Evans called the meeting to order at 2:06 P.M. in the City Council Chambers, 22 Civic Center Plaza. Members of the Council present were: Gordon Bricken, David F. Ortiz, Harry K. Yamamoto, John Garthe, David L. Brandt, James E. Ward and Mayor Evans. Also present were the following members of the Staff: City Manager Bruce C. Spragg, City Attorney Keith L. Gow, Assistant City Manager Ronald Wolford, Director of Public Works John E. Stevens, Senior Planner William Daugherty and Clerk of the Council Florence I. Malone. John DiFiori, 1700 West McFadden, stated that he had been the operator of Elite Massage for the past seven years; that he had made arrangements for the sale of his business; that he had discussed the matter with the City Attorney and been advised that he interpreted the moratorium as prohibiting the issuance of a business license to a new operator, which would preclude the successful sale of his business; and that he would like Council to amend the moratorium ordinance to allow him to close the proposed sale of his massage business. CA 131.11 CA 131 CITY SPACE NEEDS - SPEC 77-069 On a 4:3 vote, the motion REFERRAL ITEM 9-77 - ADVERTISEMENT of Councilman Ward, FOR BIDS AUTHORIZED seconded by Councilman Ortiz, dissented to by Councilmen Garthe and Bricken and Mayor Evans, to authorize advertisement for bids for 4,000 square feet of office space for the Manpower and Housing Divisions of the Community Rela- tions Department (SPEC 77-069), and to delete Council Referral Item No. 9-77 from the Summary, carried. The Staff report prepared by Dennis Yata dated September 21, 1977 stated that because of the 33.4% increase in Police Depart- ment personnel during the past three years, additional space is needed; the space made available by moving the Community Rela- tions Divisions will be utilized for expansion of Police Depart- ment offices. CA 77 CA 89 PROJECT 8118 - A.A. #25 Appropriation Adjustment HANDICAPPED ACCESS RAMPS #25 transferring $2,500 APPROVED from the City Council Revenue Sharing Unapplied Appropriations to Project 8118 for minor construction changes required during the course of the work on the handicapped access ramps was approved on the motion of Councilman Garthe, seconded by Councilman Brandt, and carried unanimously 7:0. CA 65.3 CITY COUNCIL MINUTES 358 OCTOBER 3, 1977 PROJECT 7108 - A.A. #26 On the motion of Council- HANDICAPPED ACCESS man Ward, seconded by APPROVED; REFERRAL 11-77 DELETED Councilman Yamamoto, carried 6:1, with Council- man Bricken dissenting, Appropriation Adjustment #26 transferring $3,000 from Council Contingency to Project 7108 for modifications to City buildings to allow wheelchair access to restroom facili- ties was approved, and Council Referral Item No. 11-77 deleted from the Summary. CA 65.3 CA 77 NEIGHBORHOOD REHABILITATION Deputy City Manager SERVICE PROGRAM Manuel Rede introduced APPLICATION AUTHORIZED Lydia Bundy, Local Coordinator for the Urban Investment Task Force. Mrs. Bundy described the program as she presented a series of slides of successful neighborhood rehabilitation projects. Mrs. Bundy stated that the purpose of the program is to improve homes and the quality of life for residents of the neighborhood selected, and to establish the area as a healthy real estate market; that 38 projects were in operation throughout the United States, and 20 are in the process of development; and that the neighborhood selection process is completely open after the City has agreed to support the program and fund the developmental cost. Mrs. Bundy stated that projects had been started in Inglewood, La Habra and Pasadena; that 23 - 25 lenders, commercial banks and savings and loan institutions in California, had incorporated into a foundation to support the operating budgets as well as make loans in the area; that nine programs are scheduled for California during the next three years; and she encouraged the City to make a formal application. On the motion of Councilman Ward, seconded by Councilman Bricken, Staff was directed to submit an application for a Neighborhood Housing Rehabilitation Services program and to provide information on a similar program developed by Mayor Weidener of the City of Berkeley. CA 140.40 LOGAN AREA PROPOSALS The Implementation Plan IMPLEMENTATION PLAN APPROVED and Time Frame Performance Schedule prepared by the Planning Department and submitted in a-report dated September 15, 1977 was approved, and the Staff directed to negotiate for consultant services to prepare the Environmental Impact Report, to implement the Logan Area proposal, on the motion of Councilman Bricken, seconded by Councilman Yamamoto, and carried 7:0 unanimously. The Logan Area proposal encompasses a General Plan amendment, zone changes and revised Specific Plan for Street Alignment for Civic Center Drive East. Councilman Ward requested the record to show that the Council is in a flexible condition where many