EraS, J. Ogden Markel, Jerry M. Patterson, ~ud Mayor Lorin Griset. Councilmen Wade Herrin and Ray Villa were absent, but arrived later. Also present were City Manager Carl J. Thornton, City Attorney William L. Mock, Director of Public Works Ronald Wolford, Director of Pla~nimg Van Stevens and Clerk of the Council Florence I. Malone. MINUTES O~ motion of Councilman Brooks, seconded by Councilman Evans and carried, the Minutes of the Regular Meetim~ of November 3, 1969 were approved, with a correction on Page 37~ to indicate that Council- maw Evans left the Council Chambers before consideration of Tentative Tract Map 709h and returned to the Council table after action was taken on Tentative Tract Map 709~. Councilmen Herrin and Villa arrived at the Council meeting. EXECUTIVE SESSION At 2:05 P.M., the City Council adjourned to E~ecutive Session for consideration of a per- sonnel matter. The Council reconvened at 2:35 P.M., with all Council members present. STUDY SESSION At 2:35 P.M., on motion of Councilmam Patterson, seconded by Councilman Herrin and unanimously carried, the City Council adjourned to Study Session, which was held in the Council Chamber, for consideration of the recodification of the Municipal Code and to study the plans for the new City Hall. After studying the summary of the recodification of the Municipal Code, Council agreed to go on with the Study Session at the end of the evening meeting. RESIDENCY CLARIFI- In response to a request from Mrs. Jamice Boer, CATION 912 North Lowell Street, for clarification of his residency, Coumcilman Brooks stated that he was legally a resident ef Ward 7. RECESS At 3:20 P.M. a five minute recess was declared. The Council reconvened at 3:25 P.M., with all Council members present. AG~DA ORDER On motion of CounciLman Brooks, seconded By Councilman Evans and carried, the City Council agreed to take Agenda Items 19 through 23 and Agenda Item8 out of order and consider at this time. CITY COUNCIL -383- November 17, 1969 ASSESSMENT ~4r. Robert Newco~ab, speaking on Behalf of DISTRICT 236 the City Center Association representing a group of property owners on Fourth Street, expressed appreciation to the City Coumcil and the City Staff for their assistamce in gettimg the district estab- lished. In response to a question by Councilman Villa, Mr. Newc~ab stated that the property owners from Spurgeon to French had not indicated their interest im going into this project, alth~ they had been invited and several had attended a meeting recently held for review of the plans. The Public Works Director displayed the plans and specifications and explained the various phases of the project, including tree planting in the tree wells in the sidewalk area back of the curb, resurfacing of sidewalks with. a color harmonized textured finish, the street lighting, benches and waste containers of precast comcrete, and an automatic irrigation system. He further explained the cost of the project was estimated at $360,000, or a little fmore than $100.00 per front foot, but that the City has budgeted a portion of this in the Street Lighting Budget so that the cost to the property owners would be under $100 per front foot, estimated. He also stated that the project could probably be completed in July. D. 236 B]~)S, ASSESSMENT DISTRICT NO. 236, SANTA ANA, CALIFORNIA was adopted on motion of Councilman Patterson, seconded by Councilman Evans on the following roll call vote; AYES: NOES: ABSENT: Herrin, Brooks, Evans, Patterson, Villa, Griset Markel None ORD NS-991 JUNK AND AUTO SALVAGE YAI~DS Council considered ORDINANCE NS-991 AMEND- ING THE SA~A ANA MUNICIPAL CODE BY ADDING SECTION 9260.9 TO PART 6, CHAPTER 2, ARTICLE IX '£H~tgOF PERTAINING TO NON-CONFORMING JUNK Mr. Joe Solomon, Anaheim Auto Salvage Company, 4526 West 5th, Santa Ama, stated that he neither opposed nor favored the proposed ordinance; that he wanted to bring to the Council's attention the fact that on two separate occasions he had applied for a Variance to make improvements; that many of the area residents had opposed granting of these Variances; and that both requests had been denied. He further stated that it would not be econ- omically feasible for him to make the improvememts required by the Ordinance because of the large size of the yard; and that he estimated the cost would be between $25,000 - $30,000. A motion was made by Councilman Patterson, seconded by Councilman Villa, to pass Ordinance NS-991 to second reading. Councilman Markel made a motion to amend the above motion to pass Ordinance NS-991 to second reading with the stipulation that the words "six months" im Section 9260.9 (e) be chamged to "one and one'half years" regarding the time limit to conform to the provisions of the ordinance, which motion died for lack of a second. Councilman Herrin then made a motion seconded by Coumcilman Markel to amend the first motion to pass Ordinance NS-991 to second reading with the stipulation that the words, "six month," in Section 9260.9 (e) be cha~ged to "one year" which motion failed adoption on the following roll call vote: AYES: NOES: A BSE~T: Herrin, Markel Brooks, Evans, Patterson, Villa, Griset None The original motion was adopted on the following roll call vote: AYES: NOES: ABSENT: Herrin, Brooks, Evans, Patterson, Villa, Griset Markel None CI~ COUNCIL -385- November 17, 1969 SPEC . The City Attormey explalaed that a letter had beem seat to the Alcoholic Beverage Coatrol Board at the Coumcil's directiom obJectimg umofficially to the re-opemimg of this locatiom because of the history of problems at this address im the past. Ne stated that the letter did mot coastitute a formal protest, so there would be mo hearimg, amd the letter is of mi~tmal value as far as a protest is comcermed. Mr. Hart~an said his Association opposes the pla~s for the trailer deVelopment because it did not conform to the high standards of develol~aeat of the area; that appareat]~r misumderstamdings had arises between the developer's re~res~enta- rive amd the homeowner's association as to proposed meetim~s amd cc~au~icatiom~ as a result of which the association's protest was not co,pie%ed. CROSSING GUARD Mayor recognized Jotua Fueates, who requested REQUEST that the City replace the Roosevelt School crossing guard removed last year from First amd Oramge, explai~img that the Traffic Safety Committee to date had made mo reports om a study of the imterseotiom this fall amd that Because the school is om double sessioms with peak traffic hours at 7:BO A.M. amd 4:15 P.M., coincidimg with arrival amd dismissal times, the crossing guard is meeded. Om motiom of Coumcilaan Villa, secomded by Coumcilma~ Patterson amd u~amimously carried, Staff was directed to imitiate a study of the imtersectiom amd report Back as quickly as possible to Coumcil on whether a crossing guard is meeded. c0 sc November 17, 1969 Crossing Guard Request (continued) Mrs. Carlos Martinez and Mrs. Betty Gonzales expressed the opinion that a crossing guard is needed at the intersection immediately since the small five year olds do not understand the signal light. R. J. Christenson, 2115 N. Greenbrier, also spoke. It was moved by Councilman Brooks, seconded by Councilman Villa, to place an emergency crossing guard at the intersection until Council can determine whether the warrants are met for a guard at this corner. The motion was adopted on the following roll call vote: AYES: NOES: ABSENT: Brooks, Evans, Markel, Villa Herrin, Patterson, Griset None After further discussion, on motion of Councilman Patterson, seconded by Councilman Herrin, it was directed that the Council initiate a letter to the Board of Education, requesting they meet with the City Council to discuss their mutual problems, itemizing as the first point of business, school crossing guards.
