Main Street. Roll call was answered by Councilmen Royal E. Hubbard, Harry H. Harvey, James Gilmore, Henry H. Schlueter, and Mayor A. Allen Hall. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Fred Niedringhaus, First Congregational Church. APPROVAL OF MINUTES On motion of Councilman Hubbard, seconded by Counc~lm-~ Schlueter and carried, Council approved as mailed the Minutes of the Regular Meeting of December 7, 196~. CERTIFICATE OF Mr. Lester Fant, Orange County Chair- RECOGNITION man, American Red Cross, presented to Eon Lewis~ Swimming Pool Manager for the Recreation Department, a plaque commending the department's activity in teaching youngsters to swim. BID AWARD - On motion of Councilman Hubbard~ STOP~4 DRAIN seconded by Counci]zlan Schlueter and carried~ Council ordered filed a report of bids received for construction of storm drain in Bristol between Santiago Creek and W. Orange Road~ Project D-51; approved award of contract to Earnest A. Redfearn Company at unit prices; and rejected all other bids. HEARING - Mayor Hall opened the hearing WA~D BOUNDARIES continued from December 7~ 1964 for any objections or suggestions regarding the makt,xg of changes in Ward boundary lines prior to the General Municipal Election. The Clerk reported that no written communications or objections had been received. Mrs. Janice Boer, 912 N. Lowell~ requested that Precinct 99 be added to Ward 5 so that City's three shopping centers would not be in the same ward~ stating that the Honer Plaza Association supported such a change, and that the change would not disturb the ten percent balance required by law. There being no further testimony~ the hearing was closed. O~D. NS-772 WARDS ORDINANCE NS-772 CHANGING AiID ESTABLISHING THE BOUNDARY LINES OF THE WARDS OF THE CITY OF SANTA ANA was read by title. It was mOVed by Councilman Hubbard, seconded by Councilman Schlueter that further reading be waived and Ordinance NS-772 be passed to second reading. Mrs. Boer protested adoption of the motion without further co~ ideration of her request, stating all other requests for changes had been approved. Council- man Harvey explained that ward lines are based on population alon~ not types ~fbusinesses; that CounciLmen are elco. ted on City-wide basis and serve all people. Councilman Gilmore sta.~ed he could see no reason to make a change unless sc~eone from ~inct 99 wished~'~o run for Council. CITY COUNCIL - 126 . Rogers to amend ~ectional District Map 1-5-10 By reclassifying fram the C 1, C 2, and R 1 district to the C 5 district, prOPerty on the east side of Broadway Between Santa Clara and the Santa Ann Freeway. Planning Ceamissien Resolution 571B rec~n~ad approval of E~hiBit A.A. 527 D, which woul~ reclassify to the C 5 an~ P districts. The Clerk reported that notice of the hearing was published in The Register on December 5, 1~ and that a letter in opposition had Been received from Mrs. Charles Spicer, 23~ N. Park Boulevard. The letter was ox~ered filed on motion o~ Coumc~ HuBBar~ seconded by Councilman Schlueter an~ carried. Alex Bowie, ~01 W. 8th~ attorney representing the developer, reviewed the prOPosed plans, noting the C ~ district would impose control of plans; stating that the concept was attractive and functional end an asset to the city; and displayed a colored photograph of a scale medel of the proposed development. Charles -~er, 2B~6 N. Park B~ulevard, representing neighboring hc~eowners, protested encronchmant of c~erelal zoning into residential area and the aggravation of an already critical traffic situation. Arthur ~radley, 2~21 N. Park Boulevard, stated that wide selicitation for lessees had Been unsuccessl~al Because of the lack of exit frem the site. Charles Warter, 2320 N. Broadway, and Dr. Ralph Coc~ber, 2Bk5 N. Park Boulevard, also spoke in CITY COUNCIL - 127 - December 21, 196~ opposition, after which Mr. Rowie spoke in rebuttal, citing the types of businesees that would be attracted and the solutions to traffic problems that must be found with or without this development. Virginia Ferry, 2312 N. Broadway~ spoEe in favor of the rezon~. Mrs. Collins, 23~8 N. Pare Boulevard, speaking for a group of neiEhbors, expressed opposition. Mrs. Lee Woods, 2311 Riverside Drive spoke in opposition. There being no further testimony, the hearing was closed. The Planning Director noted the Master Plan called for business and service commercial and outlined the type of businesses, which are considered secondary uses to prefessic~al zone; stated that a protective landscaping strip fifteen feet wide along Broadway was reccmmended~ and that no structure would be closer than sixty feet to Broadway; that if development other than shown were proposed, building permits could be Withheld and a re-zoning enacted. He also explained that present street construction was inadequate to handle increased traffic, but that Dr. Faustman, traffic consultant working on the General Plan, had prepared a solution which City Engineers are evaluating for submission in the General Plan. It was moved by Counc~lm~n Gilmore, seconded by Councilman Schlueter that Co~mcil approve the reclassification and instruct the City Attorney to prepare a~ amend- i~ ordinance according to E~hibit A.A. 527-B. Mayor Hall stated the development should be as shown by the applicant, otherwise he would be unalterably opposed to it. The motion to approve the reclassification according to E~hihit A.A. 527-B was adopted. HEARING - Mayor Hall opened the heari~ on A.A. 528 - EANNARENO Amendment Application 528 filed by Joseph M. and Rose Marie F~areno to amend Sectional District Map 7-5-9 by reclassifying from the R B to the C B district, property on the west side of Spurgeon between 6th and 7th. Planning C~mmtssion Resolution 5711 rec~ended approval of E~hibit A.A. 528 A revised, w~ich would reclassify to the C 3 and P districts. The Clerk reported that notice of the hearing was published in The Register on December 10, 196~ a~ that no written co--cations or objections had been received. Pacific tracks will align with those over the underpass structure. No. 8, $300 for refinishing concrete top of backwall of abutments. AUCTION REGULATIONS On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, consideration of report regarding Phil Hanson's request for change in auction regulations was continued to January ~, 1964. APPEAL iN - The Planning Director reported regarding HALL Appeal 1~8 filed by Clarence ~L. Hall frc~ the Planning Commission's denial of Variance Application 1999 to construct 37 four unit apartments with less than required front and side yard setbacks in A 1 and C 1 districts at 317 N. Euclid, stating that all points of difference had been resolve~ except the number of units. The Planning C.-~mission recmmaended approval subject to certain conditions. Luigi Salvaneschi, 24202 Stanford, submitted a letter from Dr. C. The Planning Director stated that Con~lition D (1) as revised in his report would make this acc~--,odation.
