Koo & Associates ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). RECITALS A. The Parties entered into that certain agreement entitled "Consultant Agreement" dated December 7, 1998, hereinafter referred to as "said Agreement", for providing structural plans, specifications and estimates for the seismic retrofit design of three City owned bridges; B. Consultant was awarded the contract after submitting its proposal in response to the City's Request for Proposals. The consultant selection process was performed in compliance with the Local Assistance Procedures Manual and the pre-audit of Consultant has been met. C. The Parties hereto now desire to amend the Scope of Work contained in said Agreement in order to supplement the work to be performed by adding one additional bridge, as well as adding environmental compliance services for the four (4) bridges in the Santa Ana River Bridge Project. The Compensation section will also be amended to compensate the additional work. WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, the parties hereto do hereby agree as follows: 1. The "Scope of Services" section of said Agreement (Section 2.) is hereby supplemented by adding the seismic retrofitting of the Fairview Street Bridge, as well as adding environmental consulting services for all four bridges in accordance with the supplemental Exhibit Al attached hereto and incorporated herein by reference. 2. The "Compensation" section of said Agreement (Section 6.) is hereby amended to add an additional One Hundred Seventy Three Thousand Seven Hundred Sixty Dollars ($173,760.00) for said supplemental work. 3. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged and in full force and effect. No. 55C-0513). The bridge was constructed in 1962 by County of Orange Highway Department. The structure is 52'side. Constructed of concrete "T' girders, supported over eight concrete piers founded on concrete mandrel piles. The structure has a high skew angle of 54.4 degrees, and all the supports are parallel. A seismic retrofit design was prepared by a consultant retained by Caltrans in 1991, and the retrofit mainly consist of cable restrainers and pipe seat extenders across the two expansion joints, and adding concrete shear keys at abutments. The retrofit was not constructed. The City is requesting additional consultant service to review the original seismic retrofit, and to provide revisions and modifications to the original retrofit due to the changes in seismic analysis and design codes instituted by Caltrans since 1994 and was most recently updated in 2000 with the publication of the Seismic Design Criteria (SDC 1.2). WKA will provide the services following the standard project development for a seismic retrofit project, starting with the seismic retrofit strategy analysis and report. The proposed seismic retrofit will be reviewed and approved by Caltrans in a Seismic Retrofit Strategy Sessions to be held at Caltrans Engineering Services Center (ESC) office in Sacramento. The approval will form the basis for design for the seismic retrofit design and construction plans, specification and estimates. The proposed scope is outlined below. WKA's subconsultant- RBF Consulting, will be providing environmental evaluation of the Fairview Bridge, as well processing environmental permits for four structures in the City of Santa Ana as part of the seismic retrofit program. The fours structures are First Street over SA River, Fifth Street over SA River, and McFadden Avenue Bridge over SA River. STRUCTURE DESIGN- Seismic Retrofit Design 1- SEISMIC RETROFIT STRATEGY DEVELOPMENT/ BRIDGE GENERAL PLANS WKA will prepare the Seismic Retrofit Strategy to reflect all the geometric, foundation structural details and design standard of the existing structure. The general plan (Seismic Retrofit) will follow Caltrans OSFP I&P Guide Section 4-2 "Structure Type Selection". In. We will investigate the seismic safety and structural integrity of the existing structure follows the latest SDC, as well as applicable MTD sections pertinent to seismic retrofit ( such as MTD 20-4). Seismic analysis will be based on the preliminary geotechnical design memo produced by the project geotechnical engineer. The analysis would include a 2-D push analysis of the bent(s), dynamic analysis based on the proposed ARS curve per SDC 1.2, and estimated foundation stiffness of the as-built structure. Foundation investigation will be conducted based on as-built information and available subsurface information from adjacent structure(s). No subsurface investigation will be conducted during the Seismic Retrofit Strategy Phase of this project. The analysis