FIRST AMENDMENT TO AGREEMENT URBAN AREA SECURITY INITIATIVE (U ASI) THIS FIRST AMENDMENT TO AGREEMENT is entered into on June del , 2005, by and between the City of Costa Mesa, acting through the Costa Mesa Police Department ("Subgrantee") and the City of Santa Ana ("City"). Recitals: A. The parties entered into Agreement A-2004-176-1 0, dated February 18, 2005 (hereinafter "said Agreement") by which City, in its capacity as the Core City for the Santa Ana Urban Area under the FY04 Urban Area Security Initiative (hereinafter "UASI"), transferred UASI Grant Funds to Subgrantee for the purchase and installation of security gates and fencing around Subgrantee's facilities. B. In accordance with the terms and conditions of said Agreement, the parties wish to increase the Grant Award to pay for specific project costs which were estimated at the time of entering into said Agreement and have increased. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Agreement, the parties agree as follows: 1. The amount ofUASI Grant Funds transferred from City to Subgrantee shall be increased by $22,000.00, for a total cost of$150,000.00, to pay for installation of security gates and fencing around Subgrantee's Police Department and Fire Station #5 Facilities, as set forth in the letter dated April 20, 2005, attached hereto as Exhibit A-I, and incorporated by this reference. The total FY04 UASI Grant award to Subgrantee shall be increased from $137,000.00 to $159,000.00. 2. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full force and effect. HENSLEY, CHIEF OF POLICE April 20, 2005 Captain George Saadeh Santa Ana Police Department 60 Civic Center Plaza Santa Ana, CA 92702 Dear Captain Saadeh, On the 18th of February 2005, the City of Santa Ana and the City of Costa Mesa entered into an agreement to transfer or purchase equipment or services for FY04, Urban Area Security Initiative (UASI). The agreement included $128.000.00 in funding for security gates and fencing for the Costa Mesa Police Department and Costa Mesa Fire Station #5 facilities. The project included erecting security gates to both the rear vehicle entrances that access police and fire vehicle parking areas, as well as employee parking for both of the facilities. Pedestrian gates were also being included in the project. The vehicle and pedestrian gates would be accessed using card reader devices. Security camer,as would be added to an existing system that would provide the necessary visibility to the parking areas and gate access points. The company that provided the quotation for the project was Siemens, a company that has installed other security systems throughout the City. Due to time constraints, at the time of applying for the UASI Grant the Siemens quotation was the only benchmark that could be used to estimate the cost of securing the Police and Fire facility. Since the time of entering into the agreement with the City of Santa Ana on this project, a more specific project cost estimate was obtained from Meyer & Allen Associates, the architectural firm the City of Costa Mesa has used for other projects in the City. Meyer & Allen Associates estimate was for $173,648 for the project. This estimate included more specific information and costs associated with the project. Refer to the attached estimate for more specific details. On April 19, 2005, Lt. Allen Huggins (Security Gate and Fencing Project Manager for City of Costa Mesa) spoke to Sgi:. Brian Sheldon (UASI Grant Coordinator for City of Santa Ana) about the project. Sgt. Sheldon indicated that the agreement to transfer or purchase equipment or services for FY04, Urban Area Security EXHIBIT A 1 www.ci.cosla.mesa.ca.us , \. Initiative (UASI) could be changed to increase the award to $150,000 for the security gate and fencing project. The purpose of this letter is to request the increased UASI Grant award agreement. I appreciate your assistance in obtaining the increased funding from the UASI grant for this important target-hardening project.