things may have to be modified during the process of implementation. Councilman Bricken recommended that the Task Force be continued in operation where necessary with Deputy City Manager David Tayco responsible for conducting the meetings. Mr. Bob Noble, a member of the Logan Task Force, 1518 North Lincoln, referring to comments during the Logan discussion regarding the possibility of legal difficulties with some of the "Contingencies" agreed to by members of the Logan Task Force, requested further explanation of the legal problems. Mayor Er&ns suggested that he meet with City Attorney Keith Cow for that information. CA 78.6 CITY COUNCIL MINUTES 359 OCTOBER 3, 1977 RECESS At 3:30 P.M. the meeting EXECUTIVE SESSION was recessed for an Executive Session to discuss pending litiga- tion; at 4:10 P.M. the meeting was reconvened and immediately recessed to 608 North Main Street, Center for Tomorrow's Com- munities, for a Ribbon Cutting ceremony to begin the City's Housing Rehabilitation Program; and subsequently the meeting was recessed for dinner. The evening session of the Council meeting was reconvened at 7:30 P.M. with Councilman Ortiz absent. PLEDGE OF ALLEGIANCE The Invocation was given INVOCATION by Thomas L. Thorkelson, Church of Jesus Christ of Latter Day Saints, following the Pledge of Allegiance to the Flag. Bishop Thor- kelson stated that, "No success in life can compensate for failure in the home", and he presented a copy of the booklet "Family Home Evening" to each Councilman. CA 80.17 PUBLIC HEARING CUP 77-23 Mayor Evans announced that 2801 W. BROOK ST. this was the time and place APPROVED for the public hearing of Negative Declaration and Conditional Use Permit 77-23 to allow a home for five men- tally retarded women at 2801 West Brook Street in the Ri District, set for public hearing on motion of the City Council on Septem- ber 19. William Daugherty, Senior Planner, stated that the applicant will provide 24-hour care for five mentally retarded women; that the surrounding development is single family residential; that the General Plan indicates low density residential; that in the area bounded by Fairview, the Santa Ana River, 1st Street and McFadden, there are four facilities of a community care nature serving 17 persons, which would not constitute overcon- centration; that at the Planning Commission hearing four persons spoke in favor of the permit, and there was no opposition; and that the Planning Commission recommended the approval of the application following public hearing on August 22, 1977. Speakers in favor of the Conditional Use Permit were: Ken Brandt, Regional Center of Orange County, $00 S. Main, Orange Father Stuart Campbell, Immaculate Heart, 1100 S. Center Patrick Avlicino, 202 Fashion Lane, #217, Tustin Violet Archer, 921 S. Huron Drive Joanne Gordon, 2047 South Rene Drive James I. Gordon, Teacher in Santa Aha, 2047 S. Rene Dr. The speakers were generally very supportive of Mrs. Millard and her home; they stated that she provided a very clean, neat and also very loving home for the residents; and that there was no objection from residents to her relocating in the neighborhood. Mayor Evans asked if there were any further speakers; there being none, he closed the public hearing. On the motion of Councilman Brandt, seconded by Councilman Garthe, and carried 4:2, with Mayor Evans and Councilman Ward dissenting, the Negative Declaration was approved and filed, and the City Attorney was instructed to prepare a resolution approving Condi- tional Use Permit 77-25 and affirming the approval of the Planning Commission. CA 13.4a CITY COUNCIL MINUTES 360 OCTOBER 3, 1977 PUBLIC HEARING - APPEAL 382 Mayor Evans announced MINOR EX 77-25 - 2530 W. CENTRAL that this was the time CONTINUED TO OCT. 17 and place for the public hearing of Notice of Exemption and Appeal #382 of the denial of Minor Exception 77-2S to allow a 12-foot high chain link fence for a recrea- tional court in the rear yard of the residence at 2S30 West Central Avenue in the R1-PRD District. Senior Planner William Daugherty stated that the minor excep- tion would allow a fence to remain that is in excess of the six foot height permitted in a rear yard setback; that the fence is in conjunction with a basketball court; that there are two lights for evening activities; that the application was filed due to a complaint which had been received by a property owner south and west of the subject property at 2530 Central Avenue; that the General Plan indicates low density residential for the area; and that the application was denied by the Zoning Admin- istrator on September 9, 1977. The applicant, John Devers, stated that he had not completed the planned landscaping which would improve his yard a great deal; that the fence was constructed to prevent the balls from going into other yards; that three neighbors had given their verbal approval; and that he had not applied for a minor