will dctcn~nine elastic seismic displacement of the existing structure. Alternative retrofit strategies will be developed based on the "as-built" model analysis. A minimum of two retrofit alternatives will be developed. Same sets of analyses will be performed for the "retrofitted" structure to indicate the effectiveness of the proposed retrofit strategy. Seismic Retrofit Strategy Report will be prepared that contains the material as required under I&P Guide 4-2. We will also prepare General Plan Estimates for all thc retrofit alternatives that have been studied during the Seismic Retrofit Strategy process, and will confirm any proposed retrofit that would involve foundation work following foundation recommendations contained in the Preliminary Foundation Report. The subsurface investigation will be performed, if required, after the approval of the seismic retrofit strategy. We will attend a seismic retrofit strategy meeting to be held at Caltrans Division of Structure's office in Sacramento. WKA will present the design, preliminary seismic design analysis and preliminary design of colurnns and foundations to the Caltmns engineers. Approval of one seismic retrofit strategy would signify the approval of the retrofit concept, and to continue toward the final PS&E phase of the bridge design effort. The project is assumed qualified for the Programmatic Exemptions for Seismic Retrofit projects, and no environmental document will be needed for the proposed retrofit construction. It is assumed that City will prepare all environmental document (including the PES form) in the preparation of the consultant scope of work. 2- GEOTECHNICAL INVESTIGATION Development of m~ effective seismic retrofit strategy would require the support from a geotechnical consultant. In addition, because of the potential for additional foundation work, them would also be need to conduct limited subsurface investigation to confirm the design of the new foundation system as part of the seismic retrofit strategy. Earth Mechanics Inc, the original geotechnical subconsultant on the seismic retrofit contract with the City of Santa Ana, will be providing the geotechnical services. The scope of their services is included in Appendix B herein. 3- UNCHECKED DETAILS SUBMITTAL The bridge design will have prepared in accordance ~vith the codes and standards of Caltrans. The following list summarizes the key design components of the structural improvements for the proposed bridge widening and reconstruction. 1. All plans and design calculations will be prepared in English Units. Page 4 of 22 PROPOSAL TO CITY OF SANTA ANA PAGE 22 AMENDMENT TO BRIDGE RETROFIT CONTRACT SEISMIC RETROFIT STRATEGY 2. Seismic analysis will follow the procedures as outlined in Caltrans SDC and chapter 20 of the Caltrans Memo to Designers. Effect of the combined structures will be analyzed, and additional retrofit requirement in addition to the bridge widening will be evaluated. 3. Bridge aesthetics of any structure additions as result of the seismic retrofit strategy will /bllow the treatment on the existing structure to the extent possible. 4. Bridge structures will be designed following the latest Caltrans Seismic Design Criteria (SDC). 5. Utility list will be updated at the bridge. No utility relocation or addition of new utility is assumed at this time. For the purpose of establishing a scope of work for the seismic retrofit strategy design, discussed below is a list of possible retrofit elements that are envisaged by the consultant at this time. The proposed work is based on consultant's past experiences working on similar type of structures in a similar environment and geological hazard condition. A. Abutment retrofit will be required due to the high skew of the structure. In addition to the shear keys that will be required to hold the structure securely on the abutment seats, the high skew angle would require the comer with an acute angle to be stabilized with addition of large diameter piles. B. Bent retrofit may be required due to a number of unique conditions of the as-built condition. The bent cap is supported on the pier wall in a "pinned" condition. This creates a pier wall vulnerable to high force at the base of the wall at the connection with the foundation. The lack of confinement reinforcement of the pier walls at the base could render the pier wall vulnerable to failure at the base where short the rebars are lapped spliced with the foundation dowels. C. The same concern with the pier walls could also render the foundation vulnerable. Pier wall foundation is traditionally more vulnerable due to the large transverse responses generated along