E. So Lyons~ 4413 Wo Maurieo Janice Boer asked for removal of blockade of Ross Street west of Uhe high school~ it was the concensus of Council that since this is a cul-de-sac~ with everyone living on the street willing to cooperat% and since the swin~ning pool at Rosita Park is under construction at t.his point~ the Council could act favor- ably in this instance without v~olating its policy to n~t close streets for private purposes. ~n motion of Councilman Herrin~ seconded by Councilman Markel and carried~ the City Council granted the request for this year only~ S?DB~ALK SALE On motion of Councilman Markel~ seconded by Councilman Griset and carried~ Council granted the request of the Downtown Santa Ana Association to change the date of the sidewalk sale approved by the Council on June 19th from July 1st to July 15th. SIGN REQUEST Dick O~Neil~ President~ presented request of O~NeiL~s Hasty Moving and Storage, Ir.c. to place a sign advertising their business at the rear of their South Main property adjacent to the Newport Freeway, re- str~cted by Municipal Code Section 8441. The Assistant City Manager repoi~ted that although there is not an application filed yet~ Mr. O'Neil feels the maximum sign of 40 square feet is not adequate~ that the staff inlterprets the Municipal Code to limit to that area; and the Council should consider the reason for the Code provision~ which is a safety provision to not distract motorists on the freeway. C~m~ncilm~o Brooks asked if Section 84hlwas put in the Mtu~icl~al Code to comply with Stste law for the Federal Building Actj stating it is often misconstrued because it is aimed at billboards° Noting that the Code section preceded the Federal Billboard Act, Mr~ Lafer~ Senior Planner~ commented that the State will not landscape freeways if certaio standards are not adhered to. CITY C0~CIL 226 July 3~ 1~67 On motion of Councilman Griset, seconded by Councilman Carlson and carried, the matter was referred to the staff to report at the next meeting in regard to the inter-relationship of the Municipal Code section with state and Federal legislation. WEST DOWNTOWN DIAGONAL On motion of Councilman Brooks, seconded by Councilman Herrin and carried, Council approved the proposed West Downtown Diagonal, engineering alignment of Fourth, Fi~th and Sixth Streets connection at Ross Street a~d authorized the purchase of two lots at 5th and Ross for $118,000 o O0 o STADII~M RENTAL t ~ ~ ~J~ Charles Schlegel presented request from the Orange County Ramblers Football Assoc~at'i~n for a reduction in stadium rental fees, explaining they would like to enter into an annual contract with the City. The Assistant City Mamager reco~m~ended the contract for $10,000o00 for a maximum of eight games° On motion of Councilm~ Brooks, seconded by Councilman Carlson and carried, the City Council instructed the City Attorney to prepare an ordinance to amend Municipal Code to provide for aunual contract for stadium rental, and further to prepare contract with Orange Co~uty Ramblers for $10,000o00 annual fee for eight games. SCHOOL CROSSING GUARDS ~q ~5 On motion of Councilman Thurman, seconded by Councilman Griset and carried, the recommendations of the staff in Report dated April 28, 1967, were approved in regard to School Crossing Guards, setting warrants for placing of guards. Mr. Spragg commented the Staff would begin communicating with the schools and P oToAo groups and would seek further policy guidance frmn Council if necessary. MEDICAL DIRECTOR %q~l~' On motion of Councilman Griset, seconded by Councilman Carlson and carried, Council confirmed Manager's appointment of Dr. Tad Lonergan as City Medical Director for Civil Defense purposes o ABC ~L The request for reconsideration of the ~' protest ordered by the Council on June 5th on the Alcoholic Beverage License Application of T-G-I-F Company at 225 No Harbor was discussed at length with representative of owner of property, Nfo Kobayashi and Mr° Saudon~ representing proposed lessee. On motion of CounciLman Thurma~ seconded 1fy Councilman Carlson and carried, the matter was continued to the meeting of July 17th, and the Clerk was instructed to give the Council the cemplete file on the matter. SALARY INCREASES ~ ~0 The City Manager's report dated 6/28/67 reco~,mending salary increases for meri- torious service was approved on motion of Councilmau Griset, seconded by Councilman Markel and carried° CITY COUNCrr, 227 July 3, 1967 GRAND AND DYER NoW. Following the Pledge of Allegiance to the Flag~ the Invocation was d~livered by the Reverend Robert D~ Fraley of Saint Luke's Methodist ~.