Evans in the City Council Chambers, 22 Civic Center Plaza. The following Council members were present: Gordon Bricken, David F. Ortiz, Harry K. Yamamoto, John Garthe, James E. Ward, and Mayor Evans. Councilman David L. Brandt was absent. Also present were the following members of Staff: City Manager Bruce C. Spragg, City Attorney, Keith L. Gow, Assistant City Manager Ronald Wolford, Director of Public Works John E. Stevens, Planning Director Charles C. Zimmerman, and Clerk of the Council Florence I. Malone. The motion of Councilman Ward, seconded by Councilman Bricken to refer the Ordinance to the City Attorney for modification, also failed to carry, with Councilmen Yamamoto, Ortiz, and Mayor Evans voting NO. CA 99 SCAG ADVISORY COMMITTEE A letter dated April 5, 1977 REQUEST - APPROVED from Southern California Association of Governments President, Dennis Hans- berger, requested elected officials to volunteer for committee assignments for the Association. Councilman Brandt's willing- ness to serve on the Transportation and Utilities Committee and Councilman Yamamoto's continued interest in serving on the Human Services Committee were endorsed by Council on the motion of Councilman Ward, seconded by Councilman Garthe, and carried 6:0 unanimously. CA 80.1 CA 141 USE OF SENIOR CENTER FOR AUCTION A letter of request dated BY FEEDBACK FOUNDATION April 6, 1977 for the use APPROVED; USE OF LIQUOR DENIED of the Senior Center in Birch Park for a fund rais- ing art auction for the Feedback Foundation, Inc., on May 22, 1977 was approved on the motion of Councilman Yamamoto, seconded by Councilman Ward, and carried 5:1, with Councilman Bricken dissenting. Contained in the motion was the denial of the request to sell beer and wine in connection with the auction based on the Municipal Code Section 31-1(23) prohibition of such activity in City parks. A discussion of the matter was followed by a motion by Councilman Ward, seconded by Councilman Bricken to direct Staff to prepare a report and recommendation regard- ing use of beer and wine at City facilities; the motion failed 2:4, with Councilmen Garthe, Ortiz, Yamamoto and Mayor Evans dissenting. CA 45.1 CITY COUNCIL MINUTES 130 APRIL 18, 1977 REFUSE COLLECTION CONTRACT On the motion of Council- STATUS REPORT & DRAFT REQUEST man Ortiz, seconded by FOR PROPOSAL - CONTINUED Councilman Bricken, the Status Report regarding Refuse Collection Contract, and the draft Request for Proposal for Consultant Services, were continued to May 2, 1977 by unanimous 6:0 vote. CA 11.1 A-76-42 INCREASE IN LOCAL The .Clerk of the Council DRAINAGE AREA FEES was directed to set a PUBLIC HEARING ORDERED public hearing for the consideration of a 13% increase in local drainage area fees needed because of increased construction costs, on the unanimously carried 6:0 motion of Councilman Ward, seconded by Councilman Garthe. (The public hearing was subsequently set for April 26, 1977 at 5:00 P.M. ) CA 70 APPLICATION FOR FUNDING The submission of an SOUTHERN PACIFIC BIKE TRAIL application to Orange RATIFIED County for second year funding of the Southern Pacific Bike Trail between Bristol Street and Warner Avenue for fiscal year 1977-78 (SB 821) by Staff on March 4, 1977 was ratified on the unanimously approved 6:0 motion of Council- man Ward, seconded by Councilman Bricken. CA 18.6 USE OF TITLE II EDA FUNDS The $50,000 available REPAIRS TO POLICE BUILDING under Title II of the APPROVED Public Works-Employment Act of 1976 was auth- orized for use to repair and modify the first floor of the Police Department building (Project P-2), changing the scope of the project from remodeling to repairs, as described in a report dated April 12, 1977 prepared by Captain J. L. Dittman, on the motion of Councilman Ward, seconded by Councilman Yamamoto, and carried 6:0 unanimously. CA 140.30 CA 47 APPROPRIATION ADJUSTMENT 193 On the unanimously 6:0 CETA TITLE III SUMMER YOUTH PROGRAM approved motion of Coun- APPROVED WITH MODIFICATION cilman Ward, seconded by Councilman Garthe, the following action was authorized as recommended by Keith E. Blunt, Manpower Project Coordinator, in his April 5, 1977 report, with a $12,022 increase in the City's allocation, and a $12,022 decrease in the County allocation for summer youth: l) Authorized the City Manager to apply for $512,022 of CETA Title III funds to serve approximately 750 youth with a 1977 Summer Youth Program; 2) Authorized the allocation of $1S3,398 CETA Title III funds to the County of Orange to serve Santa Aha youth in County departments; and 3) Approved Appropriation Adjustment activity account in the amount of Youth Program. #193 establishing the $512,022 for the Summer CA 65.3 CA 131.11 CA 140.3 CITY COUNCIL MINUTES 131 APRIL 18, 1977 APPROPRIATION ADJUSTMENT 95 Appropriation Adjustment BUS PASSENGER SHELTERS #95 transferring $55,000 APPROVED from Orange County Transit District Revenue Account to Local Streets account for installation