Main Street. Roll call was answered by Councilmen James Gilmore~ Walter Brooks, Davis Bum"k, Wade Rerrin~ g. Ogden Markel, Tom McMichael and Mayor Harry H. Harvey. APPROVAL OF MINUTES corrected to read as follows on page 384: On motion of CounciLman Herrin, seconded by Councilman Markel and carried, Council approved the Minutes of October 15, 1965~ PIPE LINE LICENSE On motion of CounciLman GiLmore, seconded 'by Councilman Burk and carried~ Council authorized execution of pipe line licenses with Atchison~ Topeka and Santa Fe Railroad for construction across Santa Fe Railroad property north of 17th of sewer line according to Print No. L-3-Z756~J and of sewer and storm drain acccrdin~ to Print No. L-3-27334. On Page 387: change "all members present" to "the same members present." PROPERTY SALE The Mayor called for the Clerk's report of bids filed for purchase of surplus property on Adams Street east of Raitt, containing Lots 1 through 19 of Tract 5856, minimum bid to be $66,500. The Clerk opened and read aloud one bid~ received from Security Fore in the amount of $68~400. There being no response to three calls for oral bids, the property was declared sold to Security Fore in the above amount. A written statement of bid and a cashier's check for $9,000 were deposited with the Clerk. BID AWARD - On motion of Councilman Brooks~ PROJ. 173 seconded by Councilman Herrin and carried~ Council ordered filed report of bids received for Project 173, Edinger~ Maple to Grand, and Lyon to Ritchey; and Project C-126~ Grand, north and south of Edinger; awarded the contract to C. E. Hurley at unit prices; and rejected all other bids. BID AWARD - On motion of Councilman Gilmore, BRUSH CHIPPER seconded by Councilman Brooks and carried~ Cour~cil ordered filed report of bids received for one trailer mounted brush chipper, Spec. 652-10; awarded the contract to Dearth Machinery Co.; and rejected all other bids. CHANGE ORDERS On motion of Councilman Markel, seconded by Councilman Brooks and carried, Council approved the following change orders: Change Order One to contract with Orange Coast Pipeline Construction Co., $350.00 for Project S-38. Change Order Three to contract with Charles L. Butch & Sons~ $1,936.73 for Project D-52. Change Order One to contract with C. E. Hurley Contracting, $654.64 for Project 149. Change Order One to contract with Sully Miller Contracting, $812.20 for Project 155. ST. GERTRUDE Council considered request of CROSSING Industrial Development Division of the Chamber of Commerce for construction of connection of St. Gertrude Place over the Southern Pacific Railroad tracks between Grand and Standard. The Clerk reported that letters from Kaspar Lathing Co. and Y Square Marine, Inc. and a telegram from Fabmagic, Inc., supporting opening of St. Gertrude had been received. CITY COUNCIL - 393 - November 1, 1965 George Maxwell~ 802 W. 8th, Coordinator of Industrial Division of Santa Ana Chamber of Commerce, stated the opening was necessary to give additional traffic circulation in the industrial area, showing pictures of the street. The Public Works Director reviewed his report, opposing the suggestion based on the following points: St. Gertrude, a local street, is not designed to carry "through" traffic; Edinger and Warner are nearby and major streets; and the Public Utilities Commission would be opposed to another crossing. Mr. Maxwell replied that circulation within the industrial area was of prime importance; that the number of trains involved was nominal. A motion by Councilman Markel to proceed with opening of the street was not seconded. CounciLman Markel then made a motion that staff be authorized to contact the Public Utilities Commission for permission to cross the railroad tracks: which was seconded by CounciLman GiLmore, Discussion followed as to whether or not it was the intent of the motion that the City would proceed if P.U.C. peIvaission was granted. Councilman Markel stated that was his intent. Mr. GiLmore stated that this had not been his intention in seconding