APPROVED D As Recommended D As Amended D Ordinance on 1 sl Reading D Ordinance on 2nd Reading D Implementing Resolution D Set Public Hearing For CONTINUED TO FILE NUMBER RECOMMENDED ACTION Direct the City Attorney to prepare and authorize the City Manager and Clerk of the Council to execute a second amendment to the agreement with DMJM/Harris Inc. in the amount of $150,000 for a total contract amount of $535,000. DISCUSSION The Public Works Agency is responsible for the implementation of the City's NPDES storm water permit, which contains specific requirements and deadlines. Due to staffing shortages, the Agency has been utilizing the services of several consultants that specialize in the field of stormwater management. The Agency initiated an agreement with DMJM/Harris in August 2001 to perform construction inventory and inspection of private and public proj ects, review of water quality management plans, and environmental performance reports. Their contract was amended on September 15, 2003 to continue the required inspections and meet the mandated deadlines. In order to perform the tasks outlined in the NPDES permit and comply with the imposed deadlines, a second amendment is requested. In addition to the continued construction inspection services, DMJM/Harris will conduct training for City staff on NPDES requirements as it relates to the city's field and office operations, and design of structural Best Management Practices (BMP's) for City facilities such as the City Yard. It is estimated that the DMJM/Harris contract will need to be increased an additional $150,000. 25Q-1 Second Amendment to Agreement With DMJM/Harris, Inc. November 15, 2004 Page 2 ENVIRONMENTAL IMPACT In accordance with the California Environmental Quality Act (CEQA), the recommended action is not considered a CEQA project. Therefore, no environmental documentation is required. FISCAL IMPACT Funds are available in the Federal Clean Water Enterprise (account no. 57-635-6291) .
