THIS AMENDMENT NO.9 is made and entered into this 1:J:L day of ~ C~\ I ~ 7 8 2004, by and between the Orange County Transportation Authority, a public corporation of the State of 9 California (hereinafter referred to as "AUTHORITY"), and City of Santa Ana, a municipal corporation 10 (hereinafter referred to as "AGENCY"). 11 WITNESSETH: 12 WHEREAS, by Agreement No. C-95-990 dated August 18, 1995, as last changed by Amendment NO.8 dated July 27, 2004, AUTHORITY and AGENCY entered into an Agreement which 13 14 determined that AGENCY was eligible to receive funding under the Combined Transportation Funding Programs (CTFP) as specified in the CTFP Manual and also the Bicycle and Pedestrian Facilities 15 16 Program; and 17 WHEREAS, periodic scheduled reviews approved by AUTHORITY and AGENCY may be 18 updated as required; and WHEREAS, both parties have agreed to amend the list of projects set forth in Exhibit A; 19 20 NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and AGENCY as 21 follows: 22 Amend Exhibit A. "Combined Transportation Funding Programs (CTFP) Allocations", to delete 23 the Exhibit in its entirety and in lieu thereof insert the revised "Combined Transportation Funding 24 Programs (CTFP) Allocations", dated June 28, 2004, included in this Amendment as Attachment NO.1 25 which is incorporated into and made a part of the Agreement. 26 I YC:CF L:\CAMM\CL RICAL\CLERICAL\WORDPROC\AGREE\AMEND\AM95990.DQC Page 1 of 2 AMENDMENT NO.9 TO AGREEMENT NO. C-95-990 The balance of Agreement No. C-95-990 remains unchanged.
