Direct the City Attorney to prepare and authorize the City Manager and the Clerk of the Council to execute a Cooperative Agreement with Metrolink for the construction of a block wall for the Art Panels Project at The Depot. DISCUSSION Staff is requesting authorization for two cooperative agreements with Metrolink to facilitate the concurrent construction of two major projects at the Depot. These agreements are needed to allow Metrolink to efficiently coordinate construction activity within the railroad right-of way and reduce overall project costs. The first agreement is for construction of a new passenger boarding platform with pedestrian bridge access to The Depot. Staff and Metrolink have been working cooperatively to produce a design that is architecturally compatible with the existing train station and functionally serves the needs of the station patrons. The project scope includes removal of the existing center platform and construction of a new second platform on the east side of the tracks. A new pedestrian bridge accessible from the station building and plaza will be constructed to provide access to the new platform. The project is fully funded by 8Metrolink through a $5.6 million State grant. There is no City funding required for this project. 25J-1 Cooperative Agreements July 6, 2004 Page 2 with Metrolink The second agreement is for construction of a block wall required to facilitate the City's Art Panels Project. In 1999, the City Council authorized staff to apply for Transportation Enhancement Activities (TEA) grant funds to design and construct a concrete block wall that will function as a backdrop upon which art images can be mounted or embedded. The City received $375,000 in TEA grant funds for this project. The wall will be approximately 1,000 feet long by 15 feet high and be constructed adjacent to the new second platform on the east side of the tracks. The wall will also serve to enhance the appearance of the station area by screening The Depot from the adjacent industrial properties. Cooperative Agreements are required to define the roles and responsibilities of both parties during and after construction. Metrolink will be responsible for construction and timely completion of both proj ects. The City will be responsible for the operation and maintenance of the new second platform, pedestrian bridge structure and block wall. The project schedule calls for construction to begin in August 2004 with a projected completion date of June 2005. The Art Panels will be installed in the future as part of a separate contract. ENVIRONMENTAL IMPACT Metrolink filed a Statutory Exemption for the second platform and pedestrian bridge project under California Code of Regulations Section 15260, et seq. The project qualifies for exemption because it proposes to modernize an existing station and parking facility. The Block Wall and Art Panels project is Categorically Exempt under the California Environmental Quality Act and the City is currently processing a Categorical Exclusion under the National Environmental Policy Act. FISCAL IMPACT Funding for the new platform and bridge will be provided by Metrolink through a $5.6 million State grant. There is no City funding required for this project. The recommended action will allow the City to reimburse Metro1ink for construction of the block wall. Funds for the block wall reimbursement are available in the Select Street Construction Fund (account no. 59-551-6631) and the Capital Outlay Fund (account no. 51-615-6631, project no. 1821).
