MINUTES OF THE ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF TILE CITY OF SANTA ANA, CALIFORNIA April 8, 1969 The meeting was. called to order at 7:30 P.M. in the Council Chambers, 9.17 North Main Street. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by Major Tom Cisar of The Salvation Army. Roll call was answered by Councilmen Wade Herrin, Walter Brooks, Lorin Griset, J. Ogden Markel, Thomas W. Thurman, and Mayor Tom McMichael. Also present were City Manager Carl J. Thornton, City Attorney William L. Mock, Clerk of the Council Florence I. Malone, and other department heads. CLERK'S REPORT The Clerk of the Council reported that the Order of Adjournment from the April 7, 1969, meeting was posted as required by law with a Certificate of Posting on file. CERTIFICATE OF CANVASS The Clerk of the Council presented to the City Council a Certificate of Canvass of the returns for the regular municipal e~ection held on April 1, 1969, and reported the following candidates received the highest number of votes for the respective offices: Councilman, Ward 1 - Jerry M. Patterson Councilman, Ward 3 - Wade Herrin Councilman, Ward 5 - Ray Villa Councilman, Ward 7 - Walter Brooks Member of the Board of Education, Full Four Year Term (three offices open) Charles E. Elerding, M.D. Jesse F. Berry Robert K. Harr Member of the Board of Education, Short Two Year Term (one office open) Rudy Montejano On motion of Councilman Herrin, seconded by Councilman Griset, the City Council accepted the Certificate of Canvass from the Clerk of the Council, on the following roll call vote: AYES: Herrin, Brooks, Griset, Markel, Thurman, McMichael NOES: None ABSENT: None CITY COUNCIL 176 April 8, 1969 RESOLUTION 69-55 RESOLUTION 69~-55 STATING AND 'DECLARING THE RESULT OF THE CANVASS OF ELECTION RETURNS OF THE GENERAL MUNICIPAL ELECTION HELD IN THE CITY OF SANTA ANA, CALIFORNIA, ON APRIL 1ST, 1969, was read by title. It was moved by Councilman Herrin, seconded by Councilman Griset, that further reading be waived and Resolution 69-55 be adopted. On roll call vote: AYES: Herrin, Brooks, Griset, Markel, Thurman, McMichael NOES: None ABSENT: None The Clerk of the Council announced that Councilman elect, Ray Villa, had failed to comply with Section 11563 of the Elections Code, which provides that statements of receipts and expenditures shall be filed not later than the day preceding the day upon which the candidate takes office; that Mr. Villa's statement had not been filed until today; that, accordingly, he could neither be sworn into office nor issued his Certificate of Election. The City Attorney further explained that Mr. Villa could be seated any time after tonight; that another possibility available to the Council was the appoint- ment of Mr. Villa to fill the vacancy on the Council created by the resignation of Mr. James Carlson; that if an elected candidate cannot qualify to be seated, his predecessor will remain on the Council until such time as he may qualify. Following further discussion, on motion of Councilman Herrin, seconded by Councilman Brooks, Ray Villa was appointed to fill the vacancy created hy the resignation of Councilman Carlson, on the following roll call vote: AYES: Herrin, Brooks, Griset, Thurman, McMichael NOES: Markel ABSENT: None The Clerk of the Council administered the oath of office to Ray Villa, replacing Councilman Carlson. INSTALLATION The Clerk of the Council administered the Oath of Office to the newly elected Councilmen, Jerry M. Patterson, Wade Herrin, and Walter Brooks, and thereafter presented Certificates of Election to each. ADJOURN SINE DIE On motion of Councilman Herrin, seconded by Councilman Grise~ and carried, the City. Council adjourned sine die. CITY COUNCIL 177 April 8, 1969 NEW COUNCIL CONVENED The new Council members being seated, the meeting was called to order by the Clerk of the Coui~cil with the following members present: Walter BrO~4s, Lorin Griset, Wad~' Herrin, J. Ogden Market~ Jerry M. Patterson, Thomas W, Thurman, and Ray Villa. ELECTION OF MAYOR AND CoUncilman Lorin Griset was nominated VICE MAYOR for Mayor by Councilman Thurman, seconded by Councilman Patterson. There being no further nominations, it was :moved by Councilman Herrin, seconded by Cour~cihnan Brooks, that nominations be closed and the Clerk be instructed to cast a unanimous ballot for Councilman Griset for Mayor. The motion was ado~ted unanimously. Mayor Lorin Griset assumed the Chair. Councilman Wade Herrin was nominated for Vice Mayor by Councilman Brooks, seconded by Councilman Thu~-~an. There being no further nominations, it was moved by Councihnan Villa, seconded by Councilman Patterson, that nominations be closed and a unanimous ballot be cast for election of Wade Herrin as Vice Mayor, The motion was adopted unanimously. SPECIAL PRESENTATIONS Mayor Griset presented plaques of appreciation to retiring Mayor Tom McMichael and former Councilman James E. Carlson. SANITATION DISTRICTS On motion of Councilman Herrin, APPOINTMENTS seconded by Councilman Brooks and carried, the City Council appointed Mayor Lorin Griset as~e Director for Sanitation Districts 1, 2, 3, and 7. 0n motion of Councilman Brooks, seconded'by Councilman Thurman and carried, the City Council appointed Vice Mayor Wade I~errin as the Alternate Director for Sanitation Districts 1, 2, 3, and 7. ~' ADJOURNMENT There being no further business to come before the Council, the meeting was adjourned at 8:32 P,M., on motion of Councilman Thurman, seconded by Councilman Villa and carried.
