October 5, 1970
The meeting was called to order at 2:00 P, M. , in the Council Chambers of the
City Hall Annex, 500 West Sixth Street, with the following Councilmen present:
Wade Herrin, J, Ogden Markel, Jerry M. Patterson, Ray Villa, Harry K.
Yamamoto, and Mayor Lorin Griset. Councilman Vernon S. Evans was
absent, but arrived shortly. Also present were City Manager Carl J.
Thornton, City Attorney William L. Mock, Director of Public Works Ronald
Wolford, Director of Planning Herbert Wieland, and Clerk of the Council
]Florence I. Malone.
MIN UTES On motion of Councilman Villa,
seconded by Councilman Patterson and
unanimously carried, the Minutes of
the Regular Meeting of September 21, 1970 were approved as submitted.
Councilman Evans arrived at the Council meeting.
EXECUTIVE SESSION At 2:02 P.M. , the City Council
adjourned to Executive Session for
approximately I5 minutes. The
Council reconvened at 3:25 P. M. , with all Councilmen present.
COMMUNITY IMPROVEMENT Ruben Alvarez, Il01 West Walnut,
COMMITTEE REQUESTS Chairman of Community Improvement
Committee, presented a petition
conlaining approximately 58 signatures of area residents requesting that a
residence at 1109 West Walnut be torn down for health and safety reasons
and that the City purchase the property for a mini-park. Mr. Alvarez
explained that he had talked to Councilman Villa and to the City Manager
and his staff regarding the matter.
The City Manager reported thai Mr. Alvarez had been informed that it would
take court action for the City to demolish the building and that the building
was not dilapidated enough for staff to recommend demolishing. He also
stated that it was the owner's stated intent to tear the building down within
60 days and replace it with multiple units and that he was not planning on
selling the property. The City Manager explained that development of
mini-parks is not a general program of the City; that there were some
temporary mini-parks in the City, but that it was impossible to develop
one on a single lot. He further explained that staff was undertaking a
study of placement of playground equipment in the westerly portion of the
grounds between First and Wainut Streets next to Flower and that a
schedule is being worked out for this.
Mr. Alvarez also asked Council if an adult crossing guard could be installed
at the intersection of First and Flower Streets, a signalized intersection, for
McKinley School, explaining that the traffic has increased and there are
presently four double sessions ag the school.
On motion of Councilman Patterson, seconded by Councilman Herrin and
unanimously carried, the request for a crossing guard was referred to staff
for a check to see if the intersection of First and Flower Streets meets the
warrants for an adult crossing guard.

Walter T. Flaherty, 1915 N. Flower, expressed the opinion that if there were
no parking allowed .on Flower Street at any time in this area, the school boy
patrol at Second and Flower would be much more effective.
On motion of Councilman Herrin, seconded by Councilman Patterson and
unanimously carried, the parking matter was referred to staff for report
back to Council.
SPECS. 641-199 AND 641-199A Acting on the recommendation of staff
McFADDEN LIBRARY on motion of Councilman Patterson,
FURNISHINGS seconded by Councilman Markel and
unanimously carried, Council ordered
filed report of bids received for Spec. 641-199, Furniture for McFadden
Branch Library; awarded contract on the basic bid, excluding all of the
shelving (Items 2-1 through 2=10) to Bellview Furniture Manufacturing Company;
awarded contract for Items 2-1 through 2-10, shelving, to the Library Bureau
of Remington Rand for 3/4" shelving; and rejected all other bids.
On motion of Councilman Herrin, seconded by Councilman Yamamoto and
unanimously carried, Council ordered filed report of bids received for
Spec. 641-199A, Recordak Equipment for McFadden Branch Library;
awarded contract to Eastman Kodak Company, the only bidder, for Item c
only~ 2 Recordak Starfile Microfilmers, Model RV-1.
SPEC. 641-203 - TRACTOR On motion of Councilman Herrin,
AND FRONT END LOADER seconded by Councilman Patterson and
unanimously carried, Council ordered
filed report of bids received for Spec. 641-203, Tractor and Front End Loader
with 3 Point Hitch; awarded contract to lowest bidder meeting specifications,
T & H Equipment Co.; and rejected all other bids.
SPEC. 641-204 On motion of Councilman Patterson,
AIR PAKS seconded by Councilman Villa and
unanimously carried, Council ordered
filed report of bids received for Spec. 641-204, 28 Survivair Air Paks or equal;
awarded contract to the low bidder, Halprin Supply Company, who had
corrected a clerical omission in their bid to allow the City a 2%-30 days
discount; and rejected all other bids.
SPEC. 641-200 On motion of Councilman Herrin, seconded
HYDRAULIC SEWER CLEANER by Councilman Yamamoto and unanimously
carried, Council ordered filed report of
bids received for Spec. 641-200, One Hydraulic Sewer Cleaner; awarded contract