the pier wall due to the wall stiffness. The skew angle, combined with the pier wall boundary condition, would make the foundation more vulnerable. INITIAL STRUCTURE PLANS WKA will follow the Caltrans practice and the plans will be checked independently by a registered engineer. The intent is to swap between the designers and checkers in order to maintain objectivity of the independent checking process. Differences in the calculations will be reconciled first before the Initial Plans will be submitted to Caltrans for review and approval. WKA will prepare a final quantity takeoffbased on the standard Item List developed in accordance with the Caltrans Standard Specification and SSP. Designer quantity take-offs will be compared with the independent quantity takeoffs following the completion of unchecked Details Plans. We will also prepare a complete set of independent quantity check calculations of all structural components. The quantities will be compared with the designers quantity takeoffs, and all structure bid items will be checked in accordance with Caltrans Bridge Design Aids Section 11 "Estimating". Suggested Work Days schedules will be prepared for the individual structures, as well as for the group of structures to be advertised and constructed in single phase. The Caltrans Standard Specification will be the basis of the project specification. We will develop a project specification based on the Caltrans Standard Special Provisions (SSP) in metric format. WKA will submit the Initial Structure Plans to Caltrans and the City for review and approval. This stage of the submittal will include the followings: Bridge Plans and Details shown in Table 1 Standard Special Provisions Quantity and Initial Engineers estimates 5- INTERMEDIATE PS&E SUBMITTAL wka will collect all the comments on the initial PS&E from the city and from Caltrans, and other reviewing agencies that issue permits for construction of the bridge and the relocation of utilities. We will respond the comments with written resolution letters that describes the method of dispositions of all comments. Revisions to the initial PS&E submittals will be made after the proposed dispositions are approved by the reviewers. The PS&E packages will be re-submitted to Caltmns for final review and approval. 6. FINAL PS&E SUBMITTAL The final approval submittal will implement the design corrections as noted in the agency's review and our response comments. We will also produce our final Engineers Estimates as part of the final PS&E Submittal. We will also prepare the final RE pending files in accordance with Caltrans OSFP I&P Guides. All plans will be prepared in AutoCAD formats. 7. POST DESIGN SERVICES WKA will conduct post design services (PDS) during the construction of the structures on a separate set of budget to be negotiated with the City after the plan approval. The post design services include the following activities: I. Attend pre-construction meeting 2. Respond to Request for Information (RFI) generated by the Construction Manager 3. Review prestressing reinforcement and joint seal assembly shop drawings 4. Produce As-Built plans WKA will provide other PDS at the request of the City or the Construction Manager. The services will be provided on an hour and material basis as agreed by the City. ENVIRONMENTAL EVALUATION AND PERMITS TASK 1: BIOLOGICAL REVIEW A literature review will be conducted for each bridge to determine which species have been identified as special status by state, federal, and local resources agencies and organizations, and have a potential to occur within the project site or immediate vicinity. Sources to be reviewed include: (1) special status species lists from the Califomia Department offish and Game (CDFG) and U.S. Fish and Wildlife Service (USFWS); and (2) database searches of the Califomia Natural Diversity Database (CNDDB) and the California Native Plant Society's (CNPS) Electronic Inventory. TASK 2.0 REGULATORY PROCESSING The scope for regulatory permits would involve processing one comprehensive set of permits for each bridge locations, authorizing the City to complete multiple construction phases under a single permit umbrella. A key element that must be included in the Categorical Exemptions (CE) is a thorough description of each construction phase, providing a concrete purpose for pursuing a phased construction program verses a single construction phase. RBF's approach will address all construction phases as defined by the City. This approach assumes that the combined total permanent discharge (at each bridge location) will not exceed the 0.5 acre limit. RBF will coordinate with the appropriate permit