Fain Street. Roll call was answered by Councilmen James Gilmore, Walter ~rooks, Davis Burk, Wade Herrin, J. Ogden Markel, Tom McMichael, and Mayor Harry E. Harvey. Also present were City Manager Carl Jo Thornton, Director of P~blic Works Ron Wolford, Director of Planning Van Stevens, City Attorney John Colwell, and Clerk of the Council Doris M. Brown. APPROVAL OF MINUTES after the following corrections: The Minutes of the Regular Meeting of May 16, 1966 were approved on motion of Councilman Brooks, seconded by Councilman Nerrin and carried, Page 532, TENTATIVE PARCEL MAP ~60, insert "subject to conditions in Planning Director's report dated 5-10-66" in motion approving the map. Page 533, APPOIIITMENTS AND REAPPOI~T~a~vI'$ TO BOARDS AND CO~4ISSIONS, insert "effective July 1~ 1966" after appointment of Mr. Mayes to Recreation and Parks Board. DOW~ToWN PA~I~G DISTRICT Lorin Griset~ Chairmam of the D~,ntown Santa ~na Parking Cc~aittee presented a revised report and map regarding proposed downtown parking district. The report requested the City Council to participate by approving the following progrmm~: The downtown property owners will assess themselves the maximum amount permitted by law ($1~598~257) and acquire lots for customer off~street parking in the priority and locations as shown on revised map filed with the Clerk of the Council. (The estimated acquisition cost of all lots is $1~571~460 computed at 5 times assessed value.) The off-sSreet lots will be given free and in fee to the people of the City of Santa Aha. All actions taken by the Parking District Board of Directors will be subject to the approval and confirmation of the City Council. The parking meter fund of $209~000 will be used to partially pay the estimated $271,9~3 cost of d~molition and const~ction of the new off-street lots. The difference to be bourne by the City as a contribution to the District. The amuual operating and maintenance costs will be b~e by the City out of revenue from parking fines levied within the District. Revenue from parking (both on-street and off-street collected within the District will be used to create additional off=street park_tug. The off-street parking regulations as they affect properties within the District will be amended to require new developments to either provide adequate parking or pay cash in lieu thereof to the District so it may provide adequate parking° Wendell Finley, Rod Munro aud Hal Winter, re~resenting the Downtown Santa Aha Association~ spoke in support of the program~ f~urnishing estimates of revenues from meters and traffic violation fines and estimates of meter and lot maintenance o Mr. Kenneth Price~ 2136 Heliotrope~ a Downtown Santa Ana property owner, reported to Council his willin~ess to cooperate in this project even at the risk of his ow~ parking lot being temporarily adversely affected. Janice Boer~ 912 N. Lowell, Joe Gilmaker, 308 W~ 4th and Clifford Fraizer, 2049 So Halladay spoke in opposition to the proposed parking district. 0~ motion of Councilman Rrooks, seconded by Councilman Burk and carried, the matter was refe=red to the staff for an in-depth study with report to he filed in one month. SIGNS Co~ncilm~n McMichael suggested that ar~y excess funds remaining after completion of the Bowers Museum Parking Lot be used for more adequate signs for the Museum. Councilman B~ooks commented, that if such a proposal were considered, he would donate design and specifications to be sure that the present facility would be enhanced~ The City M~.~.ager stated he would obtaim an estimate of the amount expended from the $9~ ©00 allocation for the parking lot. B~S SERVICE Co~acilman Herrin co~maented on the new service and equipment of the local bus company and urged support from all merchants. Hal Winter, ~uager of the Downtown Santa Aha Association reported that a validation system is now being developed. CITY COUNCIL ~ 5~0 ~. LAW BOOKS On motion of Councilman Brooks, seconded by Councilman Markel and carried, the City Council authorized the City Manager to purchase law books from retiring City Attorney John Colwell for $700°00° ~START PROGRAM The City Manager reported that the Superintendent of Parks, Mr o Koral, had been requested to se~e on a committee to interview~ evaluate and reccmmend persons who might be employed in the Headstart Program. Mayor Harvey c~ented that this is an educational pre-school program, part of the Federal Poverty Program to help children who are handicapped and that he believed it to be a matter of concern to the Board of Education; that if a City employee wamted to participate he should do so as a private individual° It was moved hy Councilman Burk~ seconded by Councilman Markel~ that the City Council deny the request for official participation in the Headstart Program. The motion was carried with Councilmam Brooks voting ~NO~So PAYROLL DEDUCTION The City l~anager reported that for some years he had been rejecting requests fr~m the Employees Association for payroll deductions because of the complexity of payroll procedures~ that only two additional deductions can be made before going to another IB~ card~ causing serious