The City Council of the City of Santa Ana hereby finds, determines and declares as follows: Historically the Orange County Sanitation District has increased the sewer user fee in fairly small increments using debt financing to smooth the impacts of the capital improvement program (CIP). The District now proposes to change from this process which yields a minimal rate of increase to a front-end loaded program. The District is considering alternatives to increase the sewer service user fee that range from ten percent (10%) annually for 15 years to a forty percent (40%) annual fee for two years with additional increases (22%, 19% and 4% respectively) in the following three (3) years. At this time, the District is proposing the 15 percent annual increase in each of the next 9 years. The City's concern is that there is limited information available that identifies specific or mandated requirements for the District's CIP. Additionally, the District hasn't considered deferring or phasing its programs. There are issues of scheduling, prioritizing and the cost and benefit of programs that have not been provided. Given the State and local government's current economic challenges, City staff recommends opposing the District's proposed annual increase of 15 percent in the sewer user fee. Instead, the District should reduce the increase and utilize their nearly half a billion dollar reserves to fund the CIP. Section 2. The City Council of the City of Santa Ana hereby urges the Orange County Sanitation District to reject the proposed fifteen percent (15%) sewer service user fee. Increase Section 3. This Resolution shall take effect immediately after its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
