Main Street. Roll call was answered by Councilmen James Gilmore, Walter Brooks, Davis Burk, J. Ogden Markel, Tom McMichael, and Mayor Harry H. Harvey. Councilman Wade Herrin was absent. APPROVAL OF On motion of CounciLman McMichael, MINUTES seconded by CounciLman Burk and carried, Council approved the Minutes of %he Regular Meeting of September 20, 1965, corrected as follows: Delete "representing Orange County Plumbing" under item titled "Drainage Problem" on page 357- On motion of Councilman Brooks, seconded by Councilman McMichael and carried, Council approved the Minutes of the Adjourned Regular Meeting of September 30, 1965. INVITATION Municipal Stadium for presentation of Fire Marshall Bachtelle extended an invitation to Council to attend the Fire Prevention Parade to be held October 9th, which will end at the awards by Council members. PARKING DISTRICT It was moved by Councilman Brooks, seconded by Councilman Burk and carried, that, for the convenience of the participants, the report on formation of a parking district requested by the Parking Development Committee, Santa Aha Downtown ~ssociation, be considered at this time. The City Manager stated that valuable assistance could be given by the City in helping the Santa Ana Downtown Association ronda parking district by providing forms, data, and personnel services, for $500 to $1,000, but this would not include circulating the petitions. He reviewed the history of the northeast parking district. Lorin Griset, Vice President of the Santa Ama Downtown Association, and Chairman of the Parking Develoument Committee, stated that apparently the 19~3 law was the most practical means of forming a Parking District, and the Co~ittee planned to follow this procedure. Mr. Griset described the tentative boundaries for the proposed district as Flower, First, French, and Eighth Streets excluding the Civic Center~ concluding that if 61% of the property owners sign the petition, the committee will come to Council with a definite proposal. Joe Gilmaker, 308 W. 4th, submitted to Council a letter requesting his property be excluded from the project. On motion of CounciLman GiLmore, seconded by CounciLman Burk and carried, the letter was ordered filed. CITY COUNCIL ~ 369 - October 4, 1965 Janice Boer, 912 N. Lowell, pointed out that Assembly Bill 103 passed in May, 1965, provided a law other than the 194~ act, and its use would guard against use of condemnation; that of the 77 proposed square blocks in the proposed district, 28 are either used or proposed as civic buildings. Mr. Griset defended eminent domain, remarking that many of the downtown properties are held in trust and can only be acquired under eminent domain. On motion of Councilman Brooks, seconded by Councilman Burk and carried, Council authorized the Parking Development Committee to proceed in their attempt to create a parking district, and authorized City to assist with staff and information in an amount not to exceed $1,000. BID AWARD - On motion of Councilman Brooks, ADDITION TO seconded by Councilman Burk and EL SALVADOR REC. carried, Council ordered filed report of bids received for addition to E1 Salvador Recreation Center, Spec. 672-17; awarded the contract to Goodman Construction Co.; and rejected all other bids. BI]) AWARD - On motion of Councilman Harkel, FIRE ENGINE seconded by Councilman Gilmore and carried, Council ordered filed report of bids received for Fire Engine, Spec. 626-8, awarded the contract to Seagrave Fire Apparatus, Inc.; and rejected all other bids. BID AWARD - On motion of CounciLman Markel, FIRE HOSE seconded by Counci]m~n McMichael and carried, Council ordered filed report of bids received for fire hose, Spec. 631-6; awarded the contract to Wardlaw Fire Equipment determined to be lowest and best bid; and rejected all other bids. BID AWARD - On motion of Councilman McHichaet, PARK IMPROVEMENTS seconded by Councilman Markel and carried, Council ordered filed report of bids received for improvements to park on Mabury, Project C-1~7; awarded the contract to R. J. Noble Co. at unit prices; and rejected all other bids. ORD. NS-823 ORDINANCE NS-823 AHENDING THE REGULATIONS - SANTA ANA MUNICIPAL CODE AND ADOPTING REFUSE REGULATIONS FOB THE COLLECTIONAND DISPOSAL OF ALL REFUSE ACCUMULATED IN THE CITY AND REPEALING SECTIONS 5200 THROUGH 5205., INCLUS/VE, OF THE SANTA ANA MUNICIPAL CODE was read by title. It was meved by Councilman Gilmore, seconded by Councilmmn Burk and carried, that the final reading of Ordinance NS-823 be continued to the meeting of October 18th for receipt of any comments from the city's refuse collection contractor. The City Manager handed police reports ~ ~ regarding liquor license applications to Council; expressed concern about confidential police records beccming public; and stated no information submitted warranted a recc~mmendation for protest in his opinion. Councilmen Gilmore and Burk stated concern about the high crime rate in certain