June 20~ 1966
The meeting was called to order at 2:00 p.m.~ in the Council Chamber, 217 N.
Main Street. Roll call was answered by Councilmen James Gilmore, Walter
Brooks, Davis Burk, Wade Herrin~ J. Ogden Markel, Tom McMichael and Mayor
Harry H. Harvey. Also present were City Manager Carl Jo Thornton, Assistant
Director of Public Works, R. Henry Mohle~ Senior PlaD~er, Stephen Lafer,
City Attorney John K. Colwell, and Clerk of the Council, Doris M. Brown.
APPROVAL OF MIBI~ES
On motion of Councilman McMichael,
seconded by Councilman Herrin and
carried, the minutes of the Regular
MeetLug of June 6, 1966 were approved
as submitted.
ALTERNATE BUILDING Acting on a request from Cannon Electric
CONSTRUCTION Company to deviate from 60' fire yard
requirement by alternate construction
at 666 E. Dyer Road, it was moved by
Councilman Markel, seconded by Councilman Brooks and carried, that alternate
construction be approved subject to installation of safety precautions listed
in June 14, 1966 letter from Cannon Electric and subject also to conditions
described in report of Director of Building Safety dated June 15, 1966.

COuacilman McMichael explained the P]-~tng Commission's policy not to re-
zone side-on lots when Bristol was rezoned. It was moved by Couacilman

Dale Neinly, Attorney, 611 W. 8th, represented the applicant and explained his
client,s intentidn to add a 15' x 3~' office for which the Zoning Administrator
imposed conditions requiring 30 parking spaces, a 60' dedicatio~ on Bolsa and
. continuing dffer to dedicate ~n future Shannon Street. Mr. Heinl~ stated that
the applicant would a~ree to the dedication~ if he could be assured that at no
t!~, in the future woul~ the City require that he make the improvements.
Councilman McMichael expressed the viewpoint tha~ since this was not a new
develol~aent, hut an established business desirin~ to make an improvement, he did
not feel it was the City's right to require an additional hax~ship.
It was moved ~y Councilman McNichael, seconded by Ccunci~w~ Eerrin and carried,
that the appeal be granted a~d the conditions be deleted except the condition
that the development be in accordance with the submitted, plot plan. Counci~m-~
Brooks qualified his vote by stating he was not in favor of deleting the
parking requirement.

APPEAL 178, TANE~ filed by George Lo Taney frsm the

establish an auto garage in the R 3 B district at 802 N~ Flower. The Clerk
reported notice was mailed 6-13-66 and that letters of protest had been received
from Mr. and MrS. 0skopp, 80~ N. Garn~ey, l~bel Stake~ 810 No Garnsey, A. M.
Knabb, 82~ N. Flower, and Lois Whitlock~ 802 N. Flower. Mr. Cliff Baxter
appeared for Mr. Taney, and stated there would be no struct.Ara! chauges in the
building, the hours would be shorter, and the gas pump islands would be removed~
leaving the tanks underground and filled with sand. There being no further
testimony~ the hearing was closed.
COUncilman Brooks' motion to uphold the action of the Pl-n~ing C~mmission was
lost for want of a second. It was moved by Councilman Burk~ seconded by
Councilman Gilmor~e, that Council overrule the action of the Planning Ccmmnission
and grant Variance Application 66-35, subject to conditions in Staff Commnents
dated 5-23-66 with exception of elfm~nation of condition 10, and cha~ing the
word "void" to "recc~nend voiding" and ~" to
years years im condition 4.
The motion carried with Councilman Brooks voting ~nO~o Mr. Taney agreed to the
conditions as modified.
HEALTH NUISANCE Council received a report from the
Health Department regarding a
petition submitted by property
owners on West 5th Street in which
it was stated that a poultry rauch on 1st Street between Euclid a~d Newhope

On motion of Counci!,~n ~Ark, seconded by Counci!~A~ Herrin and carried,
Council requested the City _Man~er to study the w~tter and submit to the
City Council a recc~nended ordinance including preventive measures.

D~NTOWN PARKING DISTRICT The City Manager read and filed
with Council a report on Plan for
Central City Off-Str~et Parking
Program in which he recommended
the City should accept some share of costs of providing off-street parking
in any business area based upon the following criteria:
1. The area is willing to invest at least 50% of the ~nitial cost of
procuring the off-street parking area.
2. The city shall not be required to do more than match such private
expenditures over a reasonable period of time (10 ~ears?)..
The resulting properties when developed can be expected to provide
at least the minimal demand for such parking within the designated
time span.
4.. The parking shall be required for multiple usage (i.e., more than
four~ or. s~e similar nm~mber of independent businesses) will be
serviced bythe develolmment and the cost of the program borne by
the properties to be served shall be at least as great as that
which would normally~be required u~der~the application of the city's
requirements for the private provision of off-street parking.
5. The title to the property contained in such off-st~e~t parking
program shall be with the city, and the city shall retain the
right to control the operation of the parking, the charging of
parking fees, the development of the properties and the sale or
trade of such properties so long as the city shall continue to
maintain the number of parking stalls envisioned in the program~
but the location of the facilities based upon most effective
service to the participating businesses shall stay with the city.
Regarding' specifically parking in the retail core of the "city center", he
recommended the city participate in the following manne~ circumstances~
and understandings:
That the entire initial lot acquisition cost be borne by private
interests and that the lots belong in fee to the city without
restrictions of any kind.
That all costs, other than acquisition and development and all
revenues accruing from parking facilities within the area be the
sole responsibility of the city without limitation as to fund
source or disposition including maintenance~ policing and
operational policy making.
That the city use the money available in the Parking Meter Fund
as Miscellaneous Reserve (which should total approximately
$285,000 by the time it would be needed in total) to develop the
properties as reccmmended in their item~4o
That from funds of the city's choice an annual contribution
ultimately totalling no more than initial acquisition costs be
expended to cover operating and expansion activities in the
area so long as the city is satisfied that the downtown property
owners and businessmen are acting to add the other ingredients
essential to over-all revitalization. It is reco~m~ended that
this amount be placed at $120,000 per year.