increase in cost; that in recent discussion with the Employees Association representatives regarding the possible deduction for dues, Credit Unlo~ savings~ Credit Union payments, arid E bonds~ he had agreed to recommend not more than one~ reserving the one remaining possibility for State Income T~-x withholding~ Reporting that the Employee Association representatives indicated ~terest i~ payment of dues as a primary factor, the Manager ztated that he would proceed with payroll deduction of Association dues if there wis no objection from Council° REFUSE COLLECTION The City Manager explained to Council that the Santa Aha Board of Education has had a separate contract for refuse collection which expires in june 1966; that a new contract has been awarded by the Board of Education to a contractor other than the City's exclusive contractor° He rec~ended Council authorize legal action to determine the right of the City to control collection of refuse in and on properties of the Santa Ana School District. The action necessary to make this determination was authorized by the City Council on motion of Co?Ancilm~n Markel$ seconded by Cou~.cilman McMichael and carried. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Larry BJorklund, Aldersgate Methodist Church. RESOLUTION OF APPRECIATION Mayor Harvey presented to ~r. George Townsend a Resolution of AppreCiation from the City Council for his 23 years of service on the Board of Recreation and Parks. AWARD An award frc~a the California Division of the American Water Works Association for an improved safety record during 1965 was presented to Mr. Elmer Austerman who represented the Water Division of the Department of Public Works. HFARING - Nearing was opened on Amendment AA 514 - ROHRS Application 514 filed by Calvin G. Rohrs proposing amendment of Sectional District Map 8-5-9 by reclassifying, from the R i to the C 5 district, property on the south side of 17th Street between Grand Avenue and Linwood Street. Planning Commission Resolution 5781 recommended denial. The Clerk reported that notice of the hearing was published in The Register on 5-27-66 with affidavit of publication on file and that a letter from the applicant had been filed requesting the application be cancelled. OLIVE-5TH ST. VACATION Hear~ was opened on the proposed vacation of Olive Street between 4th and 6th Streets, and 5th Street between Flower and a point 300' west of the center line of Olive Street. The Clerk reported that notice of the hearing was published May IL, 1966 in The Register, posted in the area on May 19, 1966 and that evidence thereto was on file; that no written communications had been filed. There being no response to the Mayor's call for testimony the hearing was closed. CLUBHOUSE Rearing was opened on an appeal filed by The Never On Friday Club, petitioning the City Council to waive portions of the Fmnicipal Co~e regarding issuance of a public ~ance permit in Fashion Lanes Shopping Center. The Clerk reported that a letter had been received frc~ the appellant requesting that the appeal be withdrawn° On motion of Councilman Herrin, seconded by Councilman Mm~kel and carried, the matter was removed from the agenda. C~C~IAL RABBIT YARD Council received an evaluation report from the Orange County Health Department regarding application for permit to maintain rabbits at 1426 Sullivan~ submitted by Robert Do Beckwitho The report indicated that with the exception of work to be done on hutches for convenience of cleaning, the facilities essentially meet the provision of sub-section (a) (b) and (f) of Municipal Cc(lo Section 4121.1. Council also received a petition from owners and residents within approximately 300~ of the property objecting to the continuance of the rabbit farm on the property~ Attorney Robert Rickles, represented the applicant, stating that reguLations have been met and requesting the permit be issued. Attorney John H~ Gilbert~ Jr., representing Mr. Hubert Melton, 14~6 So Sullivan~ one of the opponents, stated that the use causes excessive flies and odors; devaluates nearby property, and is a nuisance° The Planning Director stated there was a question as to whether or not a prior non-conforming use ha~ been maintained continuously° On motion of Councilman McMichael, seconded by Councilman Brooks ami c~rried, the matter was continued to June 20~ 1966 and the staff requested to investigate and report back with a recummen~ation. Giles and John Bre~er of the Planning Commission's approval of Variance Application 66-31 filed by William Moss to construct a 6' high fence in required front yard at 94~ W. Buffalo. The Clerk reported that notice of hearing was mailed to adjacent property owners May 31, 1966 and evidence thereto was on file. The Plar~uing Director reported that the Municipal Code provides that if houses are within 200 feet of a sewer facility they must connect. The Public Works Director reported that he had been notified by the refuse collection contractor that equipment was being damaged because of the condition of Quigley Lane o He noted that on/y paving was being required in lieu of the normal requirement of a full 60~ street.