of bus passenger shelters was approved on the motion of Councilman Ward, seconded by Councilman Garthe, and carried 5:1, with Councilman Ortiz dissenting. CA 65.3 CA 84 ORAL COMMUNICATION Mr. Miles Leach, 2025 WATER CONSERVATION METHODS West Tenth Street, sug- gested that the Water Conservation booklet mailed to residents of Santa Ana should have advised customers to have the water level mechanism adjusted in toilet tanks rather than to advise the placement of a plastic bottle in the tank. He stated his opinion that the plastic bottle could move and keep the water running. CA 12 ORAL COMMUNICATION Fire Chief B. J. Thompson PARAMEDIC SERVICE REPORT reported that Santa Aha Tustin Community Hospital hopes to have sufficient personnel for the operation of the third paramedic van by May 1S, 1977; that a driver, an EMT I and two paramedics will be on duty. Chief Thompson also reported that the Fire Depart- ment's paramedic truck company had been in service since the seventh day of March, and had made 191 emergency medical responses, averaging six per day, or 180 calls per month; and that the Department has seven student paramedics progressing exceptionally well in the training program. CA 64.2 ORAL COMMUNICATION On the unanimously WEST BRANCH LIBRARY GROUNDBREAKING approved 6:0 motion of MAYOR PRO TBM APPOINTED Councilman Ward, seconded by Councilman Garthe, Councilman Harry K. Yamamoto was appointed Mayor Pro Tem to officiate at the groundbreaking for the West Branch Library to be held Monday, April 25, 1977. CA 80 EXECUTIVE SESSION At 3:15 P.M. the meeting LEGAL MATTERS was recessed for an RECESS Executive Session to consider legal matters. At 4:15 P.M. the meeting reconvened and immediately recessed for dinner; at 7:30 P.M. the meeting reconvened with Council- men Bricken and Brandt absent. CA 56.1 CITY COUNCIL MINUTES 132 APRIL 18, 1977 SPECIAL TRIBUTE Vice Mayor Ward made the HUMAN RELATIONS COMMISSION presentations of City CITY SEAL TILES PRESENTED Seal tiles to each of the former members of the Santa Ana Human Relations Commission in appreciation for their outstanding service to the City; those receiving the awards were Manuel Barron, Arturo B. Castro, Mildred M. Cobb, Zeke Hernandez, Jacque Johnson, James Kelly, Rudy Moreno, Helen Stanley, and Roy Uno; Rudy Francis was not present at the meet- ing. Vice Mayor Ward cited examples of the fine work of the Commission, including work in the Logan Area, and on the City's Affirmative Action Program; he stated that with the foundation formed by the past Commission he hoped the new Commission would go forward to new and'greater challenges to create a better, more harmonious City for our citizens. CA 131.2 PROCLAMATION PRESENTATION Councilman Ortiz presented "BARBERSHOP HARMONY MONTH" the Mayor's Proclamation designating April as "Barbershop Harmony Month" to Phil Ridout, President of the Golden City Chorus; the Coun- cilman said that in these days of gloom, it is a pleasure to forget one's problems by enjoying fine barbershop harmony. Mr. Ridout accepted the Proclamation, and invited the audience to attend the annual Chapter Show at Santa Ana High School at 8:00 P.M. on May 22. The Chorus followed the presentation with a medley of some of its many musical selections. CA 46 ORAL COMMUNICATIONS A letter read to the VARIANCE 76-57 BAKER SQUARE Council by Rowena Macias, REFERRED 1243 West Sixth Street, which questions the proce- dures used by the City Council in considering and granting Variance Application 76-57 approving the Baker Square Develop- ment was referred to the City Attorney for investigation and report to Council at the May 2, 1977 meeting, on the motion of Councilman Ward, seconded by Councilman Garthe and unanimously 5:0 carried. Ed Schmidt, 1402 West Seventh, also suggested that the City has made excessive use of the variance procedure resulting in the circumvention of the General Plan and zoning laws of the City and the State. CA 13.3a ORAL COMMUNICATION Wes VanderPool of 931 West USE OF EL SALVADOR PARK Washington, voiced strong objection to the rock concert at E1 Salvador Park on Easter Sunday, April 10, 1977; he stated that the event lasted for six hours and that it was very loud; he suggested that such activities might be held in the Municipal Stadium with less disturbance to the neighborhood. City Manager Bruce Spragg stated that the City was not informed in advance that there would be amplification of the music. Councilman Yamamoto's motion to direct Staff to prepare a report for Council outlining what could be done legally to curtail such noise pollution failed for lack of a second. Roy Uno, Human Relations Commissioner, stated that he had been present at the concert with Police Lieutenant Weatherly primarily to assist in diverting any possible altercations among the participants; that he did not feel the noise was excessive; and that he felt the Police Department did an excellent job of monitoring the event.