~PLUS PROPERTY_ SALE The Mayor aunounced the sale of real property described in Report 13-67 consisting of two parcels containing 18~938 square feet on the south side of Eighth Street, west of Baker Street~ stating a minimum price of $3~30 per square foot. had been set on the property. The Clerk reported that no sealed, bids had been received. The Mayor called for oral bids. Warren Proctor, Realtor, s~bmitted an oral bid of $62~495.40 with a Cashier's Check in the amount of $6~249o54. Janice Boer asked a m~ber of q~estions regarding zoning of the property~ publication of notice of sa!e~ and curb cuts in the area. Mayor McMichael called for additional bids. After three calls with no response~ the property was declared sold for $62~495.40 to Pacific Southwestern Properties. Mr~ Lafer~ answering a Council question, stated that LP zoning allows hospi~ais~ clinics, and professional offices~ and no other uses~ and tha~ a zone change ca,not be conditioned° On motion of Councilman Brooks~ seccnded by Councilman Oriset~ the City Council overruled the decision of the Plar~ning Commission~ approved Amend- ment Application 604~ and instructed the City Attorney to prepare an amend- ing orginance. The Clerk reported notice of hearing published in The Register June 17, with affidavit on file, and stated that a letter has been received from applicant asking for a.continuance of the hearing to July 17o There being no opposition to the request, on motion of Councilman Griset, seconded by CounciLman Herrin and carried, the hearing on Amendment Appli- cation 606 was continued to July 17o SPECIAL ~.W~TION - BOND ISSUE Mayor McMichael reporting for the Council c~ittee appointed to study the Chamber of Cozmerce request that Conncil initiate a new bond issue te be placed before the v~ters to finance the Capital Ymprovement Program, stated he and the ether members, COu~ci~m~u Brooks, and Councilman Thurman, had been meeting with the Chamber Executive Com- mittee to determine what leadership and fi~aucial support it would give to the Council. Bill Wenke, Vice President of the Chamber of Comerce, speaking for the Committee, reported the Committee rec~ended that a bond election be held this year as soon as possible for the apprcximmte sum of $25,000,000, con~ tents to be the same with some revision because of pro~ects accomplished; he further reported that the Santa Ann Chamber of Commerce will provide pro- fessional assistance and do all that is necessary to organize, finance and run the campaign. Council discussed at length the pressing needs of the community -- parks, storm drains, sewers, streets, etCo -~ and a bond program being the most economical means of financing. Gerald Peebler~ representing the South Main ~provement Associations asked the Council to widen Main at the southwest corner of First when First Street is widened~ The Public Works DirecOor explained that, the widening of First Street in this area is in the ~dget~ and he felt with the widening of First Street this property would be developed and acquisition costs would be less with the building demolished° He noted further that Main is narrow from Fdrst to 8th or lOth~ Councilman Markel said that he was in favor of switching some of the money allocated for the improvement of streets going south from Talbert ~ Mrs° Janice Boer requested the Council to consider putting in a vote recorder and a tape recorder in the Chamber'; objected to adding auotber Civil Defense man~ asked about legal fees to defend Chief of Police~ opposed improving streets in the south~ objected to lack of Ward 5 representation and questioned legality of Councilman Carlson voting on the Budget~ having been absent from the study sessions and hearing~ On motion of CounciLman Market, seconded by Councilman Herrin and carried~ the hearing on the proposed Budget for 1967-68 was continued to July 17o Councilman Herrin co~ented that every department with revenues should be as self-supporting as possible. Councilman Markel suggested adjustment of zoning application fees.
