REl,4{5/9fJ RESOLUTION NO. 96-2 A RESOLUTION OF THE COMMUNITY REDEVELOP- MENT AND HOUSING COMMISSION OF THE CITY OF SANTA ANA APPROVING AMENDMENTS TO THE SANTA ANA CENTRAL CITY REDEVELOPMENT PLAN, THE SANTA ANA INTER CITY COMMUTER STATION REDEVELOPMENT PLAN AND THE SANTA ANA NORTH HARBOR BOULEVARD REDEVELOPMENT PLAN AND RECOMMENDING CERTIFICATION OF THE ENVIRONMENTAL IMPACT REPORT PREPARED FOR SAID PLAN AMENDMENTS WHEREAS, the city Council of the City of Santa Ana has approved and adopted redevelopment plans for the Santa Ana "Central City" Redevelopment Project, the Santa Ana Inter City Commuter Station Redevelopment Project, and the Santa Ana North Harbor Boulevard Redevelopment Project (the "Redevelopment Plans"); and WHEREAS, this Commission, performing functions of the Community Redevelopment Agency of the city of Santa Ana pursuant to Resolution No. 91-102 of the city Council, has formulated, prepared and proposed amendments to the Redevelopment Plans to extend the time periods for the commencement of eminent domain proceedings, as set forth in Exhibits A, Band C, attached hereto (the "Amendments"); and WHEREAS, an environmental impact report (consisting of a draft environmental impact report (EIR No. 95-2) dated November, 1995, and a final environmental impact report (EIR No. 95-2) dated February, 1996) (the "E.I.R.") has been prepared for the Amendments; and WHEREAS, pursuant to section 33458 of the Health and Safety Code, the Commission held a joint public hearing with the City Council for consideration of the adoption of the Amendments; NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT AND HOUSING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. The E.I.R. has been presented to the Commission, the Commission has reviewed and considered the information contained in the E.I.R. prior to approving the Amendments, and the Commission recommends that the City council certify that the E.I.R. has been completed in compliance with the California Environmental Quality Act. 2. The Commission hereby approves the Amendments, attached hereto as Exhibits A, Band C, and recommends adoption of the Amendments by the city Council. 1 . . . SECOND UEBDKER'1' TO THE REDEVELOPHDIT PLAB FOR THE S1\IIITA AHA "CENTRAL CITY" REDEVELOPHDIT PROJECT The time limit for commencement of eminent domain proceedings to acquire property within the project area, as established by Ordinance No. NS-1877, is hereby amended to read as follows: No eminent domain proceeding to acquire property within the Project Area shall be commenced after the date occurring twelve (12) years after the effective dated of the ordinance approving and adopting the Second Amendment to the Redevelopment Plan for the Santa Ana "Central city" Redevelopment Project. Those properties previously exempted from eminent domain by the Agency shall remain exempt. EXHIBIT A . . . :FIRST AJIEIIDJIDI'r TO THE REDEVELOPHDIT PLAB :FOR THE S1\IIITA AHA IHEa CITY COIIIIU'rEa STATIOII' REDEVELOPHDIT PROJECT The third paragraph of section 308 of the Santa Ana Inter city Commuter station Redevelopment Plan is amended to read as follows: No eminent domain proceeding to acquire property within the Project Area shall be commenced after the date occurring twelve (12) years after the effective dated of the ordinance approving and adopting the First Amendment to the Redevelopment Plan for the Santa Ana Inter city Commuter station Redevelopment project. Those properties previously exempted from eminent domain by the Agency shall remain exempt.
