The meeting was called to order at 2:00 P.M. in the Council Chambers, 217
North Main Street. Boll call was answered by Councilmen Wade Herrin, Walter
B~ooks~ James E. Carlson, Lorin Griset, J. Ogden Markel~ Thomas W. Thurman
a~d Mayor Tom McMichael. Also present were City Manager Carl Jo Thornton,
City Attorney William Mock, Director of Public Works Ronald Wolford, Planning
Director Van Stevens, and Clerk of the Council Doris Mo Brown~
MINUTES APPBOVAL Mrs o Janice Boer, Chairman of the
Preperty 0waers Protective League,
Inco~ protested minute wording that
a League statement on First Street was unsigned, submitted a paper containing
eight signatures of the Board of Directors of the League, and requested the
Clerk to add these signatures to the unsigned statement presented to Council
on September 5th. On motion of Councilman Griset~ seconded by Councilman
Herrin and carried, the paper containing the signatures was ordered filed°
The Clerk verified that the signatures were the same as the names typed on
the original statement.
On motion of Councilman Brooks~ seconded by Councilman Thurman and carried,
the Minutes of the Regular Meeting of September 5, 1967, were approved~ and
the Clerk was directed to attach the paper containing the signatures of the
Board of Directors of the Property Owners Protective League~ Inc. ~to the
statement received at the September 5th Council meeting~

A motion by Councilman Brooks~ seconded by Couaci~m-n Herrin to waive :full

of CATV frsachise. It is our imtention to award, a framchise contract
to the successful bidder based on the following fact~rs~ the amount

It is our intention that the franchise should be made exclusive for the
first three years of operation te protect the large capital investment
required, and tha~ the franchise then would be aon~c]~sive for an
additional period of seventeem years° Si~ce thi~ t~e *f facility
probably willmake use of existing lines used by ti~e phone ccmpa~v
amd electric utilities~ it is our intentio~ t~ co~u~b with these
private utilities for their ad~lce ~nd guidance in the preparation
of our bidding specifications~

similar to utilities rather than transporbable~

Mr. Karcher presented plot plan and artist rendering showing new design of the
building and explained that the building would now face 17th Street~ would have
one additional parking stall, making 23 parking stalls, and the interior would
have 12 tables, seating 54.
Mayor NcMichael spoke in opposition on the basis of lmcompatibility with neighborhood
and lack of 2 lots suggested by planning Ccmmuission stu~lyo Don Christeson stated
there was no har~lship, as required by the Municipal Co~e, and there are 1~2 uses for
the property, all of which fall within C ~ zoning. Declared out of or,er, it was
moved by Councilman Griset to reopen the hearimg but there was no second.
It was moved by Councilman Carlson, seco~ed by Couacilmam Nerriu, to overrule
the action of the Planning Commission and instruct the City Attorney to prepare
a resolution granting Variance 67-63 subject to conditions in Staff Comments

~P~ BAY LAND EXCBANGE Council discussed the exchange of laud
in the Upper Bay by the Board of Super-
visors and The Irvine Company~ with
Councilman Markel requesting the C~Ancil to ask the Board of Supervisors

PARTON STREET CLOSII~G Co~ucilman Markel reported that on
the closed portion of Par~on Street~
'the school now has three large trailers
as classrooms, with temporary utility poles, and objecte~ on the basis the
Council actic~ to close the street was for safe crossing of students. The
City Attorney suggested that if it is the view of Council that the school
district has overreached or assumed more thau they should, the situation
could be corrected by direction of the Director of Public Works that the
trailers be move~o
Noting that he and Councilman Markel had opposed the action to close the
street~ Mayor McMichael state~ it was taken by ~ majority of Council and
is a closed issue u~less the City Attormey sees Jeopardy to ownership of
the street. Cozmaenting that the Council was told the closure was needed
to protect children crossing the street, J~uice B~er read a school paper
article saying the trailers were permanently located on Parton Street,
and requested Council open the street o
A three minute recess was declared at 9~15 PoM~ The Council reconveyed
at 9:20 PoM. with all Councilmen present~
Councilman Markel remarked that the Fire Chief had been opposed to the
closing. CounciLm~uBrooks suggested the proposed use of the structures
be clarified and the Council should be informed prior to placing anything
in the street.

CROSSWALK Asked by Councilman Markel if pedestrian
crossing in Wilshire area for Glen Martin
School could be changed to a school cros~
sing, the City Manager explained that state law prevents it because of the
distance fro~ school.
BILLIABD AND POOL OPERATION Speaking of propose~ use of building at Main

center~ Councilman. Markel asked Council to
consider deleting from Municipal Co~le 'the requirement that a use permit must be
obtained. The matter was discussed at length but no action taken.