MUNICIPAL BOWL INCIDENT Council considered the letter dated
September 22, 1970, from Joan S.
Bonebrake, 12421 Eveningside Drive,
regarding a fracas at the Municipal Bowl after a ~ootball game on September
18 and requesting more police protection. Mrs. Bonebrake was present and
it was explained to her that the police have changed some of their procedures
so that toward the end of the games, in the future, police will be stationed
outside of the stadium and will be able to minimize indidents of this sort;
school officials also will be cooperating in any way they can.

vened with all Council members present.

Dr. Russ Pavey of the Broadway Baptist Church.
PUBLIC HEARING
STREET VACATION
Hearing was opened on the proposed
vacation of portions of Hubba rd, Regent and
Warren Streets.
There being no response to the call for testimony, the hearing was closed.

6-5-9 by rezoning from the 60-A1-7200 District to the R I and R 2 Districts
property located on the southwest corner of Fairhaven and Grand Avenues.

Frank Bueche, 2009 E. Edinger, representing National Land Development
Company, spoke in favor of the proposed rezoning. He explained that his
company had previously applied for rezoning of the subject property to R 4 ,
which had been denied, so they were now proposing to step-down the
zoning to R I and R 2 which they felt was compatible with the surrounding
neighborhood.
Mrs. Judith Zander, 2611 Linwood Avenue, spoke in opposition to the proposed
rezoning, stating that this would increase the density in the area from medium
to high density; also that there was a shortage of park land for the present
population regardless of any future development. She explained that the
residents in the area would be satisfied with R I zoning for all of the subject
property.
The hearing was closed.
After discussion by Council, it was moved by Councilman Herrin, seconded by
Councilman Evans, to approve Amendment Application 672 and instruct the City
Attorney to prepare an ordinance to reclassify the property according to
Exhibit A. The motion passed on the following roll call vote:

APPEAL 247 - VA 70-41
STEPHENS
Hearing was opened on Appeal 247, filed
by Walter M. Beckman, appealing Planning
Commission's approval on September 14,
1970 of Variance Application 70-41, filed by Gene J, Stephens, to construct a 2
story, 116 unit garden apartment complex in the R 1 District at 4818 W~ McFadden.
Walter Beckman, 5002 W, McFadden, the appellant, explained to Council that he
owned the property to the west of the proposed development, his property being
a mobile home park, and that a school was situated on the other side. He stated
'his main concern was overcrowding of the schools in the district, since a 191
space mobile home park is presently under construction in the area; another
concern was high density; he further stated that with the R 1 homes in the
surrounding area, this property should be developed as residential and thai
granting of the subject variance would be contrary to the City's General Plan~
Warren Proctor, 115 West 15th Street, agent for the buyer and seller, spoke
against the appeal. Mr. Proctor explained that an intermediate school is to
the east of the proposed development, an established tract with no street to this
particular parcel is to the south, Mr, Beckman's mobile home park is to the
west, and across the street the property is already developed with a church and
some older properties. He stated that it would be difficult to develop the property
as R 1 because it has to be developed within its own boundary lines because fhere
is no other access.
The hearing was closed.
It was moved by Councilman Villa, seconded by Councilman Herrin, to uphold
the action of the Plarming Commission and instruct the City Attorney to prepare
a resoltuion granting Variance Application 70-41 subject to conditions in Finding
of Fact dated September 14, 1970. The motion passed on the following roll call
vote:

ORAL COMMUNICATIONS On behalf of Mayor Charles E. McCarty
of St. Paul, Minnesota, Councilman
Yamamoto presented to the Council the
Key to the City of St. Paul, which had been given by the Mayor to a resident
of Councilman Yamamoto's ward to present to the Council.

unanimously carried, staff was directed
to bring back a recommendation regarding distance requirements and number
of dogs for new kennels coming into the City. During the discussion, Councilman
Markel requested stricter enforcement of the ordinance regulating unattended
and stray dogs in the City's streets.
