DISCUSSION On November 29, 2004, the Orange County Registrar of Voters certified the results of the canvass of the Santa Ana General Election returns. Pursuant to State Elections Code 10263 and 10264, the City Council must adopt a resolution reciting the fact of the election and the results of: (a) the whole number of votes cast in the city, (b) the names of the candidates voted for, and the offices voted for (c) the measure voted upon, (d) the number of votes by precinct, and (e) the number of votes for each candidate and for or against each measure. The accompanying resolution and Exhibit A identify the results of the balloting. By adopting the resolution, the City Council declares elected the following individuals: Miguel A. Pulido, Mayor; Jose Solorio, Council member , Ward 1; Carlos Bustamante, Council member , Ward 3; and, Claudia Alvarez, Council member , Ward 5. Additionally, Measure M, which proposed an increase in the Hotel Visitors' Tax from 9% to 11%, received a majority vote and shall become a valid and binding ordinance of the City. The ordinance change is considered adopted upon the City Council's declaration of the vote, and shall go into effect 10 days following this declaration. FISCAL IMPACT no fiscal associated with this action. 1-1 RESOLUTION NO. 2004-091 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON NOVEMBER 2, 2004 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: E. A. Pursuant to the Charter of the City of Santa Ana, a general municipal election was held in the City of Santa Ana on November 2, 2004, to fill the office of Mayor and offices of members of the City Council nominated from Wards 1, 3, and 5 of the City, and to consider a ballot measure increasing the rate of the Hotel Visitors' Tax. B. That the results of the said election, including the whole number of votes cast in the City, the names of the persons voted for, for what office each person was voted for, and the number of votes given in the City to each person, are set forth in that certain document attached hereto as Exhibit A and incorporated herein by this reference as though fully set forth. C. That, based upon said results, Miguel A. Pulido is declared elected to the office of Mayor of the City of Santa Ana to a two year term. D. That, based upon said results, the following persons are declared elected to the following respective offices, each to a four year term: 1. Jose Solorio, member of the City Council of the City of Santa Ana from Ward 1. 2. Carlos Bustamante, member of the City Council of the City of Santa Ana from Ward 3. 3. Claudia Alvarez, member of the City Council of the City of Santa Ana from Ward 5 That, based upon said results, Measure M Hotel Visitors Tax increase from 9% to 11 % shall be implemented. Section 2. This Resolution shall take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution. 1-2 ADOPTED this day of December, 2004 Miguel A.
