Main Street. Roll call was answered by Councilmen James Gilmore, Walter Brooks, Davis Burk, J. Ogden Markel and Mayor Harry H. Harvey. Councilmen Wade Herrin and Tom McMichael were absent. APPROVAL OF MINUTES On motion of Councilman Gilmore, seconded by Councilman Brooks and carried, Council approved the Minutes of the Adjourned Regular Meeting of October 4~ 1965 and the Regular Meeting of October 4~ 1965. BID AWARD - On motion of Councilman Markel~ seconded MEDIAN ISLAND by Councilman Gilmore and carried, Council ordered filed report of bids received for construction of median island in 17th, 300' west of Bristol to 300' east of Bristol~ and in Bristol, 470' south of 17th to 240' north of 17th~ Project C-114; awarded the contract to C. E. Hurley Contracting Corporation at unit prices; and rejected all other bids. BI~ AWARD - On motion of Councilman Brooks, seconded AUTOMOBILES by Councilman Markel and carried, Council ordered filed report of bids received for four automobiles, Spec. 621-56; awarded the contract to L. D. Coffing Company; and rejected all other bids. BID AWARD - On motion of Councilman GiLmore, seconded AIR COMPRESSOR by Councilman Brooks and carried, Council ordered filed report of bids received for one air compressor, Spec. 623-25; awarded the contract to Orange Co. Equipment Co.; and rejected all other bids. BID AWARD - On motion of Councilman Brooks, seconded TRACTORS by Councilman Markel and carried, Council ordered filed report of bids received for two tracbors~ Spec. 623-26; awarded the contract to Adams-Sullivan, Inc. as the lowest bid meeting specifications; and rejected all other bids. CITY COUNCIL - 381 - October 18, 1965 BID AWARD - The City Manager filed with Council A.D. 229 a report of bids received for construction of sewers in Edinger- Newhope area Assessment District 229, recommending acceptance of the lowest bid by Orange Coast Pipeline Construction Company. NS-823 The Mayor announced that certain REFUSE COLLECTION inconsistencies in the language of Ordinance NS-823 regulating refuse collection, had been brought to his attention, and he recommended its referral to the City Attorney for clarification of terms such as rubbish, garbage, and refuse. On motion of Councilman Gilmore, seconded by CounciLman Burk and carried, Council postponed action on Ordinance NS-823 to the meeting of November l, 1965. ORD. The City Manager reviewed the matter~ which was complicated because two pieces of property were involved, and expressed willingness to accept Mr. Heinly's proposal that the requirement for improvements on Figueroa be eliminated. This resolution was corrected by deleting Condition No. 7 (b) the words "and Figueroa Street" and the words "and Figueroa Street, respectively". At the time Conditional Use Permit 159 was granted for a family recreation ca~ter at the same address for Bow 'N Cue Inc.~ it was specifically stated that no alcoholic beverages be sold. He recon~ended that Council present their objections to the Alcoholic Beverage Control Board. On motion of CounciLman Brooks, seconded by CounciLman Burk and carried, a Minute Order was adopted objecting to the granting of a liquor license to The Cue, since it would be in violation of Conditional Use Permit 159 granted CITY COUNCIL - 384 - October 18, 1965 for a family recreation center; and directing the City Attorney to prepare a letter to the Alcoholic Beverage Control Board expressing Council's objections and reconm~ending denial of the license application. PUC - Application of Tustin Water Works for authorization to increase rates. TRAFFIC - Report of devices installed or removed 9-29 through 10-13-65. C-5 DEVELOPMENT Dean Evans, 510 W. Chapman, Orange, representing Wayne Mead, owner of property at southwest corner of Bristol and llth, spoke regarding development for a single lot siding on Bristol, noting that a building permit had been denied on the basis of Council policy to prohibit such development on Bristol unless two lots are consolidated. He cited a Deputy City Attorney's opinion that such a requirement was not legal, and other similar developments on South Bristol had been allowed. The City Manager and Harry Trax, Assistant Planner, explained traffic problems on an arterial street with too many accesses as being the reason for the Bristol Street policy. CITY COUNCIL - ]85 - October 18, 1965 Wayne Mead, also spoke on behalf of his request. It was moved by Councilman Brooks, seconded by Councilman Nmrkel and carried~ that the Planning Department be in~ructed to approve Mr. Mead's plans~ provided all C-5 requirements are met. FORMS & SYSTEMS The City Manager reviewed his previous report regarding the Chamber of Commerce recommendation that an objective study of reporting and forms requirements of the City be made, stating that he recommended employment of Informatics Inc. for not more than $1,000 for a preliminary study toward the possibility of going into a computer system rather than a standardized procedures analysis by a management consultant. Richard Kopel~ representative of the Chamber of Commerce, stated that the Chamber was in favor of employing a management-consultant firm which could provide a recommendation and offer assistance in changing systems. He estimated cost of a,preliminary study at $5~OO0, 8nd submitted a report containing eight management-consulting firms and four certified public accounting firms. Mayor Harvey stated no action was necessary at this time~ following considerable discussion. However Councilman