the motion, and wished to withdraw his second. It was moved by CounciLman Berrin~ seconded by CounciLman McMichael and carried~ that CounciLman GiLmore be permitted to withdraw his second to the motion. The motion died for lack of second. CounciLman McMichael then moved, seconded by Councilman Burk and carried, that the Department of Public Works contact the P.U.C. to see if they would allow a crossing at St. Gertrude Street. BID ERROR Walter McGonigle, representing Adams-Sullivan, Inc., explained to Council the company's mis- interpretation of the bid for backhoe, Spec. 623-26, and requested that the contract be voided or re- submitted for bidding. On motion of Councilman Brooks, seconded by CounciLman Burk and carried, Council authorized release of Adams-Sullivan, Inc. from their contract with the City. The City Manager recommended that the bid be awarded to the next lowest best bid meeting specifications. On motion of Councilman McMichael, seconded by CounciLman Herrin and cart [ed, Council approved award of the contract to Harron~ Rickard & McCone. Figueroa in R 2 district - APPROVED. V.A. 2182, Vilchis - reduce required distance between main buildings from 15' to 13'4" at 434 E. Central - APPROVED. CUP 206~ Edinger Church of the Nazarene - construct two second story class- room additions to existing church building that has less than required parking at 2033 W. Edinger in R 1 district - APPROVED. TRAFFIC REPORT On motion of Councilman Gilmore~ seconded by Councilman Burk and carried~ Council ordered filed report of traffic control devices installed or removed from October 13 through 27, 1965. soUTH MAII~ Harold Grimes, Director~ Traffic Committee of South Main Improvement Association, read to Council a resolution of the Board of Supervisors Of the Association~ requesting Council's assistance to preserve accessabillty to the business districts of Santa Ana by getting access to the Newport Freeway below MacArthur. The Manager reviewed the many attempts, without success~ to get support from various governmental agencies on this matter. Councilman Markel stated that the Association's secretary had been notified of a meeting to be held November 3rd with the Public Works Director, adding that Council will do whatever is possible to assist. SANITATION DIST.#7 Council received from the City Manager a report on request of Sanitation District ~7 to purchase sewer in Tustin Avenue~ north of 17th, in which he pointed out that sanitation lines have been constructed by the City for the potential development of abutting properties and for the provision of service to properties which can be annexed, concluding with a recommendation that the City not sell the line. A motion by Councilman Brooks, and seconded by Councilman Markel~ that the request of Sanitation District ~7 be denied was withdrawn with permission of Council after the Mayor called attention to the fact that the Sanitation District's representative was not present. It was moved by Councilman Brooks~ seconded by Councilman Burk and carried~ that the matter be tabled to the meeting of November 15, 1965. RECESS At 3:50 p.m. the Mayor declared a five minute recess. At 3:55 p.m. Council reconvened with all Councilmen present. 1ST ST. PABKING CITY COUNCIL On motion of CounciLman Gilmore, seconded by CounciLman Brooks and carried, Council ordered filed a letter from Lester Schwaiger, - 395 - November 1, 1965 President, Santa Ana Chamber of Commerce~ accepting the Public Works Director's report recommending no change in parking on First Street. CIVIC CENTER Robert rhomas~ Orange County Director of Building, presented the report and plans for the City-County Civic Center prepared by the Community Facilities Planners. Council also heard Don Hodgson of the O'Melveny &Mvers, Bond Attorneys, speak on financing programs and the Joint Powers Act. Also present were the Chairmen and members of the City-County Permanent Civic Center Committee. RECESS At 5:55 p.m. the meeting was recessed to 7:30 p.m. The meeting was reconvened at 7:30 p.m. in