strategy that would meet the Page 7 of 22 PROPOSAL TO CITY OI,' SANTA A NA PAGE 22 AMENDMENT TO BRIDGE RETROFIT CONTRACT SEISMIC RETROPYT STRA TEG Y City's construction objectives. However, as wiuth any project ~vhich requires authorization from the Army Corps Of Engineers (ACOE), The California Department of Fish and Game (CDFG), and the Regional Water Quality Control Board (RWQCB), the overall permit acquisition process, mitighation obligations, and phasing approach is subject to review and concurrence from the aforementioned agencies. Task 2.1: Site Visit to Determine Corps Jurisdiction RBF will determine acreage considered by the Army Corps of Engineers (ACOE) and the California Department of Fish and Game (CDFG) to be jurisdictional non-wetland 'waters of the United States.-- Since these areas of the Santa Ana River are concrete lined, it is assumed that no Wetlands will be identified. RBF will conduct a site investigation with respect to hydrology, hydrophytic vegetation (if applicable), and hydric soils (if applicable). RBF will prepare a determination of the ordinary high water mark (OHWM) within the existing drainage channel. Task 2.2: Pre-application Field Meeting If desired by the ACOE, RWQCB and/or CDFG, RBF will conduct a pre-application meeting to discuss proposed project with the agencies staff. It is assumed that only one field meeting will be conducted and that all four bridges will be visited the same day. This meeting will facilitate the processing of the permits by allowing the resoume agencies to comment on the proposed project prior to submitting the applications. Task 2.3: Army Corps of Engineers 404 Permit Application Prepare submittal package for an Army Corps of Engineers 404 Permit to satisfy the requirements of Section 404 of the Clean Water Act. It is assumed that, based upon conceptual project plans, the proposed activities can be permitted under Nationwide Permit No. 25, Structural Discharges. The submittal package will include: (a) 404 permit application, (b) vicinity map, (c) project description, (d) jurisdictional delineation map, and (e) site photos. It is anticipated that it will take two (2) to four (4) months to process this application. This time frame is dependent on issuance of a water quality certification waiver by the Regional Water Quality Control Board. Task 2.4: California Department of Fish and Game 1600 Permit Application RBF will prepare an application submittal package for the CDFG 1600 Agreement for Streambed Alteration (also known as a Streambed Alternation Agreement). The submittal package will include: (a) Form FG 2023, (b) vicinity map, (c) project description, (d)jurisdictional delineation map, and (e) site photos. This task does not include the permit filing fee, which can range up to $1,390.50 depending on the construction cost of the proposed project. Task 2.5: Regional Water Quality Control Board Section 401 Water Quality Certification RBF will prepare a submittal to secure waiver from the State requirement for Section 401 of the Clean Water Act certification. This certification is necessary prior to the ACOE concurring with discharges of fill material under their permit process. This ;york item anticipates a waiver being granted by the Regional Board. If the Regional Board escalates the permit requirement to the State Board for actual certification, Client shall be notified and additional work shall continue Page 8 of 22 PROPOSAL TO CITY Ob' SANTA ANA PAGE 22 AMENDMENT TO BRIDGE RETROFIT CONTRA CT SEISMIC RETROFIT STRATEGY based on separate addendum or a time and materials basis subject to Client approval. This task does not include the permit filing fee, typically $2,250. Task 2.6: Resource Agency Permit Processing Provide regulatory services for the processing of the permits to the Army Corps of Engineers, the California Department ofFish and Game, and the Regional Water Quality Control Board. The processing shall include required correspondence or telephone calls between the reviewing staff related to the permit or points of clarification. TASK 3.0: GRAPHICS AND REPRODUCTION Each document will include a maximum of four (4) exhibits to enhance the written text and clarify the Project and potential impacts. Exhibits are anticipated to include: Regional Vicinity Map, Site Vicinity Map, Site Plans (or aerial), site photographs, and Jurisdictional Exhibits. TASK 4.0: FINAL TECHNICAL REPORTS RBF will respond to one (1) comprehensive set of comments on the Draft documents. The revised Draft Reports will incorporate all comments received on the Draft documents. RBF will provide three (3) copies of each Final Technical Report (separately