RESOLUTION NO. 77-27
A RESOLUTION OF THE COMMUNITY REDEVELOPMENT
AGENCY OF THE CITY OF SANTA ANA ESTABLISHING
THE SPECIFIC DIVISION OF AUTHORITY BETWEEN ITSELF
AND THE COMMUNITY REDEVELOPMENT COMMISSION.
WHEREAS, the Community Redevelopment Agency of the City
of Santa Ana ("Agency"), and the Conununity Redevelopment conunission
of the City of Santa Ana ("Conunission") desire to improve the
effectiveness of both Agency and Commission and to assure maximum
efficiency in Agency staff utilization with resultant general
improvement in Agency operations; and
WHEREAS, pursuant to California Health and Safety Code
Section 33202, Agency may delegate any of its functions to
Commission; and
WHEREAS, Agency desires to delegate to Commission authority
to implement projects after Agency has approved such projects
and appropriated funds for implementation thereof; and
WHEREAS, Agency has operation and capital accounts which
are separate and apart from each other and identified as account
no. 110-135 and account no. 110-136 respectively; and
WHEREAS, "Project" shall mean a specific activity program
designated in Agency account no. 110-135 or 110-136, or a specific
activity program so designated from time to time by Agency; and
WHEREAS, Agency desires to retain ultimate control and
responsibility by approving or rejecting the operation and
capital account budgets annually, or, in the alternative, to
direct Commission and Agency staff to prepare for Agency approval
the specific project budgets identified in the capital account
budget of Agency, as the specific projects are prepared for
implementation; and
WHEREAS, such implementation shall include the authority
of Commission to make bid calls and bid awards; hire consultants
needed to implement projects approved by Agency, make relocation
payments, obtain architectural reviews and authorize and approve
demolition contracts and acquire property; and
WHEREAS, in exercising such delegated authority, Agency
desires Commission to process all bid calls, bid awards, consultant
project contracts, relocation payments, appraisal contracts,
property acquisition contracts, architectural review contracts
and demolition contracts arising from all projects designated
in Agency's capital account no. 110-136 budget, using the normal
finance and purchasing procedures of the City of Santa Ana and
in accordance with California Health and Safety Code Section
33422, requiring any work of grading, clearing, demolition or
construction in excess of Two Thousand Five Hundred Dollars
($2,500) to be undertaken by Agency by contract after competitive
bids; and
WHEREAS, Agency desires to delegate to commission final
authority to approve all contracts arising from separate projects
so designated in Agency's capital account no. l10~136 budget;

WHEREAS, Agency also desires to delegate to Commission
authority to approve all contracts not exceeding $25,000 to be
funded through Agency's operation account no. 110-135, and if
such contracts exceed said amount, Agency desires Commission to
select the contractor for said project, which decision sha1~ be
reported to Agency at the latter's next available regular meeting,
and which selection of Commission shall be final thereafter unless,
by action taken by not less than a majority of the members of
Agency, such decision is amended, reversed, recinded, or other-
wise altered; and
WHEREAS, Agency desires to delegate authority to commis-
sion to implement projects within the Agency - approved capital
account or operation account budget, where total project expendi-
tures do not exceed the approved project budget by more than five
per cent (5%) but with Agency retaining the right to prior approval
of specific expenditures by Commission which exceed such project
budget by more than five per cent (5%); and
WHEREAS, as a result of Commission's expanded responsi-
bility, it is necessary to establish quarterly meetings, in addi-
tion t~ the regular monthly Agency meetings, so that Agency may
review Commission progress and discuss specific Agency concerns
over project implementation.
NOW, THEREFORE, BE IT RESOLVED by the Community Redevel-
opment Agency of the City of Santa Ana:
1. Pursuant to California Health and Safety Code
Section 33202, Agency hereby delegates to Commission authority
to:
a) Adopt necessary procedures to implement prop-
erly all projects subsequent to budget approval and appropriation
of funds by Agency; and
b) Approve all contracts for projects to be
funded from Agency's capital account no. 110-136, with Agency
reserving no right of veto thereof; and
c) Select the consultant or contractor for all
contracts in excess of $25,000, which contracts shall be funded
by Agency's operation account no. 110-135. Each such decision of
Commission shall be reported to Agency at the latter's next avail-
able regular meeting, and shall be final thereafter unless, by
action taken by not less than a majority of the members of Agency,
such decision is amended, reversed, recinded, or otherwise altered;
and
d) Process all bid calls, bid awards, consultant
contracts, relocation payments, property acquisition contracts,
architectural review contracts and demolition contracts through
the normal finance and purchasing procedures of the City of Santa
Ana and in accordance with California Health and Safety Code
Section 33422.
2. Agency and Commission shall establish regular
quarterly meetings to review Commission's progress and to discuss
Agency concerns over project implementation.

3. Commission shall submit to Agency quarterly financial
reports and monthly progress reports of all actions of Commission
taken during the preceding month.