ex- ception because he had expected the contractor to take care of that matter for him. There being no further speakers, the Mayor closed the public hearing. Councilman Brandt moved to grant Appeal #382 of the denial of Minor Exception 77-25 which was seconded by Councilman Ward. Following Council discussion a motion to amend the motion to require certain landscaping and the redirection of the lighting was made by Councilman Ward, seconded by Councilman Bricken and carried 5:1, with Councilman Yamamoto dissenting. The subsequent vote on the main motion to grant Appeal #382 of the denial of Minor Exception 77-25 failed to carry on a 3:3 tie vote, with Councilmen Garthe, Yamamoto and Mayor Evans dissenting. A motion to continue the matter to October 17, 1977, made by Councilman Ward, seconded by Councilman Bricken, carried 6:0 unanimously. The continuance would allow Councilman Ortiz to listen to the taped hearing and participate in the vote. CA 13.5 PUBLIC HEARING - PARKING Mayor Evans announced RESTRICTION ON WASHINGTON AVE. that this was the time RESOLUTION REQUESTED and place for the public hearing of the removal of parking on Washington Avenue between Main and Lincoln Streets, which had been set by the City Council on September 6, 1977. Director of Public Works John Stevens, referring to a report prepared by Joe Foust, Traffic Engineer, dated August 30, 1977, stated that the parking res%rictions recommended were developed, through the discussions of the Logan Community Task Force, to satisfy traffic circulation in and around the area; that Washington Avenue is a 33-foot wide street which serves as a collector-type arterial; that the traffic volume is 5,800 vehicles per day; and that although the volume is not high, the narrowness of the street presents a difficult driving situation, particularly with parking on both sides. CITY COUNCIL MINUTES 361 OCTOBER 3, 1977 Those speaking in favor of the removal of parking, as proposed, on Washington Avenue between Main and Lincoln Streets were: Mike Andrade, 1042 North Logan Robert Noble, 1318 North Lincoln Avenue Both speakers were on the Logan Task Force and advocated the parking restriction. Those speaking in opposition were: Sam S. Retman, 826 E. Washington, Santa Ana Salvage James Sewell, 2402 Santiago Avenue (1007 E. Washington business) Howard Faccou, 1038 Custer St. (owner 826 E. Washington, Santa Aha Auto Salvage) The opposing speakers own or operate businesses on Washington, and stated that the restriction of parking during business hours would be a great inconvenience to their customers. There being no further speakers, the Mayor closed the public hearing. The City Attorney was instructed to prepare a resolution to remove parking on the north& south sides of Washington Avenue between Main and Santiago Streets, effective upon adoption of the resolution, and to remove parking on the north side only, of Washington Avenue between Santiago and Lincoln, effective after a period of 180 days, during which time Staff was instructed to notify those persons affected by the parking removal and to provide them all possible assistance in secur- ing necessary alternative parking, on the motion of Councilman Bricken, seconded by Councilman Garthe, carried 6:0 unanimously. A prior motion made by Councilman Brandt, seconded by Council- man Ward, to continue the matter to October 17, 1977 to allow Staff time to provide the Council with additional information, failed on a 3:3 vote, with Councilmen Yamamoto, Bricken and Mayor Evans dissenting. A further motion first made by Councilman Bricken, seconded by Councilman Ward to remove parking as recommended with the exception of the south side of Washington between Santiago and Custer, also failed on a 3:3 vote, with Councilmen Ward, Brandt and Garthe dissenting. CA 18 PUBLIC HEARING - CONDEMNATION On the motion of Coun- 4505 W. 1ST ST. cilman Brandt, seconded CONTINUED TO NOV. 7 by Councilman Garthe, carried 6:0 unanimously, the hearing to determine public interest and necessity for condemnation of real property at 4505 West First Street for a parking lot for the Newhope Branch Library was continued to November 7, 1977 to allow for continued negotiations with the property owner and other interested parties. CA 71 PUBLIC HEARING - AMENDMENT On the recommendation APPLICATION 769 902 N. GRAND of the Staff and the CONTINUED TO OCT. 17 motion of Councilman Garthe, seconded by Councilman Brandt, carried 6:0 unanimously, the public hearing of Negative Declaration and Amendment Application 769 to rezone property located at 902 North Grand Avenue (northwest corner of Grand Avenue and Fruit Street) from the R3 District to the SD-10 (Specific Development) District was continued to October 17, 1977. Mayor Evans called for a recess of the meeting; at 9:15 P.M. the PUBLIC HEARING - AMENDMENT Mayor Evans announced APPLICATION ??0 - STH STREET that this was the time ORDINANCE