HomeMy WebLinkAbout09-19-1977MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA September 19, 1977 Vice Mayor James E. Ward called the meeting to order at 2:00 P.M., in the City Council Chambers, 22 Civic Center Plaza. Members of Council present were: Gordon Bricken, Harry K. Yamamoto, David F. Ortiz, John Garthe, and Vice Mayor Ward. Councilman David L. Brandt and Mayor Evans were absent. Also present were the following members of Staff: City Manager Bruce C. Spragg, City Attorney Keith L. Gow, Assistant City Manager Ronald Wolford, Planning Director Charles C. Zimmerman, Community Redevelopment Director Richard Goblirsch and Clerk of the Council Florence I. Malone. PLEDGE OF ALLEGIANCE INVOCATION Councilman Gordon Bricken gave the Invocation, follow- ing the Pledge of Allegiance to the Flag. AGENDA ORDER Agenda Item #45 was taken NO-FAULT AUTOMOBILE INSURANCE out of order in order to AUTHORIZED SUPPORT OF NATIONAL SYTEM allow Long Beach Councilman Ernie Kell an opportunity to make a presentation. On the motion of Councilman Bricken, seconded by Councilman Yamamoto and carried 4:1 with Councilman Ortiz dissenting, the City of Santa Ana will recommend to the League of California Cities that it adopt a Resolution supporting a National No-Fault Vehicle Liability System as described in Resolution No. 22360 adopted by the City of Long Beach. The motion followed apresentation by Long Beach Councilman Ernie Kell in which he outlined the statistics showing that a 10% drop in premiums would result from such a program; he also stated that it would eliminate a vast number of lawsuits and increase the percentage of the premium returned to policyholders in benefits. CA 57.1 CONSENT CALENDAR Councilman Bricken requested ITEMS REMOVED & removal of Items 2 B and DISSENTING VOTES 12 F from the Consent Calendar; Councilman Ortiz requested removal of Item 5 F. Councilman Bricken registered a NO vote on Items 4 A, B, C and D. CA 80.9 CA 29.10A CITY COUNCIL MINUTES 342 SEPTEMBER 19, 1977 The City Manager advised that Mayor Evans had scheduled meetings with the Chairmen and Vice Chairmen of the various Boards and Commissions and that he would be discussing the Council's relationship to the advisory groups and their responsibilities and duties in order to formulate future policy. CA 29.10a CA 80.9 LEAGUE OF CALIFORNIA CITIES REQUEST FOR UPDATE OF GUIDELINES FOR ORANGE COUNTY HUMAN RELATIONS COMMISSION DELEGATE AUTHORIZED TO SUPPORT The City's voting delegate to the Orange County Division, League of California Cities, was authorized to support the recommendation of the Ad Hoc Committee on the Orange County Human Relations Commission to request a review and update of guidelines of the Commission by the Orange County Board of Supervisors, on the motion of Councilman Ortiz, seconded by Councilman Ward and carried 5:0 unanimously. CA 85.3 NEWPORT-IRVINE WASTE-MANAGEMENT A letter dated September 13 PLANNING AGENCY MEMBERSHIP 1977, from L. E. Eberling, REFERRED TO STAFF Chairman of the Board of Directors of the Newport- Irvine Waste-Management Planning Agency, requesting consideration of rejoining NIWA was referred to Staff for reassessment and recommendation, on the motion of Councilman Ortiz, seconded by Councilman Ward and carried 5:0 unanimously. Nancy Shannahan, Counsel for NIWA and Ken Smith, the 208 Plan Project Director, were present at the meeting and Mrs. Shannahan stated that they would like to work with the City Staff in any way possible to better understand Santa Ana's problems and to enable Santa Ana to better understand the purposes and the bene- fits of NIWA. CA 145.12 PUBLIC CONVENIENCE AND NECESSITY REQUIREMENT FOR EMERGENCY AMBULANCE SERVICE - Council Referral Item No. 5-77 CODE AMENDMENT REQUESTED; REFERRAL DELETED An emergency ambulance service policy, recommended by Fire Chief B. J. Thompson, in his report dated September 12, 1977, to continue the requirement that public convenience and necessity be shown before a company is allowed to operate an emergency ambulance service within the City, but without limiting the number of ambulances permitted by each company, was approved, the City Attorney directed to prepare an amendment to the Municipal Code Chapter 38 and Council