June 4, 1979
The meeting was called to order by Mayor James E. Ward at 2:06 p.m. in the City
Council Cb~z~nbers, 22 Civic Center Plaza. Council members present were Gordon
Brickon, Daniel E. Griset, R.W. Luxembourger, J. Ogden Markol, A1 Serrato, James
E. Ward, and Harry K. Y~,mmoto. Also present were City Manager/Acting Clerk of
the Council B.J. Thompson, Assistant City Attorney E.J. Cooper and Deputy Clerk
of the Council Martha Lee.

MOMENT OF SILENCE A moment of silence was observed in
JAMES GILMORE memory of James Gilmore, who served as
GEORGE PARKER Councilman and Vice Mayor from 1963-67,
and George Parker, who served as Chairman
of the Board of First American Title
and Trust Company, resident of Santa Ana for 81 years. Mayor Ward orderd flags
to be flown at half mast until after interment.

2) Increased cost to the taxpayers for police because of criminal activity.
3) The use is counter-productive in the overall efforts to improve Harbor
Boulevard.
4) The location is a gathering place for homosexuals which is offensive to
the conmmmity; on the following:

by Bricken, seconded by Ward to approve continued use of Eddie West Field - Santa
Aha Stadium for rm~sical concerts provided specific control measures are adhered
to as outlined in the report dated blay 29, 1979, prepared by the Director of
Recreation and Parks. The foregoing MOTION WAS AMENDED by Bricken, seconded by
Ward, to approve only the "Conumanity Fair" to be held June 30 - July 1, for
subsequent review by Council of any noise problems. The AMENDED MOTION carried on

designation to the mixed Residential and Industry designation, except for a portion
to be redesignated to the Comity Shopping Center designation; and Amendment
Application No. 813 to rezone the major portion of property located within the
Logan Area from the Heavy Industrial District to the Residential Industrial
District, a new use district, and from Heavy Industrial District to General
Commercial District.
Associate Planner Robert Su_ndstrom highlighted the salient points in the reports
dated May 23 and May 24, 1979, prepared by the Planning Department. He outlined
the basic parameters established by the Council and utilized by staff to develop
evaluation methodology. Using slide transparencies, he described the five
zoning alternatives developed in response to the requests of property owners
and residents of the Logan neighborhood, the area generally bounded by the
Santa Aha Freeway on the north, Santa Aha Boulevard on the south, Lincoln
Avenue on the east and Santiago Boulevard on the west, and summmrized the staff
evaluation of each.
The five alternatives were listed as follows:
Alternative I - No Rezoning or General Plan Amendment - No change in
existing M2 zoning (or permitted uses contained therein).
Alternative II - Rezoning and General Plan Amenclment - Rezone select parcels
to the R2 and C2 Districts; amend General Plan to Mediun Density Residential and
Conummity Shopping Centers designations corresponding to zoning pattern.
Alternative III - Modified Residential/Commercial/Industrial Zoning - Rezone
properties from the M2 District to the Mi-S, R2-S and C2 Districts based
on existing use of property; modify zoning regulations for the Mi and R2
Districts, creating an R2-S and Mi-S zoning district for the Logan Neighborhood
(R2-S-Multiple Family Residence-Special, and Mi-S-Light Industrial-Special);
R2-S Special zoning regulations would provide less restrictive standards for
off-street parking, yard setbacks and unit density; M1-S Special zoning
provisions provide for buffer requirements between industrial to residential
and permit residential uses permitted in R2-S zone; amend General Plan to Medium
Density Residential and Community Shopping Centers corresponding to zoning pattern.
Alternative IV - Mixed Use Zone - Creation of a new RM '%{ixed Use-Special" Zone
for specific application to the Logan neighborhood; development of regulations
similar to Alternative II, R2-S and M1-S Districts; development of design/
land use manual; creation of neighborhood planning committee to review and make
reconm~ndations on all building permits.
Alternative V - Mixed Use Zone - Creation of a new RM '~ixed Use-Special" Zone
for specific application to the Logan neighborhood; permitted uses would be
all uses permitted in the R2 and M2 District; RM si~e plan review required
for all development within the area (processing similar to C5 site plan review);
development or redevelopment with similar permitted uses to that existing on
the property or of contiguous parcels through RM site plan review process;
development or use of a parcel inconsistOnt with the uses on contiguous parcels
would require approved Conditional Use Permit; all residential development would
conform to the requirements of the R2 or more restrictive residential district;
specific development standards for conflicting uses to be established.
Karl Mazzeo-Fernandez, Ecos Management Criteria, introduced Richard Juarez, another
member of the team of consultants who prepared the Environmental Impact Report.
Mr. Juarez described the unique, multi-faceted Report, prepared by Ecos and
Advanced Planning and Research Associates, and the methodology used in its
development. Using the slide transparencies depicting each of the five alternatives,
he summarized the t~am's evaluation of each.

Assistant City Attorney Edward Cooper explained that the City Council is con-
strained in this matter because o£ the provisions of the Santa Aha Municipal Code
Section 41-651, which basically states that the Planning Commission has juris-
diction to conduct public hearings and revoke Conditional Use Permits; that the
Code does not provide for any procedure whereby the Council can hear such revocation
proceedings; that the only time the Council would become involved would be if the
party's CUP were revoked, the party would have an appeal right to the City Council;
that the Planning Commission conducted a public hearing with all interested parties
present.

The Assistant City Attorney suggested that, if Council wishes to hear the matter,
only now testimony or new evidence that was not considered by the Planning
Commission be accepted; that if Council determines grounds for revocation may
exist it would be appropriate to refer the matter back to the Planning Commission.
If no new evidence of grounds for revocation is determined, he suggested that
Council instruct staff to continue to m~nitor development and to bring the
matter back to the Planning Commission for consideration of revocation if
violations of the CUP conditions occur.

Following Council discussion, MOTION was made by Yamamoto, seconded by Serrato,
to refer the matter back to the Planning Commission, with instruction to consider
new evidence. The motion was AMENDED by Griset, seconded by Luxembourger, to
require that all now evidence be made available to all concerned parties and
the City staff on or before June 15, 1979. MOTION and AMEND~NT carried by

MINOR EXCEPTION 79-11 The Mayor opened the public hearing
2401 S. FAIRVIEW STREET to consider the Notice of Exemption
APPROVED and Minor Exception 79-11, which
would allow on-sale beer and wine
in a proposed restaurant within a shopping center located within 300 feet of
residences in the C4 District at 2401 South Fairviow Street.
The Assistant Planner described the property and the conditions imposed by the
Zoning Administrator for approval on May 7, 1979.
The Deputy Clerk reported there were no written comnunications.
Robert Sader, Park Pantry Restaurants, said that he was present to answer any
questions Council might have.
There were no speakers for or against the proposal. The Mayor closed the public
hearing.