bound) to the client. Additional copies beyond this specified number shall be subject to compensation based upon a mutually agreed upon time and materials basis for the cost of reproducing the necessary copies. TASK 5.0: PROJECT COORDINATION AND MEETING ATTENDANCE Mr. Bruce R. Grove Jr., REA will be responsible for management and supervision of the technical studies as well as consultation with the City. Mr. Grove will undertake consultation and coordination of the Environmental Review for compliance with future CEQA and NEPA requirements, including the necessary coordination with the resource agencies. This task includes attendance at up to six (6) meetings. Should additional meetings be required, an addendum will be provided to the City for approval. FEE PROPOSAL A Detailed fee proposal is attached herein. The proposal assumes the scope of services as described herein, as well as the scope to be furnished by the named subconsultant. Please note that the fee for each task assumes that all four bridges and the necessary permits will be processed concurrently. Should any one of the bridges be processed at a separate time as the others, RBF retains the right to re-submit a revised fee schedule. TASK 1,0 TECHNICAL COMPLIANCE Task 1.1: Biological Review A literature review will be conducted for each bridge ~o determine which species have been identified as special status by state, federal, and local resources agencies and organizations, and have a potential to occur within the project site or immediate vicinity. Sources to be reviewed include: (1) special status species lists from the California Department of Fish and Game (CDFG) and U.S. Fish and Wildlife Service (USI=WS); and (2) database searches of the California Natural Diversity Database (CNDDB) and the California Native Piant Societ3/s (CNPS) Electronic Inventory. TASK 2.0 REGULATORY PROCESSING It is our understanding that the City wishes to acquire one comprehensive set of permits for each bridge location, authorizing the City to complete multiple consb'uction phases under a single permit umbrella, A key element that must included in the Categorical Exemption (CE) is thorough description of each construction phase, providing a concrete purpose for pursuing a phase construction program verses a single construction phase. Our initial permitting approach will address all construction phases as defined by the City, This approach assumes that the combined total permanent discharge (at each bridge location) will not exceed 0.5 acre. RBF will coordinate with the appropriate resource agencies to discuss the City's desired permitting approach and develop a permit strategy that would meet the City's construction objectives. However, as with any project which raquires authorization from the Army Corps of Engineers (ACOE), the California Department of Fish and Game (CDFG), and the Regional Water Quality Control Board (RWQCB), the overall permit acquisition process, mitigation obligations, and phasing approach is subject to review and concurrence from the aforementioned agencies. Task 2.1: Site Visit to Determine Corps Jurisdiction RB F will demrmine acreage considered by the Army Corps of Engineers (ACOE) and the California Department of Fish and Game (CDFG)to be jurisdictional non-wetland "waters of the United States." Since these areas of the Santa Ana River are concrete lined, it is assumed that no Wetlands will be identified. RBF will conduct a site investigation with respect to hydrology, hydrophytic vegetation (if applicable), and hydric soils (if applicable). This meeting will facilitate the processing of the permits by allowing the resource agencies to comment on the proposed project prior to submitting the applications. Task 2.3: Army Corps of Engineers 404 Permit Application Prepare submittal package for an Army Corps of Engineers 404 Permit to satisfy the requirements of Section 404 of the Clean WaterAct. ~tJs assumed that, based upon conceptual project plans, the proposed activities can be permitted under Nationwide Permit No. 25, SZructuralDischarges. The submittal package will include: (a) 404 permit application, (b) vicinity map, (c) project description, (d) jurisdictional delineation map, and (e) site photos, It is anticipated that it will take two (2) to four (4) months to process this application. This t~me frame is dependent on issuance of a water quality certification waiver by the Regional Water Quality Control Board. Task 2.4: California Department of Fish and Game 1600 Pen-nit Application RBF will prepare an application submittal package for tile CDFG 1600 Agreement for Streambed Alteration (also known as a Straambed