Referral Item No. 5-77 deleted, on the motion of Councilman Ortiz, seconded by Councilman Ward and carried 5:0 unanimously. Fire Chief B. J. Thompson was present to answer Council questions and also recommended that there be two separate ordinances for ambulance service and taxicab service in the City. CA 96 CITY COUNCIL MINUTES 343 SEPTEMBER 19, 1977 REVISION OF TAXICAB ORDINANCE TO REMOVE REQUIREMENT FOR CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR TAXICABS - Council Referral Item No. 50-76 CODE AMENDMENT REQUESTED The recommendation in a report dated May 25, 1977, prepared by Lieutenant C. R. Miller, to delete the requirement for public convenience and necessity for taxicab service, while maintaining procedural and protective safety standards by the Police Department, was approved, the City Attorney directed to prepare an amendment to the Municipal Code Chapter 38, and Council Referral Item No. 50-76 deleted, on the motion of Councilman Ortiz, seconded by Councilman Bricken and carried 4:1 with Councilman Yamamoto dissenting. Police Chief Raymond Davis stated that the proposed amendment would allow free competition without impairing proper licensing and regulation; that a minimum of eight vehicles would be necessary to apply for a license and that all drivers must meet the municipal and state regulations. CA 52 CA 45.1 CITY COUNCIL MINUTES 344 SEPTEMBER 19, 1977 POLICE FACILITY SPACE NEEDS Based on an oral report PLANNING CITIZENS' ADVISORY by Police Chief Raymond COMMITTEE AUTHORIZED Davis and Captain J. L. Dittman, and a report dated September 14, 1977, prepared by Captain Dittman, formation of Citizens' Advisory Committee (including members of the existing ad hoc Committee) was authorized to recommend to Council its judgment of the police facility space needs, a suitable site for a new facility, a design philosophy, and possible funding sources, on the motion of Councilman Garthe, seconded by Councilman Ortiz and carried 5:0 unanimously. Councilmen informally agreed to appoint a Councilman as Chairman at the next Council Meeting. Councilmen expressed the desire that the Advisory Committee would explore and develop the alternatives to the construction of a new facility for the Police Department. CA 78.6 ORAL COMMUNICATIONS BOARD & COMMISSION APPOINTMENTS COMMITTEE RECOMMENDATIONS appointed to the Library Board to Jack Larson ending June 30, 1978, On the motion of Councilman Bricken, seconded by Council- man Ward, carried 5:0 unani- mously, Irma Gutierrez was complete the term vacated by subject to confirmation at the next Council meeting. Manuel Barron was recommended for re- appointment for a new term ending August 1, 1981 on the Human Relations Commission, subject to confirmation, on the motion of Councilman Bricken, seconded by Councilman Garthe and carried 5:0 unanimously. Councilman Ortiz reminded Council that there is no representative on the Human Relations Commission from Ward 6 and that he would have a recommendation for that seat for con- sideration prior to confirmation of Mr. Barron. CITY COUNCIL MINUTES 345 SEPTEMBER 19, 1977 PLEDGE OF ALLEGIANCE INVOCATION Newhope Assembly of God Church. Following the Pledge of Allegiance, the Invocation was given by Reverend J. Timothy Lake of the CA 80.17 MEDALLION PRESENTATION FOR Fire Chief B. J. Thompson, HEROISM TO RICARDO CASTRO joined Councilman David Ortiz in the presentation of a Fire Department Bronze Medallion to Ricardo Castro for heroism in saving the life of an infant. Chief Thompson related the events that occured. He stated that Mr. Castro acted swiftly to use the life saving mouth-to-mouth resuscitation technique learned in the Regional Occupational Program classes sponsored by the Fire Department. Mr. Castro's name has also been inscribed on the radio station KWIZ Kool Head Award for exemplary action in an emergency situation. CA 73B UNFINISHED BUSINESS Council instructed staff TRAFFIC SIGNAL AT BRISTOL AND WILLITS to schedule a public hearing PUBLIC HEARING AUTHORIZED to consider a plan for right turn diverters on Bristol Street between Richland and Chestnut when the results of a neighborhood public opinion survey regarding the acceptability of the plan are obtained and to recommend