Recitals: A. City and Consultant entered into Consultant Agreement N2000 -115, dated July 18, 2000, (hereinafter "said Agreement ") by which Consultant has provided counseling and instructional services to inmates housed at the Santa Ana City Jail. B. Said Agreement has been amended to, amend the Scope of Services, increase compensation and extend the term by Amendments N- 2002 -113, dated July 1, 2002, and N- 2003 -066, dated July 1, 2003 (hereinafter "Amendments "). C. In accordance with the terms and conditions of said Agreement, the parties wish to amend said Agreement to again extend the term and increase compensation to pay for services during the extended term. Wherefore, in consideration of the covenants contained in said Agreement and Amendments, and subject to all the terms and conditions of said Agreement and Amendments, except those amended in this Third Amendment to Consultant Agreement, the parties agree as follows: 1. Section 2, COMPENSATION, shall be amended to read as follows: "City agrees to pay, and Consultant agrees to accept as total payment for his services, an hourly rate of thirty -seven dollars ($37.00) for all scheduled instructional and counseling services. The total sum to be expended pursuant to said Agreement and Amendments, shall not exceed $10,000.00, annually, during the term of said Agreement." 2. Section 3, TERM, shall be amended to read as follows: "This Agreement shall commence on the July 18, 2000 and terminate on June 30, 2005, unless terminated earlier in accordance with Section 12, below. The term of this Agreement may be extended upon a writing executed by the Chief of Police and the City Attorney."
