RESOLUTION NO. 97-11
A RESOLUTION OF THE COMMUNITY
REDEVELOPMENT AGENCY OF THE CITY OF
SANTA ANA AUTHORIZING AND DIRECTING THE
CONDEMNATION OF THAT CERTAIN REAL
PROPERTY IDENTIFIED AS 1812-1818~ 1828
N. MAIN STREET,SANTA ANA, CALIFORNIA,
FOR REDEVELOPMENT PURPOSES
THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA
(the "Agency")hereby finds:
A. Pursuant to the Redevelopment Plan (the "Redevelopment
Plan") for the Santa Ana Redevelopment Project (the "Project
Area"), it has become necessary for Agency to acquire, for
redevelopment purposes, that certain property generally
within the Project Area known as 1812-1818~ 1828 North Main
Street in the City of Santa Ana, more particularly described
in Exhibit A attached hereto (the Property"); and

B. The Agency seeks to acquire the Property in order to
assemble a si te to be conveyed to the St. Joseph Ballet
Company, a non-profit corporation (the "Developer") for
construction and operation of a ballet school serving low
income youth in the community (the "Project").
C. The Agency has made an offer to the owner of record to
acquire the Property described herein at an amount not less
than the Agency's approved appraisal of the fair market value
of the property; and
D. A duly noticed public hearing was held by the Agency on
those matters set forth in its Notice of Intention to Adopt a
Resolution of Necessity and referred to in Section 1240.030,
Code of civil Procedure, which included the following
matters:
(i) whether

the manner that will be compatible with the greatest public
good and the least private injury; and

(iii) whether the
necessary for the Project.

NOW, THEREFORE, BE IT RESOLVED by the Community
Redevelopment Agency of the City of Santa Ana that it finds
and determines as follows:

1.
The public use for which the Property is to be
taken is the redevelopment of a blighted area
through the acquisition, assembly, and conveyance
of a site for the development of a non-profit
ballet school for low-income youth in the
community, all consistent with and benefiting the
Project Area. The Agency is specifically
authorized by virtue of Health & Safety Code
Section 33391 and Section 33342 to take property by
condemnation for redevelopment purposes.
2.
The Property is located within Project Area, and
is necessary for Project and the Redevelopment
Plan in that it is necessary for assembly with
other Agency-owned property in order to create a
usable and viable site for the Project.
3.
The public interest and necessity require the
acquisition of the property in order to carry out
the Project and implement the Redevelopment Plan.
4.
The project is planned or located in the manner
that will be most compatible with the greatest
public good and the least private injury.
BE IT FURTHER RESOLVED that the City Attorney of the
City of Santa Ana, as counsel to the Agency is hereby
directed to bring an action in the Superior Court of the
State of California in the name of the Agency, to acquire by
eminent domain proceedings, the fee simple estate in said
real property for the aforesaid purposes, and to do all
things necessary for the acquisition of said real property
including the making of application to said court for an
order fixing the amount of security by way of money deposit
as said court may direct and for an order permitting the
Agency to take possession and use of said real property for
the uses and purposes herein described.
