On motion of Councilman B~ooks, /, ... seconded by Councilman Burk and carried, Council ordered filed the City Attorney's report regarding procedure for withdrawal from Orange County Harbor District. Councilman Markel remarked he would like to see Council initiate withdrawal proceedings by resolution. In answer to Mayor Harvey's question, Assistant City Attorney William Mock commented that denial of such action by the Local Agency Formation C~maission would prevent consideration of other petitions for a period of one year. MID-YEAR BUDGET City Manager reviewed the request REVISION for mid-year revisions of budget ~" for the present fiscal year 1965- 66. Council asked for more information on certain items, such as select streets, for the next meeting. CHRIS~TMAS PARADE Mr. Ralph Wackerbar~h, representing Juni~ Chamber of Commerce requested permanent allocation of $2,000 for Annual Christmas Frolic Parade be included in budget of City. Mayor Harvey pointed out that such an allocation would be binding on subsequent Councils, and no permanent allocations were made. SUNRISE SERVICE Mr. Jerry Hudson, Chairman of Easter ~ Sunrise Service for Junior Chamber of Commerce, requested use of Santa Aha Municipal Bowl without fee for this purpose. Mayor Harvey advised Mr. Hudson that if no admission is charged and no donations taken inside the bo% their application should be made under Municipal Code Section 2622.1 and no Council action was required. CITY COUNCIL - 456 - February 7, 1966 GEN. PLAN Council received a letter from the 7~ Chamber of Commerce expressing approval of the General Plan and urging early adoption. Mayor Harvey commented that with Council agreement, a public hearing had been set for February 17~ 1966~ 7:30 p.m.~ in the Council Chamber. CHAR~TE~~ REVIE~ Council received the report of the Charter Review Committee, recommending certain amendments to the City Charter. Council received a letter from Noel Conway, Secretary of the Santa Aha Residents Council regarding the Committee's report and suggesting certain other amendments. Mrs. Madelyn Cenkar, 806 S. Flintridge Drive, submitted and read a letter from the Southwest Hcmeowners Association, rec~mnending changes in the Charter regarding election of Councilmen. Mrs. Janice Boer, 912 N. Lowell, and Mr. Cliff Fraizer, 2049 So Halladay made a number of suggestions and were asked to submit them in writing prior to the next regular Council meeting. RECESS At 5:03 p.m.~ the meeting was recessed to 7:30 p.m. The meeting was reconvened at 7:30 p.m. in the Council Chambers, with all Councilmen present. Following the Pledge of Allegiance to the Flag~ the Invocation was delivered by the Reverend Bonnie Flint~ First Baptist Church of Santa Ana. Mr. Tom Larsen~ Chairman of the Charter Review Committee, presented the reasoning behind the proposed Charter amendments which were presented to Council. Mayor Harvey suggested that representatives of the Charter Review C~ittee be present at the February 21st Council meeting after the Council has had time to review the proposed changes. Mr. Larsen said that he would ask each Sub-committee Chairman to be present at that time. HEARING - Hearing was opened on Amendment AA 577 - ROHRS Application 577 filed by Russell ~'~ Rohrs proposing the amendment of Sectional District Map 8-5-9by reclassifying from the R i district to the C 5 district property on the south side of 17th between Mabury and Tustin. Planning Commission Resolution 5763 recommended approval of Exhibit B~ which would reclassify to the C 5 and R i B districts. The Clerk reported that notice of the hearing was published January 22, 1966 in the Register and no communications had been filed. Mr. Frank Bueche, 1505 E. 17th, representing the applicant, described surrounding zoning and stated Exhibit B is favorable to applicant. There being no further testimony~ the hearing was closed. It was moved by Councilman McMichael, seconded by Councilman Brooks and carried~ that the reclassification be approved and that the City Attorney be instructed to prepare an amending ordinance according to Exhibit B. HEARING - Hearing was opened on Appeal 173 APPEAL 173 - V.A. 2202 filed by Keith Monroe and Thomas MONRO~ & Io~n~AN Keenan from the Planning Commission's denial of Variance Application 2202 to convert a duplex into professional office at 1068 W. 6th in the R 2 district. The Clerk reported that notice of the hearing was mailed to adjacent property owners on January 26, 1966 and that no communications had been filed. CITY COUNCIL - l~57 - February 7, 1966 Mr. Keith Monroe, representing the applicants, stated exterior remodeling would be required and proposal would benefit neighborhood; that the Planning Commission considered the CD zoning, which was not in effect and therefore not evidence. Mr. Tom Keenan presented artist's rendering of proposed exterior and agreed to any conditions and time limit. There being no further testimony, the hearing was closed. The Planning Director stated this was a rezoning request in the face of a publicly announced acquisition by a governmental agency; that the property is within the area to be acquired under the Joint Powers Agreement by the County; that the Commission had followed past policy of not approving conversions in the Civic Center area unless they were tantamount to new construction and the ~xterior remodeling had not been presented to Commission. The applicant stated it had only just ccme to his attention that the County had sent a letter of intent to purchase the property; that applicants were not owners but had option to buy; that exterior drawing was not submitted to Commission because it was felt that was of concern only to Building Department. Councilman McMichael noted the proposal was substandard in driveway, parking, and maneuvering area. It was moved by Councilman Brooks, seconded by Councilman Burk and carried, that Council uphold the action of the Planning Commission and the City Attorney be instructed to prepare a resolution denying Variance Application 2202, 17TH ST. SIGNS - GLASS & Hinsvark George Glass and Kenneth Ninsvark presented request that permit for sign (Bird) at 1621 E. 17th be held in abeyance until law suit is resolved, and request for discussion of sign control on 17th Street. Mayor Harvey suggested the arguments be presented to the Judge inasmuch as the matter was now in Court and that any suggestions for sign control be presented to the Planning Staff, who were making a study at Council direction. RECESS At 8:50 p.m., a five minute recess was declared. The meeting reconvened at 9:00 p.m. with all Councilmen present. TENT. PARCEL MAP ~47 It was moved by Councilman Gilmore, seconded by Councilman Herrin and carried, that Tentative Parcel Map ~7 filed by City of Santa Ana creating four parcels on west side of King at 10th be approved subject to conditions in Planning Director's report dated February 2, 1966. TE~T. PARCEL MAP 448 It was moved by Councilman Gilmore, seconded by Councilman Herrin and carried, that Tentative Parcel Map ~8 filed by Income Centers, Inc., et al., creating two parcels on Wainut, Center, Chestnut and Daisy Streets be approved subject to conditions in Planning Director's report dated February 2, 1966 and that w~iver of alley requirement be approved. TENT. PARCEL MAP 446 It was moved by Councilman Gilmore, seconded by Councilman Herrin and carried, that Tentative Parcel Map 446 filed by Philip R. Leos creating two parcels on the north side of Roosevelt, west of Euclid, be approved subject to conditions in Planning Director's report dated January 19, 1966. CITY COUNCIL - 458 - February 7, 1966 YOUTH CO~ISSION Mrs. Jeanne Gagnebin, Miss Ann Thornton, Mr. Steve Snyder, and Mm. Maynard Ross, Santa Ana Youth Council, spoke on behalf of establishment of a Youth Commission. Cliff Fraizer, Janice Boer, and Anne Famularo spoke in opposition. Councilman Davis Burk and Councilm~n Walter Brooks were appointed as a Committee by Mayor Harvey to consider the establishment of such a Commission and report back to Council. ORANGE COUNTY Council considered an application ANTI-POVERTY to solicit for one year funds and COUNCIL, INC. materials for the Headstart Program. It was moved by Councilman Brooks, seconded by Councilman Burk and carried, that Mr. Thomas Crockett, Acting Chairman of the Anti-Poverty Council be ~_uformed of the Municipal Code limitation of 60 days and requested to be present at the next regular meeting of the City Council to present further explanation to Council. ORANGE C0bmTf HEART ASSOC. Orange County Heart Association. On motion of Councilman Herrin, seconded by Councilman Burk and carried, Council approved request to solicit during February for SOC. FOR CRIPPT~RD It was moved by Councilmsn Gilmore, CHILDREN & ADULTS, INC. seconded by Councilman Herrin and carried, that request for permission to place coin containers in business establishments from February 28 to April 10, 1966 for Easter Seal Campaign be granted, and that request for door to door solicitation by City of Hope, June 5 - 12, 1966 be