~EARING - Mayor Harvey announced that this was the
ASSESS. DIST. 227 time and place fixed by Resolution 65-94
for hearing protests or objections to the
propose~ work, the extent of the proposed
assessment district or the proposed grades in Assessment. District 227 (Figmeroa-
Fifth) and the hearing on whether public convenience and necessity require
such improvements, a~d whether the same shomld be ordered without applicatio~
of the Special Assessment Investigation, Limitation an~ Majority Protest Act
of 1931~ On motion of Councilm-u Gilmore, seconded by Councilman Nerrin and
carried, the Affidavit of Publication and the Certificates of Mailing and
Posting Notice of Hearing were ordered filed.
Franklin T~ Hamilton, 611 Wilshire, Los Angeles, Special Counsel for the City,
explained the purpose of the hearing. Ronal~ Wolford, Director of Public
Works, testified concerming the nature of the work and the extent of the
assessment district, stating that in his opinion all lots and parcels of
within the proposed assessment district will be benefited by the proposed work.
The Clerk read a letter of protest received from the Honorable George B.
Honold, Mayor of the City of Garden Grove~ opposing inclusion of a strip of
land 746 feet long and 150 feet deep on the west side of the Willowick Golf
Course, since no benefit would accrue to the golf course.
Tom Huebner, Administrative Assistant, City of Garden Grove, reviewed the
steps leading to Garden Grovels interest in purchasing Willowick GoLf Course,
.and stated that the Garden Grove City Council was concerned with long range
planning to maintain the area as a recreational facility and that it should
be considered a park. Ne quoted from Section 5301 of the Streets & Highways
Code regarding permissible ommission of publicly owned land from assessment.
Mr. Nuebner protested the entire inclusion of the golf course property and
specifically the 746 feet on the west side and the parcel east of unimproved
Clinton Street and Fifth Street.
Mro Hamilton advised the Council that the property is owned by a non-profit
organization amd that no exemption is provided un~er Section 53G1 for such
organizations$ that the Council shoul~ disregar~ presant land uses since uses
can c~-~Ee. The Pmblic Works Director testified the property is benefitted
because it can be drained by gravity flow, and reported that the written
protest represente~l approximately 5% of the area of the property to be