areas; asked the Manager to assist Council in finding means other than protest to apply; and requested police reports be continued. RECESS At 3:28 p.m. the Mayor declared a five minute recess. The Council reconvened at 3:35 p.m. with the same Councilmen present. PERSONNEL BOARD On motion of Councilman McMichael, APPOIB/I~ENTS seconded by Councilman Burk and carried, Peter Math and Richard Loughlin were appointed to replace Messrs. Stauffer and Larsen on the Personnel Board~ whose terms expired July 1, 1965. Terms of the new appointees will end July 1, 1969. BUSINESS LICENSE WAIVER On motion of Counc~lm-n Brooks, seconded by Councilman Markel and carried, Council authorized business license issuance without fee to Orange County Association for Retarded Children to operate Thrift Shop at 422 W. 4th Street provided all code requirements are met. BUSINESS LICENSE TAX A written report of staff study regarding the Chamber of Cc~merce proposal to remove the City's business license tax was not completed, but the Manager stated it would recc~mend that the tax not be removed and cited reasons therefor. Chamber of Commerce represent~tivem withheld comment pending receipt of the written report, which the Manager said would be available in a few days. Councilman ~rkel read a statement urging immediate consideration of a new City Hall and asked the Clerk to send copies to each Councilman. FEE SCHEDULE Councilman Brooks questioned whether or not the City's fees for variances and conditional use permits were high enough to cover costs and asked the Manager to report on this to Council. The Manager felt the Building Department fees would about cover operation of the department. CITY COUNCIL - 374 - October 4, 1965 MASSAGE PARLOBS The City Manager briefed Council on proposed legislation for the City concerning massage parlors, which have become a problem in nearby cities. Council meeting, not appearing on the Mrs. Janice Boer, 912 N. Lowell, requested that in the future the Mayor publicly announce the contents of any item handed him duringthe agenda. ECONOMIC OPPOR. ACT Dave Dowell~ 12261 Redhill Avenue~ asked for information concerning the Economic Opportunity Act and the City's participation in the program. The Mayor replied that the Council had taken no action in the matter and had little information on it, but noted that a Poverty Program was being initiated by the Orange County Board of Supervisors. A~TOBNEY ' S ABSENCE On motion of Councilman Brooks, seconded by Councilman Burk and carried, the City Attorney ~as granted permission to be absent on vacation October 8th, 14th and 15th. COUNCILMAN' S ABSENCE On motion of Councilman Brooks, seconded by Councilman B~rk and carried, Council granted permission to Councilman McMichael to be absent from the October 18th meeting. RECESS At 4:17 p.m., on motion of Councilman Brooks, seconded by Councilm~R Burk and carried, the meeting was recessed to 7:30 p.m. The meeting was reconvened at 7:30 p.m. in the Council Chambers, with all Councilmen present except Councilman Wade Herrin. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Robert Shuler~ First Methodist Church. ORD. NS-830 ORDINANCE NS-830 CNANGING DISTRICT AA 550 - VOSE CLASSIFICATIO~ON AMENDMENT APPLICATION NO. 550, FILED BY CLARA E. VOSE, AND AMENDING SECTIONAL DISTRICT MAP 2-5-10 (EXHIBIT AA 550 A-Revised) was introduced by title for first reading. Dr. John Holiday, 1223 River Lane, speaking for the protestants, requested a new hearing, stating so many continuances had been granted in prior proceedings that opponents were not aware a decision would be made on September 20th. It was moved by Counc~lmmn McMichaet, seconded by Councilman Gilmore for discussion only~ that~ the action of September 20th be rescinded and the matter be referred back to the Planning Co~nission for rehearing and a definite recommendation to Council. AFter considerable discussion of CITY COUNCIL - 375 - October 4, 1965 Planning C~ission action, precedent factor, and legality of action, the motion was lost on voice vote. Inasmuch as the applicant's representative was not present, it was moved by Councilman Gilmore, seconded by Councilman McMichael, that action on Ordinance NS-830 be postponed to October 18th at which time arguments will be made solely on the issue of setting a new hearing. Mayor Harvey noted Council would hear one representative of the applicant for rebuttal of the opponents' statements. The motion carried on roll call vote: AYES, COUNCILMEN: NOES, COUNC II-MEN: ABSENT, COUNC II~EN: Gilmore, ~arkel, McMichael, Harvey B~ooks, Burk Herrin H~R~ ING - Hearing was opened on Appeal 166 APPEAL 166 - VA 2170 filed by Donald R. Rochambeau from the Planning Commission's denial of Variance Application 2170 to construct a two story duplex with less than required front and rear yard setbacks at 2210-2212 Valencia Street in the R 2 district. The Clerk reported that notice of the hearing had been mailed to adjacent property