granted. BYIRD - MORALES Morales, be denied. It was moved by Councilman Markel, seconded by Councilman Herrin and carried, that claims filed by Joy Benita Byrd and (late) Sammy Robert MW]) BOND ISSUE On motion of Councilman Brooks, / ~ seconded by Councilman McMichael and carried, Council ordered filed the Resolution adopted by Board of Directors of Orange County Water District in support of $850 million Metropolitan Water District Bond Issue to be voted on in June, 1966. PAP/~S On motion of Councilman Brooks, seconded by Councilman McMichael and carried, Council ordered filed for consideration the suggestion for naming of future parks submitted by Board of Recreation and Parks. SALARY INCREASES It was moved by Councilman Brooks, '~ seconded by Councilman McMichael and carried, that the Manager's report dated 2-2-66 reco~mmending salary increases for meritorious service be approved. TAX PENALTY It was moved by Councilm~n. Brooks, ¢~ seconded by Councilm-n Herrin, that request frcm Ralph Curiale, 622 E. Buffalo for reimbursement of $15.53 tax penalty in addition to incorrect weed abatement assessment be denied, but that reimbursement in amount of $20.54 be approved for incorrect weed abatement assessment. CITY COUNCIL - 459 - February 7, 1966 Jess Berry and Noel Conway protested Mro Curiale's having to pay a penalty because of incorrect information received frc~ a City employee. REIMBURSEMENTS It was moved by Councilman Markel, seconded by Councilman Herrin and carried, that reimbursement be approved for Earl E. Clayton, 19412 St. Jude~ $21o69 for incorrect weed abatement assessment; for Mr. George No Buban, 12661 Swidler Place, $15.87 for incorrect weed abatement assessment; and for Mr. Balph A. Diedrich~ 6700 Stanton, Buena Park, $3,039.60 for construction of oversize sewers in Tract 5910 and for extension of City trunk main with Jacked casing under ATSF Railroad. PRE. REC. OF SURVEY ~lO On motion of Councilman Rrooks, seconded by Councilman Burk and carried, Council waived Condition C-5, regarding l0 year offer of dedication of alley in Preliminary Record of Survey ~lO, approved by Council 6-7-65 for Fred R. Cermak. BID C~T.T.~ It was moved by Councilman Burk, seconded by CounciLman Herrin and carried, that plans and specifications be approved and authority granted for the advertisement for bids on 103 Parking Meters, Spec. 667-4~ opening date 2-21-66; Project 196 widening Grand between 2000' north of 17th and Santa Clara; Project 231 widening Santa Clara from Grand to 600' east of Grand; Project C-124 widening Mabury between Palm and 4th, opening date 3-1-66; Project 204 construct Warner from Newport Freeway to Redhill, opening date 3-1-66. It was moved by Councilman Burk, seconded by Councilman Brooks, that plans and specifications be approved and authority be granted for the advertisement of bids for construction of addition to Police Facilities Building, opening date 3-15-66. WARNER ACCESS It was moved by Councilman McMichael, seconded by Councilman Herrin and carried, to continue to the next regular meeting of the Council, February 21, 1966, the request from Gerald F. Rrame~ Inc., for access rights to Warner Avenue from the Hokanson property~ 3421 W. Warner, and request Mr. Breme's presence at that meeting to present his case. ~SEUM GIFT It was moved by Councilman Herrin, seconded by Councilman Burk and carried, that Council authorize acceptance for credit to Account 51-221-693, $93.60 check from Edna B. McClelland for purchase of specified books (Duflot De Mofras Travels) for Bowers Museum, and authorize purchase of books from that account. CUP 198 Council received a request for 90 ROVIN day extension of time on Conditional Use Permit 198 to construct and operate a psychiatric hospital in M i district approximately 100' east of ~313 S. Main, granted by Council August 16, 1965o The City Manager reported the property under this zoning had been advertised for sale. The request was denied on motion of Councilman Herrin, seconded by Councilman Brooks and carried~ with CounciLmen Gilmore and McMichael voting "No". CITY COUNCIL - 460 - February 7, 1966 ORAL CO~94UNICATIONS amendments was on behalf of the Santa Anne Famularo spoke in opposition to Council action on the Civic Center Authority. Noel Conway noted his letter regarding Charter Ana Residents Council. ADJOURI94ENT At 10:55 p.m., there being no further business to come before the Council, the meeting was adjourned to 7:30 p.m., February l?, 1966, in the Council Chambers of the City of Santa Ana, 217 N.