Alternation Agreement). The submittal package will include: (a) Form FG 2023, (b) vicinity map, (c) project description, (d) jurlsdictional delineation map, and (e)site photos. ThJstask does not include the permit filing fee, which can range up to $1,3g0.50 depending on the construction cost of the proposed project. Task2.5: Regional Water Quality Control Board Section 401 Water Quality Certification RBF will prepare a submittal to secure waiver from the State requirement for Section 401 of the Clean WaterAct certification. This certification is necessary pdor to the ACOE concurring with discharges of fill material under their permit process. This work item anticipates a waiver being granted bythe Regional Board. ifthe Regional Board escalates the permit requirement to the State Board for actual certification, Client shall be notified and additional work shall continue based on separate addendum or a time and materials basis subject to Client approval This task does not include the permit filing fee, typically $2,250. Task 2.6: Resource Agency Permit Processing Provide regulatory services for the processing of the permits to the Army Corps of Engineers, the California Department of Fish and Game, and the Regional Water Quality Control Board, The processing shall include required correspondence or telephone ceils between the reviewing staff related to the permit or poinls of clarification. (EMI) has prepared a scope of work to provide geotechnical consulting services for the Fairview Street Bridge retrofit project. We had provided a scope of work and cost estimate on April 23, 2002. The current proposal is prepared to update the scope of work and the cost estimate. It is our understanding that Caltrans conducted the original retrofit design over 10 years ago and WKA will check validity of the design to conform with current design codes. There is no geotechnical report available from the earlier Caltrans' design. This bridge is supported on eight piers and two abutments. All foundations are supported on piles. We propose two phases that include the following scopes of works 1. Preliminary Design Phase Search Additional Soil Data: The existing Log-of-Test-Boring (LOTB) shows three soil borings; all drilled within the Santa Ana river channel. No soil data is available from the embankment. We will search for additional soil data specifically from the U.S. Army Corp of Engineering during the river improvement program. Development of ARS Curve: EMI will study the seismic hazards at the site and recommend an ARS design curve appropriate for the site which is consistent with Caltrans latest guideline. Evaluation of Liquefaction Potential: EM1 will evaluate liquefaction potential of the foundation soil. Geotechnical & Earthquake Engineering Development of p-y Curves for Existing Piles: EM1 will provide recommendations on p-y curves for all existing piles supporting the bridge. If simplified p-y curves are needed (such as these used for WFRAME), WKA ~vill develop these simplified curves using the nonlinear p-y curves provided by us. Development of t-z and q-u Curves for Existing Piles: EM1 will provide recommendations on t-z and q-u curves for all the piles. WKA can evaluate pile capacities from the provided axial springs. 2. Final Design Phase Site Investigation: We propose a site investigation program consisting of three hollow- stem auger soil borings; two at the abutments and one in the channel, and laboratory tests. The borings are approximately 60 feet in length. Standard Penetration Test (SPT) blowcounts will be recorded every 5 foot intervals alternating SPT Spoon sampler and modified California sampler. The concrete channel liner will be cored prior to soil boring and will be filled with quick set concrete upon completion. Logs-of-Test-Boring: We will prepare full size Logs-of-Test-Borings. The format of LOTB follows the Caltrans standard guideline. Evaluation of Additional Piles: If additional piles are needed, we will provide recommendations on the geotechnical parameters of the pile type chosen for retrofit. Report Preparation: A report will be prepared documenting all the findings including site investigation, laboratory testing, liquefaction potential, ARS curves, and foundation design parameters. The following items are not included in our scope of work: No environmental drilling, if hazardous materials are encountered during the boring, we will halt the operation and notify you for further instruction. Them will be no Caltrans review and approval of our work and report. No pile group stiffness will be provided. Soil stiffness of the embedded pier wall and pile cap will not be provided.