owners as required by law and evidence thereof was on file; that a letter favoring the variance had been received from Hays, 501 E. Buffalo. On motion of Councilman GiLmore, seconded by Council~n Brooks and carried, the letter was ordered filed. Donald Rochambeau, 13742 Gilbert Lame, stated he was protesting the Planning Commission's decision because of their indication that Valencia should be extended on to his property to the cul de sac; that widening the street would be costly to the City and more benefit would be derived from taxes on his improved property. He also commented that adjacent property oWners favored the Lmprovement. Harold Peck, 2243 N. Valencia, protested the hazard a half street would cause if the application is approved and suggested purchase of the property by the City for street widening. There being no Further testimomy, the hearing was closed. On motion of Councilman Mc~4ichael, seconded by Councilma~ B~ooks, and carried by 4 - 2 vote, Council upheld the action of the Planning C~ission and instructed the City Attorney to prepare a resolution denying Variance 2170. HEARING - Hearing was opened on Appeal 167 APPEAL 167 - VA 2168 filed by Robert E. Decker from the Planning Commission's denial of Variance Application 2168 to construct a duplex on the rear of an R 1 lot containing two existing dwellings at 4406 Regent Drive. The Clerk reported that notice of the hearing had been mailed to adjacent property owners as required by law and evidence thereof was on file; and that no written communications had been received. Fred Sawyer, 13111 Chirping Sparrow Way, Tustin, representing the applicant, distributed plans of the project to Council, showing a change in the building's position. He explained as a hardship to the owner the large lot which required much yard care, and presented a petition with about 21 signatures of property owners who favored the project. On motion of Councilman B~ooks, seconded by Councilman Gilmore and carried, the petition was ordered filed. Speaking La opposition, Del Michael, 917 S. Toland, President of the Southwest Homeowners Association, favored retention of R l, pointing out many in area wanted to keep horses; Madelyn Cenkar, 806 S. Flintridge Drive, noted other oversize lots in area would press for duplexes or apartments. In rebuttal, Mr. Sawyer stated that other owners would not be kept from having animals, and that the matter should be considered from the standpoint of the individual involved and not the group. There being no further testimony, the hearing was closed. CITT COUNCIL - 376 - October 4, 1965 At the request of Mr. Michael, the Clerk read the n~mes of petitioners favoring the variance. It was moved by Councilman Burk and seconded by Councilman Brooks, that Council overrule the action of the Planning Cc~mmission and grant Variance 2168, subject to conditions. The motion was lost on roll call vote: AYES, COUNCILMEN: NOES, COUNC II~N: ABSENT, COUNC II~{EN: Brooks, Burk Gilmore, Markel, McMichael, Harvey Herrin It was moved by Councilman McMichael, seconded by Councilman Markel that Council uphold the action of the Planning C~mmission and instruct the City Attorney to prepare a resolution denying Variance 2168. It w~s moved by Councilman McMichael, seconded by Councilman GiLmore and carried, that the matter be referred to the Planning Department staff for recommendation as to the desirability of rezoning the area. The motion carried on roll call vote: AYES, COUNCILMEN: NOES, COUNCII~EN: ABSENT, COUNCILMEN: Gilmore, Brooks, Markel, McMichael, Harvey Burk Herrin HEARING - Hearing was opened on Appeal 168 filed APPEAL 168 - VA 2166 by Sidney Levin from the conditions imposed by the Pls~ning Co~ission in its approval of Variance Application 2166 to permit parking, damaged vehicle storage, and side yard waiver for a service building at 3712 Hazard in B 2 district. The Clerk reported that notice of the hearing had been mailed to adjacent property owners as required by law and evidence thereof was on file; and that no written communications had been received. Dale Heinly, 611 W. 8th, representing the applicant, stated the Planning Commission had imposed conditions on adjacent property not a part of application. He suggested that applicant was willing to dedicate Harbor with no improvements, dedicate Hazard to Figueroa including spandrel~ and dedicate Figueroa; and asked City to impose conditions of improvement only to existing pavement. The Manager stated staff's acceptance of compromise. There being no further testimony, the hearing was closed. On motion of Councilman Brooks, seconded by Councilman GiLmore and carried, Council instructed the City Attorney to prepare a resolution granting the appeal amd modifying the conditions of Variance 2166 to require dedication of all areas requested and all improvements up to existing streets. RECESS At 9:00 p.m. the Mayor declared a five minute recess. The Council reconvened at 9:08 p.m. with the same