CRA 2003-10 A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA APPROVING AN AFFORDABLE HOUSING PARTNERSHIP AGREEMENT BETWEEN THE AGENCY AND HABITAT FOR HUMANITY OF ORANGE COUNTY FOR DEVELOPMENT OF THE PROPERTY LOCATED AT 322 E. ADAMS STREET BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA, AS FOLLOWS: ~: The Board of the Community Redevelopment Agency of the City of Santa Ana hereby finds, determines and declares as follows: A. The Community Redevelopment Agency of the City of Santa Ana ("Agency") has heretofore adopted the Redevelopment Plan for the Santa Ana South Main Street Redevelopment Project Area on July 6, 1982 by Ordinance NS1639, as amended (the "Project Area") which includes strengthening of public-private partnerships to provide more affordable housing, and particularly to provide decent, safe, sanitary, and affordable housing to the lower income citizens of the City of Santa Ana. B. Pursuant to Sections 33334.2(a) and 33334.6(c) of the California Community Redevelopment Law (California Health and Safety Code Section 33000 et seq.) not less than 20 percent of all taxes which are allocated to the Agency are set aside in a Low- Moderate- Income Housing Fund ("the Housing Funds") and used by the Agency for the purpose of increasing, improving and preserving the community's supply of Iow and moderate housing available at affordable housing costs to persons and families of Iow- and moderate-income, including very-low- income persons. C. Pursuant to Section 33334.2(e) of the Community Redevelopment Law, the Agency may exercise any and all of its powers to carry out this purpose. D. Pursuant to Section 33334.6(a) of the Community Redevelopment Law, the California State Legislature has found and declared that the provision of LES 8/26103 affordable housing outside of redevelopment project areas can be of direct benefit to those projects in assisting the accomplishment of project objectives. E. Pursuant to Section 33334.2(g) of the Community Redevelopment Law, the Agency may use Housing Funds to assist in the prevision of housing for Iow- or moderate-income households outside the Redevelopment Project area if such use will be of benefit to the Redevelopment Project, and the Legislature has further found and declared that the prevision of replacement housing pursuant to Section 33413 is always of benefit to a project. F. The Agency has used Housing Funds to purchase certain real property located at 322 E. Adams (the "Property"), which is located outside the Redevelopment Project area. G. In order to implement the Redevelopment Plan, the Agency has agreed, subject to the approval of the City Council, to sell the Property pursuant to the terms and provisions of an Affordable Housing Partnership Agreement (hereinafter referred to as the "Agreement") between the Agency and Habitat for Humanity of Orange County, a non-prefit corporation, which is on file in the office of the Executive Director of the Agency, in which the Property is described. H. The Agency has duly considered all of the terms and conditions of the proposed sale, and believes that the proposed sale is in the best interests of the City and the health, safety, morals and welfare of its residents, and in accord with the public purposes and provisions of applicable state and local laws and requirements. I. The Agreement contains all of the provisions, terms, conditions and obligations required by the state and local laws, including long-term affordability covenants benefiting the Agency. J. Habitat for Humanity possesses the qualifications and financial resources necessary to acquire and insure development of the Property as two single-family homes to be sold to qualified very-low income families in accordance with the purpose and objectives of the Redevelopment Plan. K. The Agency has held a public hearing on the proposed Project and the Agreement as required for a small housing project by Section 33433(c) of the Community Redevelopment Law, after having duly provided notice of such public hearing in accordance with state law. 2 LES ~2~03 L. The Agency recognizes that it has received and heard all oral and written objections to the proposed sale, and to other matters pertaining to this transaction, and that any such oral and written objections are hereby overruled. M. The proposed sale of the Property is exempt from further review and in accordance with the California Environmental Quality Act, categorical exemption ER No. O3-171 will be filed for 322 E. Adams. N. The Agency hereby finds and determines that the sale of the Property will provide housing for very Iow-income persons. O. The Agency hereby finds and determines that the information set forth herein is true and correct. P. The Agency hereby approves the sale of the Property. ~. The Agency finds and determines that the use of the Housing Funds as authorized by this resolution will be of benefit to the Redevelopment Project Area. ~. The Affordable Housing Partnership Agreement is hereby approved, and the Executive Director of the Agency is hereby authorized to execute the Agreement, with such non-substantive changes as may be approved by Agency's General Counsel. ~. The Executive Director of the Agency is hereby authorized to take all steps, and to sign all documents and instruments necessary to implement and carry out the Agreement on behalf of the Agency. 3 LES 8/26/03 ADOPTED this 2nd.day of September, 2003. ~chgauel A.
