Main Street. Roll Call was answered by Councilmen James Gilmore, Walter Brooks, Wade Eerrin, J. Ogden Markel, Tom McMichael and Mayor Harry H. Harvey. Councilmau Davis Burk was absent, but arrived at 3:05 P~M. Also present were City Manager Carl J. Thornton, City Attorney William Lo Mock, Director of Public Works Ronald Wolford, Director of Planning Paul Van Stevens, and Clerk of the Council Doris M. Brow~. APPROVAL OF I~AwOTES On motion of Councilman Markel, seconded by Councilman Herrin and carried~ the City Council approved Minutes of the Regular Meeting of February 20, 1967 and approved Minutes of the Regular Meeting of Feb~aary 6, 1967 with the addition of the following paragraphs to Page ll9 under FIRST STREET ALIGNMENT after the close of the public hearing: Councilman Markel opposed the recommendation that additional width be taken from the north side only, proposing that if anything is done on First Street, the building at the south- west corner of First and Main should be first, and that the four lanes of traffic from the underpass be continued to the west end of the Excelsior Creamery property. The City Manager commented that development of First and Main will require removal of the building on the southwest corner and its value was not added to cost estimates in any case; that four lanes will accommodate traffic in the underpass, which is freeway- designed, but will not on any other part of the street where there are turning movements. AWARD Councilman Gilmore expressed opposition to the divider strip and his opinion that Justice might better be served by taking from both sides in spite of the additional cost, indicating it is a Juagment decision. Councilmen Markel noted the Downtow~ Merchants Associatio~ was not represented and stated his questions were not answered enough that he could vote. SEWER The City Manager presented a report of bids received for Main Street Trunk Sewer and Seventeenth Street and Washington Avenue Sub-Trunk Sewers held over from the February 20 meeting and explained the problem to downtown merchants of having construc- tion on Main Street during the pre-Easter season. Ne explained further that the need for the sewer was critical because there is a location being floc~led out about every two weeks because the sewers are over-taxed and will not accept the total flow. Sam Rue and Emi Winters, representing the Downtown Santa Aha Association, asked that start of construction be delayed until the 27th of March. Jim McGuire, representing Far Western Pipeline, Inc., the low bidder on the project, explained that he had a good crew of men, some of whom he might lose if the work cannot be started at once; that he believed it would not take the C ~ITT~ CO'~CIL -134- March 6, 1967 estimated ninety days to complete the work; that there were streets to the east and west in addition to one lane of traffic in each direction being maintained on Main Street; that it would be reasonable to assume that within a week prior to Easter the project could be above Washington Avenue; and asked permission to c~ence the work starting Wednesday morning. It was moved by Councilman Brooks, seconded by Councilman Herrin and carried, that the contract be awarded to the low bidder, Far Western Pipeline, Inc., at unit prices bid; that all other bids be rejected; and that the report of bids received be ordered filed. Mayor Harvey reminded Mr. McGuire of the merchants' problem and asked him to do everything possible to assist them. STORM DRAN2~ D-57 ~ ~C~ On motion of Councilman Herrin, seconded by Councilman Markel and carried, the City Council ordered filed report of bids received for Project D-57, Storm Drain in Segerstrom Avenue frem Towner to Flower; awarded contract to Famco Construction Company at unit prices; and rejected all other bids. FAIRVIEW PROJECT 27h~/({ ~a~ On motion of Councilman Brooks, seconded by Councilman Narkel and carried, Council ordered filed report of bids received for construction of Fairview, Project 27~, frem Segerstrc~ to 1000 feet south of Warner; awarded contract at unit prices to Sully-Miller Contracting Company; and rejected all other bids. ROSITA PARK POOL ~ ~ ~ ~ '3 - Council received a letter from Sealtight Construction Company, the second low bidder on Project C-141 Rosita Park Pool and Building, objecting to award of the contract to the low bidder until written verification is received from the State Registrar of Con- tractors that the low bidder held proper license at the time of bidding. Edward J. Modes appeared on behalf of Sealtight Construction C~mpany. Stan Nelson, of Nelson-Baird Construction Company, the low bidder, stated that he had flown to Sacramento and talked to Mr. McKay in the State office to verify the firm's eligibility and that a letter could be produced within 24 hours. On motion of Councilman Brooks, seconded by CounciJm-n Herrin and carried, award of the contract was postponed to