A RESOLUTION ESTABLISHING POLICIES AND
PROCEDURES FOR CITY PARTICIPATION IN AMICUS
CURIAE LEGAL BRIEFS.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1. The City Council of the City of Santa Ana hereby finds, determines
and declares as follows:
A. From time to time the City of Santa Ana is requested by other public agencies,
the League of California Cities or other municipal organizations to participate in
"amicus curiae" or friend of the court briefs in pending litigation of importance to
local government; and,
B. It would be expedient to authorize the City Attorney and City Manager to
determine whether or not to authorize such participation without formal action in
advance by the City Council.
Section 2. The City Attorney, following consultation with the City Manager, is
hereby authorized to approve the participation of the City of Santa Ana as an amicus
curiae upon the request. Prior to giving final approval, the City Attorney shall notify the City
Council in writing of the intended participation with the basis for the action. Upon the
request of any one Councilmember following receipt of such notice, the City Attorney shall
agendize the matter for Council action. If time does not permit to do so, the City Attorney
shall withhold amicus participation.
Section 3. This Resolution shall take effect immediately upon its adoption by
the City Council, and the Clerk of the Council shall attest to and certify the vote adopting
this Resolution.
