A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA ESTABLISHING A UNIFORM SCHEDULE OF
MISCELLANEOUS FEES FOR FISCAL YEAR 2003-2004
AND REPEALING IN PART RESOLUTION NO. 2002-041
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1: The City Council hereby, finds, determines and declares as follows:
A. Each year, for the convenience of the public the City Council gathers in a
single document a comprehensive listing of fees and service charges
imposed by the City upon that limited number of persons seeking services
of value from the City, for the public's convenience, various rates charged
for City commodities, such as the water rate, are also included in this
document.
B. This document is known as the "Miscellaneous Fee Schedule" for Fiscal
Year 2003-2004 and is attached to this resolution and made a part hereof
• by this reference.
C. As part of approving the Miscellaneous Fee Schedule for Fiscal Year
2003-2004, the various agencies of the City have analyzed the cost to
administer the various programs, activities and applications for which the
City charges, fees or service charges.
D. In a few, limited circumstances, agencies have determined that the cost to
the City to process or undertake the services set forth in the
Miscellaneous Fee Schedule has increased over the prior fiscal year by
approximately 4% (or 5% for fees for services provided by the Fire
Department), so that certain proposed fees for Fiscal Year 2002-2003
have been increased by this percentage, or by this amount rounded.
These p ercentages r eflect t he s alary i ncrease for 2 003-2004 n egotiated
between the City and various bargaining units recognized under the
Meyers-Millias-Brown Act.
E. The Council finds that the cost of providing the services set forth in the
Miscellaneous Fee Schedule has risen by 4% (except for fees for services
provided by the Fire Department, which the Council finds have risen by
5%) and that this reflects the cost of administering certain programs,
activities or applications for which the City levies charges, fees or service
• charges.

F. Similarly, in a few limited circumstances, new charges have been added
or existing charges raised beyond this 4% (or for the Fire Department, 5%)
cost of providing services. In each of these cases, the Council further
finds, determines and declares that such new or increased charges, fees
or service charges do not exceed the City's reasonable cost to provide the
pertinent service, process the specified application or administer the
certain program.
G. In order to have a single comprehensive document for Fiscal Year 2003-
2004, the majority of fees which are unchanged have simply been
reprinted in the Miscellaneous Fee Schedule. The Council expressly
states that it is not its intention to repeal previously adopted fees and
adopt new fees of exactly the same amount, but is simply repeating these
fees so that the Miscellaneous Fee Schedule can continue to be a
comprehensive source of City fees and service charges.
H. Based upon the testimony, reports and other evidence submitted on this
matter, this city council makes the above -specified findings.
Section 2: The Miscellaneous Fee Schedule for Fiscal Year 2003-2004 is
hereby adopted. Each fee or service charge set forth shall be levied until further
resolution of this Council.
Section 3: To the extent that any fee or service charge established pursuant to
City Resolution No. 2002-041 is inconsistent with the fees or service charges
established pursuant to this Resolution, then said Resolution No. 2002-041 is hereby
repealed.
Section 4: If any charge, fee, service charge, section, subsection, sentence,
clause, phrase or word of this Resolution is for any reason held to be invalid by a court
of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Resolution. The City Council hereby declares that it would have passed
and adopted this Resolution, and each and all provisions hereof, irrespective of the fact
that one or more provisions may be declared invalid.
Section 5: That except as may be stated otherwise above, this Resolution shall
be operative from and after July 1, 2003.

1) Downtown Event Litter Control Deposit

This deposit will be collected from organizations requesting permission to hold an event
in the Downtown area. The deposit will be applied to applicants who leave the area in
an unclean condition. The deposit will offset staff and contract costs for removing litter

4) Dog License — Duplicate Certificate Fee

Department: Treasury & Customer Service Division
The City presently charges $3.35 for issuance of a replacement dog tag. Establishing a
fee for reprinting a dog license certificate is considered an extension of the replacement
dog tag fee. This fee will help recoup costs associated with reprinting and mailing dog
license certificates.
5) Dog License - Non -Compliance Fee
Proposed Fee(s): $46.00 Per License
Department: Treasury & Customer Service Division
Currently, the County of Orange charges a $46.00 Non -Compliance Fee to dog owners
who require field enforcement for compliance with dog license requirements/laws. The
County of Orange administers its own dog -licensing ordinance for the areas of the
unincorporated county and is also the Contracted Dog License Enforcement Agent for
18 Orange County Cities, including Tustin, Garden Grove, Anaheim and Huntington
Beach.
The Orange County Animal Care Services Division assesses the $46.00 Non -
Compliance Fee in all 18 of its contract cities as well as throughout the unincorporated
county areas. They report that the assessment of this fee has proven to be a very
successful method to both expedite payment by chronic late payers and to recover field
enforcement costs.
6) Business License Tax Collection Fee
Proposed Fee(s): $40.00 Per Inspection
Department: Treasury & Customer Service Division
This fee is assessed based on salary and overhead costs for the license inspector to
perform the collection. The Business License Tax Collection Fee would be assessed and
collected at the time the Business License Tax Collector performs a field collection.

The fee is for plan review of aboveground storage tanks utilized for the storage of
hazardous materials. The fee is primarily for cost recovery for plan review and filed
inspection of aboveground tanks.
The legislative reference to allow the fee is California Health and Safety 13916.
8) Alternate Materials and Methods Request
Proposed Fee(s): $180.00 Per Request
Department: Fire Prevention
The fee is for plan review and Fire Marshal consideration of requests for alternate
construction methods as prescribed by the Uniform Fire Code. The fee is based on cost
recovery as well as a similar established fee with the Planning and Building Agency.

The Library will be utilizing a collection agency specializing in libraries to assist in the
recovery of overdue fines and lost material. The Material Recovery Surcharge Fee will be
added to a patron's account once the account is turned over for collections. Patron
accounts will be turned over to the collection agency once the account is overdue by 42
days and has been issued 3 overdue notices from the Library directly.
The proposed fee equals the fee the collection agency charges the Library per account.
10) Computer Rental
Proposed Fee(s): $5.00 Per Half an Hour
Department: Administration/Circulation
Santa Ana residents and City employees qualify for a free library card and have access to
the Library's computers at no charge. Non-residents may obtain a library card by paying a
$45 annual fee or a $15 per day fee for full use of the library's services. The computer
rental charge will allow non-resident, non -library cardholders who do not want to pay the
annual or per day fee access to the Library's computers. The computer rental fee will be
collected at the circulation desk.
11) Passport Application Fee

The proposed fee is to help offset staff costs for processing passport applications.

the Police Department for time spent and various other costs associated with the storage and
impound of vehicles. This includes the officer's time waiting for the tow truck arrival,
completion of paperwork, computer entries, records functions, post -storage hearings and
activities required to release the vehicle. The proposed fee will be deposited into the City's
general revenue fund.
