Main Street, Roll Call was answered by Councilmen Walter BTookso Davis Burk, Wade Herrin, Tom McMichael and Mayor Harry H. Harvey. cQnncilman Jf Ogden Markel was absent. TRAAITIC REPORT - of devices installed or removed 11/17 - C7!P7 COONCIL -81- December 5, 1966 PLAVAH CONDEMNATION Thomas E. Heffernan, attorney representing Pleven, et al, in a condemnation action regarding Fairview Street, requested consideration of an offer to settle in excess of that agreed to by the Administrative Staff. The Manager reported the Staff was following the same policy for participating in street improve- ments on major streets as had been followed with all other owners or developers. Following a lengthy discussion of the many problems encountered when attempting to arrive at a fair price, motion was made by Councilman Bark, seconded by Councilman Brooks and carried, that the Public {corks Director proceed .with negotiations in accordance with established policy. Council- man Gilmore voted "no." P SURPLUS PROPERTY REPORT On motion of Councilman Brooks, seconded by Councilman Herrin and carried, the City Council declared surplus and authorized demolition of house on the north side of Sixth, west of Olive, as identified in Surplus Property Report 31-66. SALARY INCREASES On motion of Councilman Brooks, seconded by Councilman Herrin and carried, the City Council approved salary increases for meritorious service, as listed in Manager's Report dated 11/30/66. ALCOHOLIC BEVERAGE LICENSES The Council discussed at length -_L the'new,procedure for reporting on Alcoholic Beverage license applications. The Manager explained that each application was being investigated by various departments with a summary report from his office. He assured Council he would report any departmental recommendation which is different from his own. On motion of Councilman McMichael, seconded by Councilman Herrin and carried, the following applications were ordered filed: Orange Distributing Co., Sale Beer & Vine, Person Traveler's Inn Hofbrau, Beer, Person transfer: Chat Noir$'218 E. 17th - RECESS c t! " ° ANNEXATION REQUEST 7522 Park Ave., G.G., Off transfer, 3G4 N. Broadway - On sale New On Sale Beer. At 3:45 P.M., the meeting was recessed for ten minutes and reconvened at 3:55 P.M. Speaking on a request from property owners at the westerly end of Silver Drive, the City Manager reporzea znaz a caeca with the City of Garden Grove revealed a question about the subdivision of the property and requested additional time for investigation. On motion of Councilman Burk, seconded by Councilman Herrin and carried, the matter was submitted to Staff for further study and report at a later date. CITY COUNCIL -82. December 5, 1966 CAPITAL IWROVEKMRS Lci�`' Council considered a Proposed Five - Year Capital Budget recommended by the Planning Commission; also, a recemumended $25,000,000 bond program as a part of financing the improvements. San Rae and Tom Sweeney, representing the Chamber of Commerce, and Hal Winter, Downtown Basta Ana Association, spoke in support of the program and urged Council spprovel, Janice Boer commented briefly on the program. The Staff answered a number of questions about the projects and the proposed budget was discussed at length. Councilman Gilmore made a notion, seconded by Councilman Brooks and carried, that a resolution be prepared by the City Attorney ccmending the Planning Casission for their work in preparing the Capital Improvements Program. On notion of Councilman Gilmore, seconded by Councilman McMichael and carried, Council approved the "Proposed Five Year Capital Budget" (re- commended by the Planning Commission) and instructed the City Attorney to #rapers necessary documents to place e'$25,000,000 bond proposal on the April 4th ballot. Councilman Brooks consented that, even though Councilman Markel was absent, he had written to the Mayor of his support of the program and urged its adoption. RECESS At 4:55 P.M., the meeting was recessed to TOO P.M. The meeting wan reconvened at TOO P.M. with the same Councilman present. Following the Pledge of Allegiance to the Flagg the Invocation was delivered by the Reverend Kenneth Doctor, Spurgeon Methodist Church. The National League of Cities Award was presented by Mayor Harvey to Manuel Esgaeda for Santa Ana's People -to -People WARD BOUNDARIES CP Hearing was opened on the proposed ward boundary changes as required by Charter. The Clerk reported notice published as required, with affidavit an file. Janice Boer asked questions regarding the Map. There being no further testimony, the hearing was closed. on motion of Councilman Bark, seconded by Councilman Herrin and carried, O1WXXANCE 18-863 CHANGING AND ESTAELISKM THE BOUNDARY LINES OF THE WARDS OF THE CITY OF SANTA ANA was passed to second reading. APPEAL 184 c��` Hearing was opened on Appeal 184, GEORGE ARMOS filed by. George Argyros from the vA 66-4o Planning Commission's denial of Variance 66-40 to tonstruet a camercial center.in R2 District with less than required parking at 902 W. McFadden. The Clerk reported notice mailed as ,required, with certificate on file. CITY COUNCIL -83- December 5, 1966 Dale Heinly, attorney for applicant, described the area, the proposed small market use, noting design as compatible with residential neigh- borhood and commented on the 80' primary streets. He cited other markets in area and requested air conditioning and refrigeration equipment be allowed on top of building if variance granted. Wesley Ulrich, 1110 S. Garnsey, spoke in opposition, Speaking in favor of the application were Doug Faulkner, Roland Witherow, 813 W. McFadden, and Ray Shirley. A petition in opposition, with 65 signatures, was ordered filed as a part of the hearing, on motion of Councilman Gilmore, seconded by Councilman Brooks and carried. The Planning Director explained that a study of neighborhood markets would be completed in January but the applicant had asked the Commission to act on this application. There being no further testimony, the hearing was closed. On motion of Councilman Burk, seconded by Councilman Herrin, Council overruled the decision of the Planning Commission and approved the variance, subject to conditions set out in Staff Comments,dated 11/14/66, with no exceptions. PARCEL MAP 491 On motion of Councilman Herrin, seconded by Councilman Brooks and carried, Council approved Parcel Map 491, filed by Tubbs, creating two parcels south and east of the intersection of Fourth and Tustin, subject to conditions in report dated 11/3o/66 with added condition requiring standard City street lights, and waived alley requirement. Cliff Prazier, 2049 Halladay Street, Santa Ana, expressed disappointment at not being able to be present during the afternoon session at the time the Capital Improvements Budget was considered.