Gilmore felt it would do no harm to at least see what would be offered by the firms and moved that the firms listed be requested to send brochures for Council's consideration. The motion was seconded by Councilman Burk and passed with Councilman Markel voting No. Mrs. Janice Boer~ 912 N. Lowell, asked that the brochures be retained until public had an opportunity to see them. She also requested a tape recorder be purchased for meetings. VARIANCES Councilman Markel asked the City Manager regarding the policyof charging for variance applications for necessities such as gas pumps and canopies for a service station, and the City Manager stated thematter would be studied and a report made to Council. BUS LIC. TAX The City Manager's report regarding the business license tax not being ready~ no action was taken. DRIVEWAY ACCESS John Kilgore, 1345 S. Bristol~ stated he had been unable to obtain a curb cut after repeated discussions with various city departments, and had been referred to Council for action. Mr. Trax~ Assistant Plaaner, explained the Bristol Street policy to deny a curb cut when there is an alley to the rear providing secondary access. After consulting with the Public Works Director and the Assistant Planner~ Mr. Kilgore was advised the matter would be placed on the Planning Commission's agenda for 4:00 p.m. on October 25th. EXECUTIVE SESSION On motion of Councilman Gilmore, seconded by Councilman Burk and carried~ Council adjourned to executive session for discussion of a personnel matter at h:22 p.m. CITY COUNCIL - 386 - October 18~ 1965 RECESS Council reconvened at 4:55 p.m. with-e~ members present, and the Mayor declared a recess to 7:30 p.m. The meeting was reconvened at 7:30 p.m. in the Council Chambers, with the same Councilmen present. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Everett Hezmall, Wilshire Presbyterian Church. CERTIFICAT~ OF APPRECIATION Mayor Harvey presented Certificates of Appreciation to Messrs. William J. Stauffer and Thomas Larsen for their service on the Personnel Board. ORD. NS-830 ORDINANCE NS-830 CHANGING DISTRICT A.A. 550-VOSE CLASSIFICATIONS ON AMENDMENT APPLICATION NO. 550, FILED BY CLARA E. VOSE, AND AMENDING SECTIONAL DISTRICT MAP 2-5-10 (EXHIBIT AA 550 A - REVISED) was read by title. The Mayor announced that only testimony regarding legal technicalities of the hearing which was closed would be heard, and called attention to the fact that two Councilmen were absent. John Parker, 1010 N. Main, attorney representing Santa Ann Homeowners Association, stated that residents in the area had not been able to present their arguments because of the many continuances, and asked for reopening of the public hearing; concluding that he had not examined the proceedings and could not comment on legal technicalities. John Harvey~ attorney representing the applicant, commenting on the argument that opponents were not adequately heard, observed that spokesmen, Holiday and Cohen, had certainly spoken adequately; that the applicant could not add to another hearing, and he doubted anyone else could without being repetitious. It was moved by Councilman Burk, seconded by Councilman Brooks, that further reading be waived and Ordinance NS-830 be passed to second reading. M~r. Parker stated that if the hearing was not going to be reopened it would be to the disadvantage of the residents to have action taken when a full Council was not present, and asked for a continuance. The Mayor replied that at the next Council meeting representatives would be able to make their presentations to a full Council and that holding first reading of the ordinance was not a conclusive action. ~ne City Attorney added that tonight's discussion was not a hearing but to determine if an error had been made in the proceedings. The Mayor called for a voice vote and the motion to pass the ordinance to second reading carried. Mayor Harvey invited Mr. Harvey and Mr. Parker to come to the next meeting if they have any evidence pointing to a legal defect in the proceedings. HEA~ING - Hearing was opened on Amendment Application A.A. 563 - KOCHAN 563 filed by M. L. Kochan proposing the amendment of Sectional District Map 9-5-10 by reclassifying from the R i to the C 5 district, property on the east side ef LaBonita between Westminster and 16th Street. Planning Commission Resolution 5753 recommended denial. M. L. Kochan, applicant, stated that the Planning Commission decision had been made because they did not wish the street to become commercial and because of small lot size. He stated that storage facilities existed on the CITY COUNCIL - 387 - October 18, 1965 street and hea~y trucks were using it; that he had been assured by his contractor that four offices could be placed on the lot by building a two- story structure. Harry Trax, Assistant Planner, displayed maps of the area, explaining that Planning Commission policy was not to rezone to commercial small lots on side streets. There being no further testimony, the hearing was closed. It was moved by Councilman Markel, seconded by CounciLman Brooks and carried, that Council deny the reclassification. HEARING _ REFUSE COLLECTION Hearing was opened on proposed change to service charge for refuse collection~ set by Council September 30, 1965. On motion of Councilman Markel~ seconded by Councilman Brooks and carried, Council continued the hearing to November l, 1965, inasmuch as the Manager's written report was not completed. COMMERCIAL-RESIDENTIAL Council considered the