the Co~cil Chambers~ with all CounciLmen present. Following the Pledge of Allegiance to the Flag~ the Invocation was delivered by the Reverend James K. Thomann~ Spurgeon Methodist Church. ORD. NS-830 ORDINANCE NS-830 CHANGING DISTRICT VOSE CLASSIFICATIONS ON AMENDMENT APPLICATION HO. 550~ F~,~ BY CLARA E. VOSE~ AND AMENDING SECTIONAL DISTRICT MAP 2-5-10 (EXHIBIT AA 550 A - REVISED) was presented to Council for adoption. John Harvey, attorney, representing the applicant~ requested that the application for rezoning be withdraw~. On motion of CounciLman McMichael, seconded by Councilman Burk and carried, Council granted the request to withdraw the application and declared the property remain under its original classification. HEARING - Hearing was opened on Amendment A.A. 567-GELKE~ Application 567 filed by B. E. Bruce Gelker proposing the amend- ment of Sectional District Map 17-5-9 by reclassifying from the R 3 to the C 2 district property on the west side of Lyon between First and Chestnut. Planning Con~nission Resolution 5754 recommended approval of Exhibit A. The Clerk reported that notice of the hearing had oeen published in ~ne Register on October 16~ 1965, and no written communications had been received. There being no testimony~ the hearing was closed. On motion oi' CounciLman GiLmore, seconded by CounciLman Burk and carried, Council approved the reclassification and instructed the City Atto~mey to prepare an amending ordinance according to Exhibit A.A. 567 A. HE~RING - Hearing was opened on proposed REFUSE COLLECTION change to service charge for re~se collection. Mayor Harvey read a letter from Lester Schwaiger~ President of Santa Aha Chamber of Commerc% which requested that the matter be postponed to provide the Chamber with time to study the City Manager's proposal. On motion of CounciLman Gilmore~ seconded by CounciLman Burk and carried, Council continued the matter to the meeting of November 15~ 1965. CITY COUNCIL - 396 - November 1~ 1965 ST. VACATION The Clerk announced that notice of the hearing had not been published properly for Resolution 65-156, proposing vacation of street right of way known as Mantle, south o£ 22nd Street, and read the title of a new resolution of intention setting a new hearing date of December 6th. RESOLUTION 65-169 APPROVING MAP AND DECLARING I~ENTION TO VACATE STREET RIGHT OF WAY~ KNOWN AS MANTLE STREET~ SOUTH OF ~ENTY-SECOND STREM~ GIVING NC~ICE OF HF~RING THEREON~ AND RESCINDING RESOLUTION 65-156 was read by title. Studies revealed that no further traffic controls were needed at Standard and Mcfadden: and it was recommended that children be instracted not to use the east and south crosswalk; that further traffic control was not needed at Standard and Hobart, but that use of a school boy patrol be recormnended to the school. Mrs. Henry Honaker~ 841 E. Norman~ Ken Pruitt~ 1124 E. Hobart~ Principle of Madison School~ and Mrs. Barbara Benning, 820 Hobart~ spoke in favor of crossing &bards. Mr. Pruitt expressed opposition to school boy patrols~ because of the disruption of the school schedule. On motion of Councilman Gilmore~ seconded oy Councilman Brooks and carried, Council orderem filed the reports of the Public Works Director and denied the requests for crossing guards. RECREATION CFnNTER The City Manager reviewed the ADDITION circumstances resulting in a letter from Goodman Construction Company stating inability to obtain performance bond for contract to construct addition to E1 Salvadore Recreation Center~ awarded by Council 10-4-65. On motion of CounciLman Brooks~ seconded by Councilman Markel and carried~ Cotu]cil ordered the contract be cancelled and forfeiture of bid deposit. TENT. TRACT 6074 Tentative Tract Map 60'[4 was filed by R. A. Diedrich creating five R 1 parcels south and east of the intersecting streets, Hathaway and Twenty-first Streets. It was moved by Councilman McMichael~ seconded by Councilman Herrin and carried, that Council approve Tentative Tract Map 6074~ subject to the conditions described in the Planning