THIS AMENDMENT NO.1 is made and entered into this ~ day of -1J('.-6<.~ b -v- , 2004, 6 7 8 by and between the Orange County Transportation Authority ("Authority") and the City of Santa Ana 9 ("City"). 10 WITNESSETH: 11 WHEREAS, by Agreement No. C-2-0896 dated June 24, 2002, Authority and City entered 12 into a cooperative agreement for City and Authority to cooperate to the end that the Centerline Light Rail System planning, engineering, and environmental activities are undertaken and completed 13 14 in ways that meet the mutual; objectives and goals of the parties; and 15 WHEREAS, the Authority desires, and City has agreed, to define the term of this Agreement 16 and to define the allowable overhead billing percentage at no increase in the reimbursable not to 17 exceed amount and; 18 WHEREAS, the Authority desires, and City has agreed, to amend the funding amounts for 19 Public Involvement On-Call Consultant Services; 20 NOW, THEREFORE, it is mutually understood and agreed by Authority and City that 21 Agreement No. C-2-0896 is hereby amended in the following particulars only: 22 1. Amend ARTICLE 3. WORK AUTHORIZATION AND PAYMENTS, paragraph 3.4, 23 Payment of Invoices, page 9, to add the words "Allowable overhead shall be as defined for Local 24 Agency Forces as identified in the Measure M Combined Transportation Fundinq Proqram Manual, 25 Chapter 13, Overhead, at an allowable rate not to exceed 30% of payroll and fringe benefits." 26 / Page 1 of 5 AMENDMENT NO.1 TO AGREEMENT NO. PUBLIC INVOLVEMENT CONSULTING SERVICES 2 GUIDELINES. paragraph 4.1 On-Call List of Public Involvement Consulting Services, 4.2 Responsibilities of the Authority, and 4.4 Mutual Responsibilities pages 9 through 11 to make the 3 4 following changes: a. To add new sub-paragraphs 4.1.3 and 4.1.4 as follows: 5 6 4.1.3 The Authority has entered into Agreements with firms to assist the City by providing 7 public involvement consulting services to meet its needs. The maximum cumulative obligation 8 amount for this effort is a not to exceed amount of $120,000 for Authority's fiscal year 2003/2004. 4.1.4 The Authority has entered into Agreements with firms to assist the City by providing 9 10 public involvement consulting services to meet its needs. The maximum cumulative obligation 11 amount for this effort is a not to exceed amount of $60,000 for Authority's fiscal year 2004/2005. b. To delete in its entirety sub-paragraph 4.2.1 and replace with the following: / 12 13 4.2.1 To fund the full cost of the consultant services, as identified in section 4.1.2, 4.1.3 and 14 4.1.4 above, at a maximum cumulative obligation amount of $120,000 in fiscal year 2002/2003, $120,000 in fiscal year 2003/2004 and $60,000 in fiscal year 2004/2005. / 15 16 c. To delete in its entirety sub-paragraph 4.4.2 and replace with the following: 17 4.4.2 Any notices, requests and demands made between the parties pursuant to Articles 4 and 5 are to be directed in accordance with paragraph 7.2 Notices. 18 19 3. December 22, 2004 METROPOLITAN PLANNING ORGANIZATIONS REGIONAL TRANSPORTATION PLANNING AGENCIES Dear Executive Directors: Subject: Federal Fiscal Year 2003-2004 Regional Surface Transportation Program and Congestion Mitigation and Air Quality Apportionments The Federal Highway Administration (FHW A) released the Federal Fiscal Year (FFY) 2003- 2004 computation tables on December 3, 2004. The computation tables are available on the FHW A web site at: http://www.fhwa.dot.gov/stea04/index.htm. The release of the infonnation enables the California Department of Transportation (Department) to provide actual FFY 2003-2004 apportionment infonnation. Final FFY 2003-2004 apportionments for the Regional Surface Transportation Program (RSTP) and the Congestion Mitigation and Air Quality Program (CMAQ) are attached. These apportionments are made in accordance with Sections l82.6(b) and l82.7(b) of the California Streets and Highways Code, respectively. Regional Surface Transportation Program - Attachment I The final, adjusted, statewide RSTP total, $398,495,697, reflects the following: 0.59% rescission, two percent set aside for State Planning and Research, ten percent deduction for the Transportation Enhancement Program, and ten percent deduction for Safety Programs. The apportionments include the pro-rata distribution of Minimum Guarantee (MG) funds as specified in Title 23 United States Code (USC); Section 1 05( c). The RSTP Large Area portion shown in Attachment 1 must be programmed and obligated in urbanized areas with populations greater than 200,000 as required by Section l33(f) of Title 23 USC, as amended by Section 1108 of the Transportation Equity Act for the 21 st Century (TEA 21). It is important to note that failure to meet this requirement may jeopardize the availability of future Federal funding to these areas. The RSTP totals reflect a pro-rata $500,000 deductiOn for the Cooperative Training Assistance Program (CTAP). Infonnation regarding training courses available through CT AP may be obtained by contacting the Institute of Transportation Studies at (510) 231-9590. The RSTP apportionments comply with Streets and Highways Code 182.6( d), which require RSTP apportionments to equal or exceed 110 percent ofFFY 1990-1991 Federal Aid Secondary (FAS) funding and to equal or exceed FFY 1990-1991 Federal Aid Urban (F AU) funding adjusted by population. Congestion Mitigation and Air Ouality - Attachment II The final adjusted CMAQ total, $436,739,681, reflects a two percent set aside for State Planning and Research and includes the pro-rata distribution of MG. CMAQ apportionments are distributed based on non-attainment area population and pollutant factors. Please review the detail and contact Cathy Gomes at (916) 654-3271 ifthere are any recommended revisions. All CMAQ funded projects must meet program eligibility and reporting requirements. The CMAQ program guidelines are available online at: http://www.fhwa.dotgov/enyironment/cmaqpgs/index.htm. Un-obligated regional balances will be adjusted for these apportionments. The status of un-obligated funding is available on the Caltrans' Local Assistance web site at: http://www.dot.ca.goy/hq/LocaIPrograms/ABI012/abl012.htm.