recommendation DISTRICT from Planning Co~ission proposing the amendment of the Municipal Code to add a new Commercial-Residential District. The City Manager informed Council that contacts had been made with sign representatives~ who requested that the matter be continued for two months to permit study. On motion of Councilman Brooks, seconded by Councilman Burk and carried, Council continued the matter to December 20, 1965. ZONING VIOLATIONS On motion of Councilman Brooks~ seconded by Councilman Gilmore and carried, Council referred to staff for investigation and action~ request of M. Gerst that zoning violations on Washington from Santiago Street to the Freeway off-ramp be abated. LEGISLATION After considering a communication from the City of Long Beach and hearing a report from Councilman Brooks regarding League of California Cities action, on motion of Councilman B~ooks, seconded by Councilman Burk and carried, Council instructed the City Attorney to draft a resolution urging Governor Brown to consider as a special item at this Legislative Session the matter of making it a felony to possess or use a Molotov Cocktail or other incendiary object. SEWE~ LINE Council considered the request from County Sanitation District No. 7 to purchase from the City at construction cost, sewer line running northerly from 17th Street and lying in Tustin Avenue to its northerly terminus in Tustin Avenu~ being a continuation of the sewer recently acquired by the District from the City. The City Manager reviewed the past City policy, stating that originally staff had recommended that the portion lying north of 17th not be sold because the line was built to serve adjacent properties and had been built with a capacity to accommodate areas outside of Santa Ana~ in order to encourage their annexation to the City. He expressed concern that the Sanitation District might be able to condemn City lines, and requested a ruling from the City Attorney. CITY COUNCIL - 388 - October 18~ 1965 On motion of Councilman Brooks~ seconded by Councilman Gilmore and carried, Council postponed to the meeting of November 1st action regarding the sewer line, for further report and a City Attorney's ruling. pRZVATE WATER CO. On motion of Councilman Gilmore, seconded by Councilman Burk and carried~ Council ordered filed letter from John P. Quirk urging City to purchase that portion of the Southern California Water Company located within the city limits. CROSSING GUAED On motion of Councilman Gilmore, seconded by Councilman Brooks and carried, Council referred to staff for recommendation at the November 1st meeting, petitions requesting crossing guards at the intersection of Standard and McFadden and at the intersection of Standard and Hobart. REIMBURS E~MENTS On motion of Councilman Markel~ seconded by Councilman Gilmore and carried, Council authorized reimbursements to the following: Clara E. Vose, 1248 Memory Lane, S.A., $5~298.87 for constructing over improvements for paving at southeast corner of Bristol and Memory Lane; Security Fore Corp., 1565 Talbert, Costa Mesa, $3,278.50 for constructing oversize sewers as part of Tract 5580; Robert & Theodore Rosenson, 9470 Santa Monica, Beverly Hills, $2,874. for constructing oversize sewers in Tustin Avenue north and south of Santa Clara; Cal Enterprises, 2300 Westwood Blvd., Los Angeles~ $992.49 for construction of street improvements in exchange for dedication on Main Street; Frank Robel, 4006 Hazard, $953-86 for construction of street improvements in exchange for dedication on Hazard. CITY COUNCIL - 389 - October 18, 1965 BOND RELEASE Acting on the Public Works Director's report of satisfactory completion of improvements, on motion of Co~acilman Markel, seconded by Councilman GiLmore and carried, Council authorized release of bonds for Tract 4471, Edinger and Grand Avenues. FINAL TRACT MAP Final Map~ Tract 5953 was filed by Security Fore Corporation to create 60 lots west of Bristol and south of Warner. It was moved by CounciLman Brooks, seconded by Councilman Markel and carried, that Council approve Tract Map 5953, accept the dedications thereon~ and authorize execution of the sub- division agreement, subject to approval of the City Attorney. INTRODUCTIONS Del Michael, 917 S. Toland introduced to Council the Southwest Santa Ana Homeowner's new President, Mr. Stanley Hadsell~ 4122 W. Kent, and his son Del Michael, Jr., now President of the Southwest Homeowner's Junior organization. Mr. Michael pointed out in regard to the Vose amendment application that he felt the opponents had asked for a continuance of the hearing at the September 20th meeting. BARRIER REMOVAL Bill Van Riper, 2902 Fernwood Drive, speaking for signers of a petition submitted by residents living adjacent to the C. W. Todd property at the western end of W. Orange Road, protested the removal of a City barrier by C. W. Todd Jr., opening W. Orange to his property. He was informed that the matter was scheduled for the November 1st meeting. FEATHER RIVER Councilman Markel stated that he had PROJECT visited the Feather River Project and had been impressed by it. He asked that a letter be written to Governor Brown suggesting that the State post the area of the Project with informative signs and placards, showing the project is being paid for by the California taxpayers. ADJOURNMENT There being no further business to come before the Council, the meeting was adjourned at 9:10 p.m. on motion of CounciLman Gilmore, seconded by Councilman Markel and carried. DORIS M.