the next regular meeting. Councilman McMichael stated that, although he voted in opposition to the action of the City Council at its last meeting, he woul~ not be in favor of re-opening the hearing since both the Planning C~mmission and the City Council had held public hearings. Mayor Harvey informed Nrs. Counctl~n~arkel stated that although he had holed the matter was closed~ he believed an effort should be made to determine whether or not there was such a document. CITT COUNCIL -139- March 6, 1967 cOUncilman McMichael commented that the document was being greatly over- played since the so-called problem with Mrs. Boer was not the result of a single Statement or document, that it had been going on for a period of months with a number Of people appearing before the Planning C~ission about her being a disrupting influence which resulted in the Planning Commission rec~ending to the City Council that she he removed in the best interest of the City in or,er to get the Job done rather than face resigna- tions frcm many other persons. It was moved by 0on~c~]m-n McMichael, seconded by Councilman Herrin, that the letter fr~a Mrs. Boer be ordered filed. Councilman Markel stated that if there was a letter or document that a copy should be made public record and Mrs. Boer be given permission to read same. The motion to order Mrs. Boer' s letter filed was adopted. The Council received a c ~n~muni- cation from the Board of Recrea- tion and Parks requesting that steps be taken to commemorate the founding fathers of Santa Ama. Noting that this matter had come up a short time ago, Mayor Earvey recalled that it was decided at that time to wait for a new City Council after the April elec- tion. Councilman Herrin felt that no action should be taken until a decision was made to erect a mall. Councilw~u Brooks felt that although such things as plaques could cc~e later that a "Founders Day" would be appropriate. Council- man Markel s~ggested that this was a matter in which the Chamber of C~erce should be interested and suggested that it be passed along to them with the offer of City assistance. On motion of Councilman Gilmore, seconded by Counc~lmau Nerrin and carried, the cn,~mu~icatlon was ordered filed. SALARY INCREASES On motion of Counc~lmanBrooks, seconded by Councilman Gilmore and carried~ Manager's report dated 3/1/67 recmamending salary increases for meritorious service was approved. ALCOEOLIC BEVEPAGE LICENSE APPLICATIONS Citing a number of police problems, arrests and disturbances, Council- man McMichael moved that all neces- sary steps be taken to protest the application for transfer of on-sale beer license at 1729 W. 1st Street, and that the following applications be ordered filed: Sarong Gals, 701 N. Harbor, New On Sale Beer; Aztec, 3325 Wo 1st, On Sale Beer, Person Transfer; The Honey Bee, 1411 E. 1st, On Sale Beer & Wine, Person Transfer. CITV CO~tCIL -140- March 6, 1967 TOPLESS ENTERTAINMENT The City Manager reported that an ordinance to eliminate topless enter- tainment in the city is ocing pre- pared and will be reconmmended to the City Council by the administrative staff, FIRST S~REMI' WIDENING C~ ,.t Council discussed Councilman Markel~s letter to the editor of The Register regarding the First Street widening and reviewed the action of the City Council in postponing consideration of the ordinance to widen First Street at the request of Councilman Markel and not for any other reason. Councilman Markel presented his own analysis and figures of cost estimates for both total and partial takes on the north and south sides of First Street and submitted that if his figures were used, taking only what is needed on the north and south, it would come well within the appropriation of the bond pro- gram and be fair to people on both sides. Councilman Brooks commented that an equal take would create substandard lots in depth. Mayor Harvey requested that Councilman Markel discuss his analysis and cost estimates with the staff and meanwhile the other Council members would do their own studying on figures and perhaps be able to reach an understanding of the situation at the next meeting. Councilman Markel responded that he was at the disposal of the staff. CITY HALL AND CIVIC CE~ITER ~ ~! Councilman Markel, Chairman of the Council City Hall Building Commit- tee~ introduced the architect for the City Hall, Don Ramberg, who presented a report to the City Council on schematic plans for the building, showing numerous sketches and drawings and two model layouts. Council discussed the plans at length with Mr. Ramberg and the staff. Mr. Ramberg explained that it was impossible to design some elements of the City Hall at the pedestrian as well as parking levels until an overall de- termination was made regarding the adjacent areas of the Civic Center. He explained they had followed as closely as possible the design of the Civic Center presented by the Cc~mmnity