NO. NS-1383 - ADOPTED and place for the public hearing of Negative Declaration and Amendment Application 770 to rezone property located on the south side of Fifth Street between Euclid Street and the Orange County Flood Control District Channel from the A1 District to the R2-PRD District. Senior Planner William Daugherty stated that the total area of the subject property is 5.7 acres and has 414 feet of front- age along Fifth Street; that there are presently four duplexes on the property, but that the applicant proposes to demolish all existing structures and construct a 68-unit condominium complex on the property; that the general area is planned for medium density residential; and that the Planning Commission, following a public hearing on August 22, unanimously recommended approval of the proposed zone change. James Whitmore of Whitmore Homes, Inc. said he would be avail- able to answer any questions on the project. There being no further speakers, the public hearing was closed by Mayor Evans. On the unanimously carried 6:0 motion of Councilman Yamamoto, seconded by Councilman Bricken, the Negative Declaration was approved and filed, and the following ordinance received second readi~ng and was adopted: ORDINANCE NO. NS-1383 - AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. 770 TO REZONE PROPERTY LOCATED AT 4910 WEST FIFTH STREET FROM THE A1 (GENERAL AGRICULTURE) DISTRICT TO THE R2-PRD (MULTIPLE FAMILY RESIDENCE) DISTRICT AND AMENDING SECTIONAL DISTRICT MAP NO. 9-5-10. CA 10 PUBLIC HEARING - AMENDMENT Mayor Evans announced APPLICATION 771 - WARNER & GRAND that this was the time ORDINANCE NO. NS-1387 1ST READING and place for the public hearing of Negative Declaration and Amendment Application ??1 to rezone property located at the southwest corner of Warner and Grand Avenues from the A1 District to the Mi District. William Daugherty, Senior Planner, stated that the total area of the subject property to be rezoned is 9.32 acres; that the total area owned by Southern California Edison Company is approximately 30 acres with 850 feet of frontage on Warner Avenue and 1,500 feet of frontage on Grand Avenue; that the utility company plans to construct a substation on the subject site to serve the 2S-square-mile surrounding industrial and residential areas; that the construction of a substation is a permitted use on property zoned Mi; and that after considera- tion of these facts, it was determined that a Negative Declara- tion could be issued. Renner, Engineer for Southern California Edison, described the planned project as a low-profile trans- mission station, and stated that the highest rack would be 32 feet; that there will be two buildings, for the communica- tion and maintenance building and the control room; that the project, planned for 1985, will be surrounded by an 8 to 12 foot high wall on Warner and on Grand, with a 35 foot wide landscaped setback which will include 124 trees. Mayor Evans closed the public hearing when no other speakers wished to comment on the matter. On the motion of Councilman Brandt, seconded by Councilman Garthe, carried 6:0 unanimously, the Negative Declaration was approved and filed, and the following ordinance was placed on first reading: ORDINANCE NO. NS-1387 - AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. 771 TO REZONE PROP- ERTY LOCATED AT THE SOUTHWEST CORNER OF GRAND AND WARNER AVENUES FROM THE A1 (GENERAL AGRICULTURE) DISTRICT TO THE MI (LIGHT INDUSTRIAL) DISTRICT AND AMENDING SECTIONAL DISTRICT MAP NO. 30-5-9. CA 10 PUBLIC HEARING - AMENDMENT Mayor Evans announced APPLICATION 773 - ORANGE AVE. that this was the time ORDINANCE NO. NS-1388 1ST READING and place for the public hearing of Negative Declaration and Amendment Application 773 to rezone property located on the west side of Orange Avenue between Myrtle and Camile Streets from the Ri District to the R2 District. Senior Planner William Daugherty stated that the subject appli- cation involves six properties comprising .86 acre; that the General Plan designation is high density residential; that there are single family homes on five of the parcels, and the lot at 516 South Orange has a move-in duplex located on it; that with the approval of the owners of the property in the entire block, the zone change could be accomplished for the entire block face; and that following a public hearing held September 12, 1977. the Planning Commission unanimously recommended approval. The owner of the property at 516 South Orange, Treva M. Munick, stated that the building had only one kitchen, and she would appreciate the rezoning so that she could complete the remodel- ing to a duplex. There being no further speakers, the Mayor closed the public hearing. On the motion of Councilman Brandt, seconded by Councilman Ward, carried 6:0 unanimously, the Negative Declaration was approved and filed, and the following ordinance was placed on first reading: ORDINANCE NO.
