to amend Sectional District Map 32-4-9
by prezoning property on the west side of Tustin between Fairhaven and the
Garden Grove Freeway from the A 1 to the R 1 and C 5 Districts. Planning
Commission recommended denial.
Mike Immel, attorney representing applicant, explained to Council that applicant
was requesting that the property fronting on Tustin Avenue for a depth of 190
feet be zoned C 5 (1 lot) and the rest of the 9 acres be zoned R 1 (34 lots), as
applicant felt the highest and best use for the frontage along Tustin Avenue would
be commercial zoning. Mr. Immell presented a list of conditions which his client
would be Willing t0 bomplM with if attachedlto' T~ehtatiVe Tract Map~6530 approval
and this would be the same as a variance procedure. The communication was
ordered filed, on motion of Councilman Herrin, seconded by Councilman Griset

applicant could request a variance on the Tustin lot; however, the applicant
asked for decision on the application as filed, so the Planning Commission
denied the application.

favor of the tract map, and Philip Simons spoke opposing it and asked if
developer would be able to use the C 5 lot on the tract map for commercial
use. Mayor McMichael explained that by the previous action on Amendment
Application 634, all lots would remain R 1, and if the developer wanted to
develop the large lot on Tustin as anything but R 1, he would have to request
a variance. The hearing was closed.
