A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN REAL PROPERTY FOR REDEVELOPMENT PURPOSES IN THE PHILIPSON DEVELOPMENT SITE IN THE CITY OF SANTA ANA, STATE OF CALIFORNIA, AND DECLARING THE PUBLIC NECESSITY THEREFOR WHEREAS, pursuant to the redevelopment plan of this Agency, it has become necessary to acquire certain real property located at 816 Santa Ana Boulevard, and on the southeast corner of Flower and Santa Ana Boulevard in the redevelopment project area; and I WHEREAS, all persons whose names and addresses appear on the last equalized assessment roll for the property described herein and all persons whose names appear as record owners on the litigation guarantee reports for said property, and all tenants were given notice and an opportunity to be heard pursuant to the Code of Civil Procedure Section 1245.235; and WHEREAS, a public hearing was Redevelopment Agency on those matters of Intention to Adopt a Resolution of to in Section 1240.030, Code of civil the following matters: held by the Community set forth in its Notices Necessity and referred Procedure, which included (a) Whether the public interest and necessity require the proposed project; (b) Whether the project is planned and located in the manner that will be most compatible with the greatest public good and the least private injury; and . (c) Whether the property described herein is necessary for the proposed project. NOW, THEREFORE, BE IT RESOLVED by the Community Redevelopment Agency of the City of Santa Ana that it finds and determines as follows: 1. The Agency is specifically authorized by virtue of Health & Safety Code Section 33391 and Section 33342 to take property by condemnation for Redevelopment purposes, namely redevelopment of real property situated within the area described in the first recital hereinabove. 2. The propèrty described herein is located within the Community Redevelopment Project area of the City of Santa Ana as depicted by the map attached hereto as Exhibit A, and incorporated herein by reference, and is necessary for the proposed project. Said property is more particularly described as follows: A.P. 008-l11-03 and 008-l11-13 PARCEL 1: , Lot 4 and the West 6.00 feet of Lots 2 and 3 in Block I of the Ross Addition to Santa Ana, as shown on a Map re- corded in book 3, page 554 of Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California. -1- ¡ lA Except that portion of said lots granted to the City of Santa Ana by a deed recorded December 5, 1975, in book 1l585, page 947 of Official Records. . PARCEL 2: That portion of Lots 2 and 3 in Block I of the Ross Addition to Santa Ana, as shown on a Map recorded in book 3, page 534, Miscellaneous Records, in the Office of the County Recorder of Los Angeles County, California, described as follows: Beginning at a point 94.00 feet West of the Northeast corner of said Block I; thence West 50.00 feet along the North line of said Block; thence South 125.00 feet to the South line of said Lot 3; thence East 50.00 feet; thence North 125.00 feet to the place of beginning, and being the West 6.00 feet of said Lot 2 and the East 44.00 feet of said Lot 3. PARCEL 3: That portion of Lot 5 in Block I of the Ross Addition to Santa Ana, as shown on a Map thereof recorded in book 3, page 534, Miscellaneous Records of Los Angeles County, California, more par- ticularly described as follows: I Beginning at the Southeast corner of said Lot 5 as shown on said map; thence Westerly along the South line of said Lot 5 to a line parallel with and distant 5.00 feet Westerly, measured at right angles from the East line of said Lot 5; thence North- erly along said parallel line a distance 86.02 feet to the be- ginning of a tangent curve concave Southeasterly having a radius of 25 feet; thence Northeasterly along the arc of s8id curve a distance 16.08 feet through a central angle of 36 52'11" to its intersection with the East line of said Lot 5; thence Southerly along said East line a distance lOl.02 feet, to the point of beginning. 3. The public interest and necessity require the proposed project. 4. The proposed project is planned and located in the manner that will be most compatible with the greatest public good and the least private injury. . 5. The property described herein is necessary for the proposed project. 6. The Legal Counsel of the Community Redevelopment Agency of the City of Santa Ana is hereby directed to bring action in the Superior Court of the State of California in the name of the Community Redevelopment Agency of the City of Santa Ana, to acquire by eminent domain proceedings, the fee simple estate in said real property for the aforesaid purposes. The Agency Legal Cdunsel is authorized and instructed to do all things necessary for the acquisition of said real , -2- Õ lA ,0 . property including the making of application to said court for an order fixing the amount of security by way of money deposits as said court may direct and for an order permitting the Community Redevelopment Agency of the City of Santa Ana to take possession and use of said real property for the uses and purposes herein described.
