ADJOURNED REGULAR MEETING OF MAY 21, 2001 CRA MINUTES JUNE 4, 2001 . . . RECORDING SECRETARY POSTING REPORT The following notices were posted pursuant to the Brown Act and the Maddy Act. Agency Agendas and Notices are posted on the door of the City Council Chambers at 22 Civic Center Plaza. Motion: Instruct the Recording Secretary to enter notice of posting into the Minutes. 2. Notices/Aaendas Adj. Regular Meeting Agenda Meetina Date OS/21/01 Posted 05/18/01 Time 10:44 a.m. *** END OF CONSENT CALENDAR *** 3. PUBLIC HEARING SALE OF AGENCY-OWNED PROPERTY: 1402 SOUTH PARTON. Legal Notice published in the Orance Countv Reaister on May 18 and 28, 2001 Recommended for approval by the Community Redevelopment and Housing Commission on May 15, 2001 by a 6-0 vote (Leon absent) Presentation of staff report by John Reekstin, Executive Director, Community Development Agency. Mr. Reekstin explained that the property was acquired by the City through a grant deed in lieu of foreclosure. In September 1997, a maintenance and management agreement was initiated with Safely on Shore Ministries, Inc. to use the property as a housing option for abused women and children. He further explained that Safely on Shore Ministries, Inc. has tendered an offer to purchase the property for $160,000, which represents the value of the property as of September 1997. Presentation of written communication by the Clerk of the Council: None Public Hearing: No speakers Public Hearing Closed Staff Recommendation: 1. Adopt a resolution authorizing the sale of Agency-owned property located at 1402 S. Parton and all other required documents. CRA MINUTES 2 JUNE 4, 2001 . . . 2. Approve a loan to Safely on Shore Ministries Inc. in an amount not to exceed $80,000 for the acquisition of 1402 S. Parton. Following the presentation of the staff report, Council Discussion ensued. Council member Alvarez made the following motion, seconded by Council member Bist: Motion: (Alvarez-Bist) Approve Staff recommendations as amended to provide: 1. 60% of the residents of 1402 S. Parton shall be Santa Ana residents before becoming residents at the shelter, and 2. Increase the amount of the loan to Safely on Shore Ministries, Inc to $115,000 to reflect the value of the property in 2001 Discussion continued. Councilmember Bist offered a friendly amendment to require that the covenant on the property restrict residency to single family occupancy. Councilmember Alvarez accepted this amendment to her motion. Debate continued. Council member Franklin stated that he could not support the 60% prior Santa Ana residency requirement. He did, however support Council member Bist's amendment. Council member McGuigan introduced the following substitute motion, seconded by Councilmember Franklin: Substitute Motion: (McGuigan- Franklin) Approve staff recommendations as amended to provide that the covenant on the property require that residency be restricted to single family occupancy. Council member Alvarez withdrew her motion, and introduced the following Substitute Motion: Substitute Motion: (Alvarez-Bist) 1. Adopt a resolution authorizing the sale of Agency-owned property located at 1402 S. Parton and all other documents. 2. Require that residency at the property be restricted to single family occupancy 3. In the event the property is sold during the term of the loan, Safely on Shore Ministries, Inc shall be required to reimburse the Community Redevelopment Agency the full amount of the loan including the additional $35,000 that reflects the increased difference in the value of the property since 1997 CRA MINUTES 3 JUNE 4, 2001 . . . Councilmember McGuigan withdrew her substitute motion. Discussion continued. Terry McCaulay and Gerald Chirpka representing Safely on Shores Ministries, Inc. addressed Council and requested that the single family occupancy restriction not be placed on the property. Additionally, Mr. Chirpka stated that if the Agency requires Safely on Shore to pay an additional $35,000 in the event the property is sold, it would impose a hardship on the organization and would impact other programs that Safely on Shore provides. Mayor Pulido introduced the following motion: Substitute Motion: Continue consideration of item to the June 18, 2001 Community Redevelopment Agency meeting. MOTION: Pulido SECOND: Bist VOTE: AYES: Alvarez, Bist, Christy, Franklin, McGuigan, Pulido, Solorio (7) NOES: None (0) COMMENTS There were no public or agency member comments ADJOURNMENT - 9:54 P.M.