Councilmen present. TRAFFIC HAZARD The City Manager reported regarding a communication and petition from Ed Attenborough, 2121 N. Edna Drive, asking improvements of south half of West Edna Drive at Lewis; stating that a written request to the County Supervisors for an easement to even out the width of the street would be submitted, and if granted the street would be improved on a mini~l level to provide traffic safety. OF SURVEY 434 On motion of Counci]mAn Markel, seconded by Councilman Burk and carried, Council approved Preliminary Record of Survey 43~ filed by Donn Calder to create two M i and M 2 parcels west of Grand on the south side of Hunter, subject to the conditions outlined in the Planning Director's report dated September 27, 1965, and waived alley requirement. PRE. REC. OF SURVEY 431 On motion of Councilman Markel, seconded by Councilman Bu~k and carried, Council approved Preliminary Record of Survey 431 filed by Norman K. Beals, Jr., M.D., and King Manor and Convalescent Hospital to create three C 2 parcels east of B~istol on the south side of Warner, subject to the conditions outlined in the Planning Director's report dated September 22, 1965, and waived alley requirement. PRE. REC. OF SURVEY 433 On motion of Councilman Markel, seconded by Councilman Burk and carried, Council approved Preliminary Record of Survey 433 filed by Erico, Inc. and T. R. Bolte Development, Inc. to create two M 1 parcels between Grand and the Southern Pacific Railroad and south of McFadden, subject to the conditions outlined in the Plmgning Director's report dated September 23, 1965, and waived alley requirement. RES. 65-158 ST. ABANDONMENT Council received Planning Commission recommendation that thirty feet of right of way on Mantle, south of 22nd Street be abandoned. SALARY INCREASES On motion of Councilman Brooks, seconded by Councilman Burk and carried, Council approved two reports dated September 29, 1965 and one dated October 1, 1965 recomending salary increases for meritorious service. FINAL MAP 6036 Final Map, Tract 6036 was filed by Bristol Joint Venture creating 71 lots south of Segerstrom, west of Bristol. It was moved by Councilman Gilmore, seconded by Councilman Burk and carried, that Council approve Tract Map 6036, accept the dedications thereon, and authorize execution of the sub- division agreement. BID CAT~,M On motion of Councilam~ Burk, seconded by Councilman Brooks and carried, Council approved plans and specifications and authorized staff to advertise for bids for: Project 173 - construction of Edinger frc~ Maple to Grand; Edinger fr~n Lyon to Bitchey (County); and Project C-126 - construction of Grand 460' south of Edinger to 270' north of Edinger; opening date 10-26-65. REIMBURSEMENTS On motion of Councilman Markel, seconded by Councilman Gilmore and carried, Council authorized reimbursements to the following: Dr. W. M. Townsend, 1150 W. 10th, Santa Ana, $114.00 for paving in excess of local street requirement on F/linger, east of Fairview. Jezowski & Markel, 2619 W. Edinger, Santa Ana, $11h.O0 for paving in excess of local street requirement on Edinger; east of Fairwiew. Anaheim Investors, 843 S. State College Blvd., Anaheim, $57,271 for construction and dedication of Edinger and Grand within Tract 4471. Leonard V. Bouas, 315 N. Manchester, Anaheim, $4,234., constructing ultims~ street improvements for City at ,ortheast corner of Newhope and Hazard adjacent to Orange County Flood Control Channel. OVER-WIDTH DRIVEWAY On motion of Councilman Gilmore, seconded by Councilman Brooks and carried, Council approved request of Standard Oil to construct a 46-foot overwidth driveway at 1814 E. 1st. CITY COUNCIL - 379 - October 4, 1965 SURPLUS PROPERTY On motion of Councilman Brooks, seconded by Councilman Burk and carried, Council ordered filed City Manager' s Surplus Property Report 55-65 regarding irregular parcel south of McFadden, west of River, declared the property surplus and of value only to adjacent owner because shape precludes use as separate parcel, and authorized sale to adjacent owner. Del Michael, 917 S. Toland, asked that Council and staff notify Southwest Homeowners Association of any surplus property in the area suitable for play- ground purposes. APPROPR~TION ADJUSTMENT On motion of Councilman Markel, seconded by Councilm~u McMichael and carried, Council authorized the transfer of $350 from Account 51-551 to Account 51-569. STREET CLOSINGS Councilman Markel discussed the proposed closing of Talbert and Alton Streets and the effect on traffic from Huntington Beach. The City Manager stated that an extensive report on the matter would be coming to Council from the Planning Cnmmission. HARBOR CLIPPINGS In response to a request from Councilman Markel that the Mayor instruct the Clerk to furnish him with two copies of Harbor District clippings and material, Mayor Harvey stated he was certain the Clerk would furnish information on any subject for any Councilman upon request.