Director's report dated October 15~ 1965. TENT. TRACT 6075 Tentative Tract Map 6075 was filed by George Farms, Inc., creating thirty-three A 1 parcels south of Mcfadden, west of Santa Aha River Channel. On motion of Councilman McMichael~ seconded by Councilman Herrin and carried, Council approved Tentative Tract Map 6075, subject to the conditions described in the Planning Director's report dated October 15, 1965. CITY COUNCIL - 397 - November 1, 1965 W. ORANGE ROAD Council considered petition filed BARRIER by residents in neighborhood regarding destruction of barrier providing access to W. Orange Road frc~Todd property~ causing a heav~ dust nuisance. W. E. Van Riper, 2909 Fernwood, reviewed the events of destruction of a second barrier. The Public Works Director stated that steel posts in concrete were going to be installed. The City Attorney was requested to proceed inmmediately with action against the party for damaging City property. SOLICITATIONS On motion of CounciLman Gilmore, seconded by CounciLman Brooks and carried, Council granted the following requests: Disabled American Veterans, Jack Fisher Chapter, to sell forget-me-nots November 4 - 6, 1965. Benevolettes Drill Team to hold car wash October 30th, and Silver Tea, November 14th. SALARY INCREASES salary increases for meritorious service. On motion of CounciLman GiLmore~ seconded by CounciLman Brooks and carried, Council approved Manager's report dated 10-27-65 recommending BID CALLS On motion of CounciLman Gilmore~ seconded by CounciLman Brooks and carried~ Council approved plans and specifications and authorized advertising for bids for the following: Construction of two handball courts at Jerome and Memorial Park, Spec. 673-5. Opening date 11-15-65. Furnish and install sign for Municipal Stadium, Spec. 672-18. Opening date 11-15-65. Furnishing and delivering two Police special motorcycles with trade-ins~ Spec. 622-6. Opening date 11-15-65. JOB SPECIFICATIONS On motion of CounciLman GiLmore, seconded by Councilman Brooks and carried~ Council approved job specifications for Water Utility Inspector and Sanitation Inspector. BOND RELEASES Acting on the Public Works Director's report of satisfactory completion of improvements~ on motion of CounciLman Brooks~ seconded by CounciLman GiLmore and carried~ Council authorized release of bonds for the following: Tract 5952 - Pacific and Hall Avenues. Tract 5720 - Flora and Pacific Avenues. Tract 5884 - Rene Drive and Adams Street. Tract 5885 - Spruce and Adams Street. CITY COUINCIL - 398 - November 1, 1965 SURPLUS PROPE~qTY On motion of Councilman Brooks, seconded by Councilman Herrin and carried~ Council ordered filed City Manager's Surplus Property Report No. 56-65 regarding building on land needed for parking lot for Fire Headquarters at 213 S. Sycamore; declared the building surplus and authorized its demolition. VET. DAY MARCH Mayor Harvey read a telegram from Andrew Callanan, stating he plarn]ed to march from La Veta down Main Street to First Street in support of service men in Viet Nam on November llth. On motion of CounciLman Gilmore: seconded by CounciLman McMichael and carried, Council ordered the telegram filed. Y LICENSE WAIVE~ Discussion followed reading of the request of the Gemini Club that license fee be waived for amateur boxing exhibition to be held at Laborer's Hall, 1532 E. Chestnut, and for one-day controlled beverage permit. The Manager stated the one day alcoholic beverage license had been a pro01em to the City. It was moved by Councilman Markel, seconded by Councilman Brooks~ that the request be denied. The motion carried~ with two "No" votes. DECENCY AMENDM3]NT On motion of Councilman Brooks~ seconded by Councilman Herrin and carried~ Council authorized the City Attorney to prepare a resolution in support of the proposed Decency Amendment which would return control to the local level in sex crimes~ pornographic material, etc. RES. 65-172 RESOLUTION 65-172 AUTHORIZING QUITCLAIM DEED ~D(ECUTION OF A QUITCLAIM DEED TO OWNERS OF RECORD was read by title.
