RECOMMENDED ACTION
Adopt a resolution vacating portions of street and a sidewalk easement
along south side of 8 First American Way East.
DISCUSSION
First American Title Company of Santa Ana has requested that the City
vacate a portion of a street easement and a sidewalk and public utility
easement adjacent to the vacant lot at 8 First American Way East
(Exhibit 1). When originally dedicated, the easements were intended to
provide the City with the appropriate right of way at a planned
driveway. However, the driveway was not constructed, and the applicant
has reconfigured the site plan to eliminate the proposed driveway. The
Planning Commission approved the site plan on September 27, 2004.
The easements are not needed for public purposes and have not been used
by the public within the past five years. Private utilities companies,
other government agencies, and City Departments have been contacted and
reviewed this street vacation request as to potential impacts. No
adverse impacts were reported to the Public Works Agency.
There are no City or public owned utilities within the vacated area.
However, a fi ve- foot wide sidewalk and public utility easement behind
new the right-of-way alignment will be reserved. Drainage and traffic
circulation will not be impacted by the vacation.
ENVIRONMENTAL IMPACT
In accordance with the California Environmental Quality Act, the proposed
proj ect is exempt from further review. Categorical Exemption ER No.
2004-223 will be filed for this report.

A RESOLUTION APPROVING THE SUMMARY VACATION
OF A PORTION OF STREET, SIDEWALK AND PUBLIC
UTILITY EASEMENT ADJACENT TO 8 FIRST AMERICAN
WAY EAST
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA
ANA AS FOLLOWS:
Section 1. The City Council of the City of Santa Ana hereby finds,
determines and declares as follows:
A. The City of Santa Ana intends to vacate a portion of the street,
sidewalk and public utility easement adjacent to 8 First American Way
East, in accordance with the provisions of Chapter 3 of Part 3 of
Division 9 of the Streets and Highways Code of the State of California.
The portion to be vacated is 110 feet wide in the front, 64 feet wide in
the back and 27 feet deep adjacent to First American Way, as shown
on the attached Exhibits A and B, which are incorporated herein.
B. The vacation of the portion of the street, sidewalk and public utility
easement of First American Way is a summary vacation because the
area lies within property under one ownership pursuant to the
provisions of section 8334 of the Streets and Highway Code of the
State of California.
C. The portion of street, sidewalk and public utility easement adjacent to 8
First American Way to be vacated is not necessary for traffic
circulation.
D. There are presently no City or publicly owned utilities within the area to
be vacated.
E. A five-foot wide sidewalk and public utility easement behind new the
right-of-way alignment will be reserved, as shown on Exhibits C and D
which are attached hereto and incorporated herein.
F. In accordance with the California Environmental Quality Act, the
proposed project is exempt from further review. Categorical
Exemption Environmental Review No. 2004-223 will be filed for this
report.

Section 2. The City Council of the City of Santa Ana hereby approves
the summary vacation of the section of street, sidewalk and public utility
easement at 8 First American Way, as described herein.
Section 3. The above portion of the street, sidewalk and public utility
easement shall not be deemed vacated until this resolution is recorded.
Section 4. The Clerk of the Council shall attest to and certify the vote
adopting this Resolution.
