Main Street. Roll Call Was a~swered by Co~ucilmen James Gilmore, Walter B~ooks, Davis Burk, Wade Herrin, J. Ogden Markel, Tom McMichael and Mayor Harry H. Harvey. Also present were City Manager Carl J. Thornton, Assistant City Attorney Frank Lowrey, Director of Public Works Ronald Wolf oral, Director of Planning Paul Van Stevens, and Assistant Clerk of the Council Maxine Vallery. APPROVAL OF MINUTES On motion of Councilman McMichael, seconded by Councilman Nerrin and carried, Minutes of the Regular Meeting of December 5, 1966 were approved. PUMPER TRUCK After hearing a report from the City Manager that only one bid was received for the Pumper Truck, Spec. 641-114, and that it was felt to be very reasonable, and also that a 1500 gallon piece of equipment could be supplied at a reasonable additional cost to the 1250 gallon piece of equipment, on motion of Councilman ~rooks, seconded by Councilman Mmrkel, and carried, the City Council awarded contract for a 1500 gallon Pumper Truck, Spec. 641-114, to Crowu Coach Corporation. PROJECT 66-4 - CAMBRIDGE RESERVOiR On motion of Councilman Eerrin, AND PUMPING STATION seconded by Councilman Markel and carried, Council ordered filed report of bids received for Project 66-4 - Cambridge Reservoir amd Pumping Station; awarded contract to J. Putnam Henck; and rejected all other bids. POLICE AUTOMOBILES Acting on the City Manager's recom- mendation, on motion of Councilman B~ooks, seconded ~y Councilman Herrin an~ carried, the request of Monte Peters to correct error in his l~w hid on 11 automobiles (black and white) for Police Department, Spec. 6~1-112, was denied° It was directed that additional automobile needed be added to the 7 automobiles (unmarked)~ Spec. 6~1-113. Ar~yrosl spoke objecting to Conditiou No. 7 regarding signs; he stated that applicant wanted to have a free standing sign that woul/l mot be too large, too bright, or detrimental to the neighborhood~ aud that they would apply for a variance for this type of sign; that they would like an indication from the Council of their intent to allow this type of sign. CAPITAL IMPROV~2~E~I~ '~2 ~ ~ Couucil considered a draft of four bon~ propositions for the April 4th ballot to assist in financing improvements pre- pared for the first five-year period of the Capital Improvements Program -- A. Sewer and Storm Drain Bonds; B. P~blic B~ilding Bonds; C. Street Bonds; and D, Park and Recreation Bonds. Coumcil discussed at length the legal and promotional aspects of the ho~d program. Co~c~lm-- McMichael asked if the program could be carried out without an increase in property tax, to which the City Ms-ager replied in the affirmative. C°Uncilmam Bmr~ suggested an increase in sewer amd storm drain f~ds by providing for Library f~mds from the General Fund rather than umder Item B. Councilman Brooks state~ his opinion that as proposed it was a ~alanced program rec~ended by the pl~.nt~g Commission an~ should not be altered. Counc~:~m-~ McMichael suggested a chs~Ee in wording o~ Item D, such as "a~diti°nal city wide parks" so that it did not give impression of so, e- thing new. Councilman Brooks ad, ed that this should Be for the continuing program of acquisition and constructicu. A motion by Counc~lm-~ Brooks to approve draft as set o~t died for lack of a second° It was moved ~y Councilman Burk, seconded by Councilman Nerrin and carried, that the draft be approved with the transfer of $660,000 from Item B to Item A anal the deletion of the words ~ranch libraries" from Item B. Councll~n ~rooks voted "No." BOARDS AND CO~I~SiONS The Mayor directed the City Clerk to supply a complete r~udowm on all Beards an~ C~tssions, when the terms expire~ and what the vacancies are, so Council can have an Wxecutive Session at the first meeting of the year to fill all the vacancies. He stated that he thought new members of Boards and CummIssions should be present at the Council meeting after appointment to be introduced to the Council an~ sworn in. Regarding all the Councilmen who are liaison representatives to various c~.