RESOLUTION NO. 79-23
A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY
OF THE CITY OF SANTA ANA CANCELLING A CERTAIN CON-
TRACT FOR DEMOLITION OF BUILDINGS DUE TO THE FAIL-
URE OF CONTRACTOR TO COMPLY IN GOOD FAITH WITH THE
REQUIREMENTS OF SAID CONTRACT; AND DIRECTING THE
CITY ATTORNEY, AS COUNSEL FOR SAID AGENCY, TO DO
ANY AND ALL THINGS NECESSARY TO ENFORCE THE OBLIGA-
TIONS OF SAID CONTRACTOR AND HIS SURETIES
WHEREAS, this Agency, on December 27,1977, awarded a
certain "CONTRACT FOR DEMOLITION OF EXISTING STRUCTURES
WITHIN AREA GENERALLY BOUNDED BY FIRST ST., FOURTH ST.,
FORMERLY VAN NESS AVENUE, AND FLOWER ST." to Calvin C.
Crowley, doing business as CCC Land Clearing and Wrecking;
and
WHEREAS, this Agency has been informed that said con-
tractor is not complying in good faith with the requirements
and agreements of said contract, has failed and refused to
undertake work required hereby, or to complete work com-
menced by him heretofore, and that said contractor is in
default thereunder and can no longer be reached; and
WHEREAS, this Agency intends to pursue its remedies
under and pursuant to said contract.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY REDE-
VELOPMENT AGENCY OF THE CITY OF SANTA ANA, AS FOLLOWS:
1. That, pursuant to the provisions of said contract,
said contract is hereby cancelled for failure of said con-
tractor to comply in good faith with the requirements
thereof or to carry out and complete the work required of
him thereunder.
2. The city attorney is hereby directed to give notice
hereof to American Fidelity Fire Insurance Company, surety
of the bonds securing performance of said contract. The
city attorney is hereby further directed to take any and all
actions, including, but not by way of limitation, litigation
if such be necessary, to enforce the rights of this Agency
against said contractor and his sureties under the provision
of said contract.
