C MANAGER APPROVED 0 As Recommended 0 As Amended 0 Ordinance on 1" Reading 0 Ordinance on 2nd Reading 0 Implementing Resolution 0 Set Public Hearing For CONTINUED TO FILE NUMBER RECOMMENDED ACTION Direct the City Attorney to prepare and authorize the City Manager and Clerk of the Council to execute an agreement with the law firm of Daley and Heft for specialized legal services for the City of Santa Ana. DISCUSSION .The City Attorney' s Office provides legal sèrvices to the City, its officials and employees, primarily through staff attorneys. However, it is sometimes necessary to retain outside counsel for specialized fields of practice and cases that have extraordinary staffing requirements. The City is, currently engaged in various extensive projects that require regular and constant eminent domain proceedings. While our staff has handled the majority of the legal proceedings, both the volume and the complexity of the cases now require and merit additional attention that only a firm that specializes in eminent domain can provide. Daley and Heft has been handling eminent domain cases since 1980 for a variety of public entities throughout California. The scope of services has varied from preparing Resolutions of Necessity, to review of appraisals, to negotiations. Daley and Heft's billing rate is $200 per hour, plus reimbursable costs for expenses such as travel, photocopying and facsimile transmissions. A member of the Litigation Division will supervise counsel to ensure that costs are efficiently reasonably maintained. In surveying the limited market for these services, City Attorney staff found the rate for the services to be competitive given the complexity of the litigation and expertise possessed by Daley and Heft. . 25G-1 Agreement with Daley and Heft March 15, 2004 Page 2 FISCAL IMPACT Funds are budgeted and available in the Public Works account for Transportation System Improvement Area D Funds (992-631-6631) and various projects in the Capital Improvement Program. .--,--" APPOVED AS TO FUNDS AND ACCOUNTS: 25G-1 -'~------- '
