their places at the Council table. HEARING - APPEAL 137 Mayor Hall opened the hearing continued VoA. 2004 - DAVIS from October 5, 1964 on Appeal 137 filed by Jack Davis from thePlanning C~maission's denial of Variance Application 2004 to construct a commercial building with retail sales and general offices in the R 1 district at 1430 E. 17th. The Clerk reported that postponement until after the Christmas holidays had been requested by Herman Bo Altman, 1618 No Linwood, and John M. Hoy, 1514 N. Linwoo~. On motion of Councllm-u Hubbard, seconded by Councilman Schlueter and carried, the letters were ordered filed and the hearing was continued to the meeting of January 18, 1965 at 7:30 p.m. in the Council Chamber. HEARING - A oAo 524 Mayor Hall opened the hearing on Amendment PILA~tT Application 524 filed by Arthur B. Pliant to amend Sectional District Map 4-5-9 by reclassifying from the P to the C 5 district, property on the north side of 17th between Deodar and Ponderosa. Planning Ccm~ission Resolution 5707 recommended approval of Exhibit A.A. 524 A. The Clerk reported that notice of the hearing was published in The Register on November 14, 1964 and that no written communications or objections had been received. There being no response to the Mayor's call for testimony, the hearing was closed. Leighton Garner to amend Sectional District Map 16-5-10 by reclassifying from the R i to the C 2 district, property on the south side of Bolsa between Euclid and Andres. Planning C~==~tssion Resolution 5705 recummended approval of Exhibit A.A. 526 A. The Clerk reported that notice of the hearing was published in The Register on November 14, 1964 and that no written communications or objections had been received. There being no response to the Mayor's call for testimony, the hearing was closed. HEARING - APPEAL 151 GEGDEP~ & MARK Application 2049 to develop a convalescent at 4717Wo Bolsa. Mayor Hall opened the hearing on Appeal 151 filed by Geoders &Mark Corporation from the Planning Cc~mission's denial of Variance rest home in the C 2 and A i districts The Clerk reported that notice of the hearing was mailed to adjacent property owners November 30, 1964 and that no written c~unications or objections had been received. Mayor Hall commented that new plams had been submitte~ which had not been reviewed by the Planning Cc~mission and closed the hearimg. 0~ motion of Councilman Hubbard, seconded by Councilman Hurvey and carried, Council referred the matter back to the Planning C~mmission for consideration of new plans. HEARING - WARD Mayor Hall opened the hearing on the BOD-NDARIE~ changing of ward boundaries prior to the General Municipal Election. The Clerk reported that notice of the hearing was published in The Register on November 28 and December 5, 1964, and that no written communications had been received; that a population estimate over 120,000 had been certified by the California Director of Finance, therefore, Council must in accordance with Charter provisions establish two new wards. CITY COUNCIL - 114 - December 7, 1964 Janice Boer, 912 N. Lowell, requested that the hearing be continued so public could study map. Darrell Boyer, 925 E. Hunter, protested the splitting of the subdivision where he lives. In answer to a question by Noel C6nway, 1521 E. Catalina, the City Attorney explained that after the boundaries are established by Council action, the map will be published. It was moved by Councilman Hubbard, seconded by Councllw~n Schlueter and carried, that the hearing be continued to December 21, 1~6~, 7:30 p.m. in the Council Chamber; that the change of one precinct in the southern section be made; that there be tentatively designated as Ward 6 that area located in the southeast portion of the map, and as Ward 7 that area located in the northwest portion of the map; that the Counc~lmau elected frown Ward 6 be for a two year tern and from Ward 7 be for a four year tern. HEARING - Mayor Hall opened the hearing on planning LP DISTRICT C~w..~ssion rec~endation for amendment to the zoning ordinance for Ltmfted Professional (LP) Zoning District to allow strictly professional land use that would be exclusive of residential encroachment. The Clerk reported that notice of the hearing had been published in The Register on November 21, 196~, and that no written comz~mt cations or objections had been received. There being no response to the Mayor's call for testimony, the hearing was closed. On motion of Councilman Hubbard, seconded by Councilman Gilmore and carried, Council approved th~ proposed amendment and instructed the City Attorney to prepare an appropriate ordinance. STREN£ VACATION Mayor Hall opened the hearing on proposed vacation of a portion of Edinger at the southwest corner of Flower and Edinger. The Clerk reported that notice of the hearing was published and posted as required by law, and that certificates thereto are on file in the office of the Clerk; that no written communications or objections had been received. The City Attorney informed Council that a utility easement should have been included in the Resolution of Intention setting this hearing and suggested the proceedings be commenced again with a new Resolution of Intention. The hearing was closed. Bigler, attorney from Los Angeles, to investigate all facets of the complicatio~s within the Police Department. Mr. Harvey commented that Mr. Bigler will make no statements to the press, but will report directly to the Co~mcil; and that statements will be issued by the Mayor periodically to the press.
