RESOLUTION NO. 76-7 RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF SANTA ANA AUTHORIZING EXECUTION OF SECTION 8 HOUSING ASSISTANeE PAYMENTS PRO- GRAM ANNUAL CONTRIBUTIONS CONTRACT PART I FOR EXISTING HOUSING PROGRAM INCLUDING PROJECT NUMBERS CA16-E093-00l AND CA16-E093- 004, PROVIDING FOR THE INCORPORATION OF SAID PART I INTO MASTER SECTION 8 ANNUAL CONTRIBU- TIONS CONTRACT NO. SF-503 AND AUTHORIZING THE CHAIRMAN OF THE HOUSING AUTHORITY TO EXECUTE A LETTER AGREEMENT TERMINATING THAT PART OF SECTION 23 HOUSING ASSISTANCE PAYMENTS PROGRAM ANNUAL CONTRIBUTIQNS CONTRACT NO. SF-492 CONSISTING OF PROJECT NO. CA-093-004 WHEREAS the HOUSING AUTHORITY OF THE CITY OF SANTA ANA (herein called the "Housing Authority") has previously entered into a Master Section 8 Housing Assistance Payments Program Annual Contributions Contract (herein called the "Contract") with the United States Department of Housing and Urban Development (herein called the "Government"), and now proposes to (1) enter into an Annual Contributions Contract Part I for Existing Housing Program including Project Nos. CA16-E093-00l and CA16-E093-004¡ and (2) provide for the incorporation of said Part I into the Master Section 8 Annual Contributions Contract identified hereinbelow¡ and (3) provide for the deposit of monies pursuant to a General Depositary Agreement with. a financial institution which is a member of the Federal Deposit Insurance Corporation (herein called the "Bank")¡ and (4) enter into a Letter Agreement with the Govern- ment Terminating That Part of Section 23 Housing Assistance Payments Program No. SF-492, Consisting of Existing Housing Project No. CA-093-004. NOW, THEREFORE, BE IT RESOLVED BY THE HOUSING AUTHORITY OF THE CITY OF SANTA ANA, AS FOLLOWS: Section 1. The proposed Contract, designated "Section 8 Housing Assistance Payments Program Annual Contributions Contract Part I For Existing Housing Program" including Project Nos. CA16-E093-001 and CAl6-E093-004, pursuant to the United States Housing Act of 1937, as amended, is hereby approved and accepted both as to form and substance, and the Chairman is hereby authorized and directed to execute said Contract in three counterparts on behalf of the Housing Authority and to forward such executed counterparts to the Government together with such other documents evidencing the approval and authorizing the execution thereof as may be required by the Government. Section 2. The Annual Contributions Contract Part I For Existing Housing Program, as approved and accepted in Section 1 hereinabove, is hereby incorporated into Master Section 8 Annual Contributions Contract No. SF-503. Section 3. The Bank of Tokyo and the Housing Authority have pre- v10uslyentered into a General Depositary Agreement, dated March 10, 1975, which provides for the deposit of specified monies of "... one or more additional low-rent housing projects...". The Housing Authority hereby determines that pursuant to the terms of the Agree- ment, the aforesaid Bank shall be the Depositary for the Section 8 Housing Assistance Payments Program and/or Project established under the Contract hereinabove approved. ~\) , " . , , , . ~ . . . . . . 8 ~.. ,. PAGE TWO Section ,4.., The proposed Letter Agreement designated "Letter Agree- ment Terminating That Part of Section 23 Housing Assistance Payments Program Master Annual Contributions Contract No. SF-489 Consisting of Existing Housing Project No. CA-093-004," a copy of which is on file in the office of the Recording Secretary of the Authority, is hereby approved and accepted both as to form and substance and'the Chairman is hereby authorized and directed to execute said Letter Agreement in five counterparts on behalf of the Housing Authority and the Secretary is hereby authorized and directed to impress and attest the official seal of the Housing Authority on each such counterpart and to forward such executed counterparts to the Govern- ment together wi,th such other documents evidencing the approval and authorizing the execution thereof as may be required by the Govern- ment. Section 5. The Chairman is hereby authorized and directed to file with"the Government fromtime-to-time as payments are required, requisitions together with the necessary supporting documents requesting periodic payments to be made on account of the Annual COntributions Contract, and the Chairman of the Housing Authority shall prepare, execute and deliver to the Government said requisi- tions in a form prescribed by the Government and shall accept pay- ment therefor from the Government and such officer is authorized to do and perform all other things and acts required to be done or performed in order to obtain such payments, which shall be deposited and disbursed only in accordance with the provisions of the Annual Contributions Contract.