Facilities plan, but that a number of things must be dOne at a larger scale for the City Hall and Court House, and should be done while plans are still flexible. Councilmen Burk and Gilmore reported on a meeting with the Civic Center Authoritywherein this problem was discussed as well as a possible source of revenue. Bob Thc~as, County Director of Building~ com~nented that the Civic Center Authority or Commission was the proper vehicle, with the city and county empowering the Civic Center Commission to design and have the cost allocated on an equitable basis, but as yet there was no idea of cost. It was moved by Councilman Gilmore, seconded by Councilman Herrin and carried, that the City Council indicate to the Civic Center Commission that the Council recognizes the need for final plans for the Civic Center area, is anxious to proceed in a way that is prudent, and encourages the Civic Center Commission to recomend to the City Council a request for whatever authority is needed to empower the C~i~ission to proceed with a design for the entire area. Mr. Ramberg advised the City Council that the final report on the City Hall plans would be in their hands before the end of the week. RECESS At 5:15 P.M., the meeting was recessed to 7:30 P.M. The meeting was recon- vened at 7:30 P.M. with all Council- men present. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by Captain Tom Cisar, Salvation Army. Mayor Harvey recognized members of the Santa Arm Chapter of DeMolay participating in Civic Day. TAXT OPERATOR APPEAL Rearing was opened on an appeal filed by Herbert G. Wilson from the Police Chief's denial of a permit to operate a taxicab. The Clerk of the Council reported that n~tices were mailed as required by the Municipal Co~e. After hearing testimony of the applicant, Mr. Wilson, the hearing was closed, there being no further testi- mony. Mayor Harvey explained the public hearing was closed on January 16 when the Council referred the appeal of the decision back to the Planning Commission. At the request of Mayor Harvey, the Plan~ing Director reviewed the action of the Planning Cummission in denying the application on the gr~sn~s of the staff's o~inion that it was a motel (based on the number of kitchens) and on the C~tssion's belief that as an apartment it should not be permitted in a retail commercial area at the density requested; that the City C~zucil felt the question of whether or not the project was a motel had been deter- mined or could be determined by itself but wanted the Ccm~issicm to take another look at the project and re-evaluate it in light of the willingness of the applicant to submit a revised plot plan; that the applicant had submitted a revised plan which had cleared up the lack of access to the Fire Department and the rear yard requirement, but in spite of this the Planning Commission felt it still ccmstituted an apartment and forwarded to the Council their statement re-affirming their original action. The Planning Director cc~nented that the revised plan is available, but he did not know whether it was admissable to the hearing; that other than the kitchens, the revised plan meets C-2 requirement; that in the event the Council should rule on percentage of kitchens on the ground floor, the staff had prepared a list of conditions which would be rec~mw, ended to apply to the revised plot plan and that the applicant had a co~y of the list of conditions, in which there were no changes except to delete those not applying to a motel. Ne reported further that the variance at this point is necessary only because of a previous Council determination that when the number of kitchens exceeds the standard of trade it is in fact an apartment and this development has ap- proximately 66% kitchens on ~the ground floor;that the initial set of conditions was for an apartment but that in neither set of conditions was there recom- mended individual apartment open spaces. Councilman Brooks c~ented that he would agree to the re~.~en~atiou ef 50% but that the applicant could have more kitchens by cc~- plying with the 25% requirement on the ground floor and have all kitchens on ~he seconal floor. C~umcilman Gilmore stated he would have no objection to allowing the al~peal as requested, with ~B units on the ground floor with kitchens an~ 23 without. Answering a n-aBer of questions by Council, the Planut~g Director stated that the parkt~ c~nformed to stau~-r~s for apartment units, that the size of individual units was above the mt~imum establishe~ for apartments, and that the only conditions not met if it were an apartment classification Would ha the size of the stree~ side yard and the front yard~ amd the density without private open space, which exceeds any R-3 development in Santa Ans. Mayor Harvey reported that he had already discussed with the City Manager possible approaches to breach the communications gap with members of the Industrial Division.