funding sources to implement the plan as soon as possible at the time the public hearing is held, on the unanimously carried motion 6:0 of Councilman Ortiz, seconded by Councilman Yamamoto. Traffic Engineer Joe Foust referring to his written report dated September 13, 1977, stated that he began a comprehensive study of the conditions at the intersection of Bristol and Willits to see if nationally accepted minimum warrants could be met for traffic signal installation; that the warrants must be met before Federal or State funding could be requested; that the Staff has been monitoring this intersection for a number of years; that it still meets only 85% of the minimum warrants; that it is half way between two major arterials; and that if a right-turn diverter plan developed by Staff were acceptable to the residents, the average daily traffic at the intersection would be increased sufficiently to meet the criteria for a signal installation; that the right turn diversion plan would tend to reduce the rear-end type accidents occurring at the location; and that with the installation of the Bristol Street Plan, the intersection of Bristol and Willits would place high on next year's priority list for funding. ORAL COMMUNICATION;~ EXCESSIVE NOISE AT POST OFFICE AT SANTA CLARA AND GRAND DIRECTED STAFF TO ASSIST John P. Cantrall, 1239 West Bishop, thanked Council for its action. CA 18.3 Staff was directed to work with Wayne Miller, 1401 East Avalon, and Clayton Bakke, Postmaster, to recommend to Council a solution to the neighborhood noise problem generated by the activity at the post office facility at Santa Clara and Grand, on motion of Councilman Yamamoto, seconded by Councilman Ortiz and carried 6:0 unanimously. CITY COUNCIL MINUTES 346 SEPTEMBER 19, 1977 Wayne Miller, 1401 East Avalon, stated that he first registered a formal complaint concerning noise at the post office in August, 1972; that in 1974, following many complaints, there was an effort to reduce noise and it was reduced about 80%; and just this past week, it had been reduced another 25%; that the Post Office is in the Federal jurisdiction, but that it is located on leased property; and that peace and quiet of over 50 resi- dents are being distrubed by the nighttime operations of the Post Office. Clayton Bakke, Postmaster, explained that most of the mail .for Orange County is distributed from the Post Office facility at Grand and Santa Clara; that he is very concerned about any com- plaint about noise; that approximately 61 trucks arrive or· leave the facility during the course of a day and most of the processing is done at night; that several steps have been taken over the years to reduce the noise: 1) eliminated the public address system for messages; 2) discontinued piped-in music to the back room and dock; 3) installed dock levelers which are placed in the vehicles; 4) have monitored employees by making periodic checks to be sure that management and employees are complying in re- reduction of all unnecessary noise; 5) had engineering studies made to investigate and suggest solutions that could further reduce the noise, keeping in mind that nobody wants to be a better neighbor than the Post Office does and; 6) designated noise reduction as a day-to-day high priority item. Hector Godinez, former Postmaster, stated that he felt there were special circumstances involved in this matter and that the Planning Commission saw fit to allow residences to be built adjacent to a Post Office that has a 24-hour operation. On the motion of Councilman Garthe, seconded by Councilman Bricken and carried 6:0 unanimously, the petition, record of complaints made by telephone and copies of letters of complaint, were re- cevied and filed. CA 145.4 ORAL COMMUNICATION On the motion of Councilman SIDEWALK CONSTRUCTION & MAINTENANCE Bricken, seconded by Council- POLICY man Yamamoto, carried 6:0 REFERRED FOR REPORT unanimously, Staff was directed to prepare a report for Council on current City policy for new sidewalks and reconstruction and repair of sidewalks. Councilman Bricken stated that he felt that the present policy may not be in the best interests of the Community and he would like to have an opportunity to debate the matter.