~ittees, the Mayor would like to have a wrapup some time next year on where they stand and what they are doing in their positions. COUNCIL I%EPORTS Coune~lm~n Markel spoke at length on his trip to Las Vegas for the National League of Cities Conference. He stated that it was a very highl~ rewarding and inspiring trip. Ceunci~m-~ Narkel suggested Femn~er's Day be e~emorated each year -- in honor of the late William H. Spurgeem, our City Founder. The oaly things we have to remind ms of him are the Spurgeon School an~ the m-rker ma the County Courthouse lawn which was erecte~ by the Native Daughters of the Golden West in 19~o. CITY COUNCIL -89- December 19, 1966 cOUncilman Bark brought up several items. He asked the Public Works Direct°r about money allocated for the widening of ~riStol and First Street. Secondly, he stated that 1969 is going to be ~ Centennial (it will be California's 15Otb) an~ it is not too early to set up a cmmaittee. He asked that it be hrou~t up at a future meeting. C~cilma~ ~Ark asked th~ City Mm~ager if there were amy injuries resulting frcm the defense class. The City Namager said it was a relatively new karate class. A discussion was about the crossim~ g,,a~ situation and the purpose of the committee. Co~nc~w~n ~rooks mentione~ that the Criminal Division of the Depax~men'~ of Justice encourages people to take keys out of their cars a~l is asking coopera- tion frem the various City Councils by enactment of an ordinance making ~t necessary for the in~ividual to call at the Police Department for a stolen car (where he will also pay a fine). (42% of all autcmobile theirs were autos with keys left in the igai%ion--SO~ are c~w~tted by youths under 1~. ) There was a short discussion regarding the Council's voting one way at one meeting and another way at the next meeting. RE~ESS At ~:~5 P.M., the meeting was recessed to 7:S0 PoN. The meeting vas recon- vened at 7:30 P.M. with the same Councilmen present. Following the Pledge of Allegiance to the Flag~ the Invocation was delivered ~y the Reverend Fred W. Nie~r~g~ams, First Congregational Church. APPEAL 185 Hearing was opened on Appeal 185, ECCO CONTRACTORS, ~NC. filed by Ecco Contractors~ ~nc. VA 66-89 appealin~ conditions imposed by Plaz-~tng C~mmissioa in its approval of Variance 66-89 to operate a steel fabrication y~rd an~ shop without an entirely enclosed building an~ to construct an office building at 2216 South Grand. The Assistant Clerk reported notice of the hearing mailed to a~Jacent property owners on December 12~ 1~66, with certificate on file. On motion of Counc:l~'~ Herrin, secen~e~ by Councilman Markel and carried, Council ordered filed a cmmaonication fr~m Harry R. Martin, Industrial Plaza, 500 Dyer Road, opposing the variance. The letter wes rea~ by the Assistant Clerk. Don Sc~id~ Secretary-Treasurer of Ecco Contractors~ Inc.~ spoke for the a~licant, stating tha~ a~licant is o~Jecting to the conditions regarding l~rkin~ facilities, the 8 foot fencin~ al~ all street frontages, e~ the full landscaping plan. He stated that al~licant felt these conditions were unwarranted, ~ince only a part of the parcel is being occupied. ~he Council considered each of the six conditions separately. There being no further testimony, the hearing was closed. It was moved by Councilman ~rooks, seconded by Councilman Werrin amd carried, to uphold the decision of the pla,ntnE C~ission an~ instruct the City Attorney to prepare a resolution approving Variance 66-89 subject to conditions imposed by the Planning C..~.~esion except c~a~Ees to be made in conditions as follows: Condition 2 - Modify Condition 2 to stnt~ "~. l~- scaping plan" rather than 'a full landscaping plan"; Condition B - An 8 foot wall be constructed on Gran~ -~ a 6 foot wall on Warner; Condition 4 - parking to be worked out with Planning C~ission in relation to the namBer of ampl~yees; and that the rest of the conditions be complied with. SOLICITATION ~ ~\ On motion of Councilman Gilmore, seconded by Councilman Brooks and carried, the application of Orange County Heart Association to solicit funds during the month of February, 1967 for their annual campaign, was approved. BOND RELEASE ~ ~ Acting on the Public Works Director's report of satisfactory completion of improvements in Tract 6161, Park Lane and Hesperian Street~ on motion of Ccrunc~lma~ ~4cMichael~ seconded by Coune~lman~ Herrin and carried~ the Council approved release of bonds. ~PLOYMENT OF ~ 6 ~ Councilman Burk asked if there should SPECIAL COUNSEL ~e any limitations in any ~ay on this matter. The City Manager stated that he thought it should be handled on a c.!.~.~.ittee basis for the terms of the employment. On motion of Councilm~ McMichael, seconded by Councilman B~ooks and carried, the request for authorization to employ special legal counsel to assist the City Attorney in special defense actions now pending in the courts was granted, with the recummendation that any limitations to be placed on this be submitted to the Council. Coumcilmau Burk requested that all members of the Council be advised when there are any reports on matters of this nature.
