Hunter or Fred Orgeron as "Owner"), does hereby grant to the City of Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution and laws of the State of California, its officers, agents, employees or representatives (collectively referred to as the "City"), the right to enter the property located at 1249 W. First Street, in the City of Santa Ana, County of Orange (the "property"), and hereby grants to the City a license for the following: Purpose: to conduct a site investigation to determine the location, if any, of an underground storage tank. The investigation process will include soil borings and the use of a backhoe to remove asphalt and soil, within the close proximity to the suspected storage tanks. The Scope of Work and location are described in the attached Exhibit "A", The City agrees to indemnif'y and hold harmless, the Owner, from any liability arising out of the City's exercise of this License and Right-of-Entry, The City further agrees to repair any damage to said property caused by the exercise of this License and Right of Entry at its sole cost and expense and to restore said property, with the exception of the improvements left thereon, to the state in which it existed prior to the use of the property by the City. The rights herein granted to the City, are exclusive, and the City agrees not to assign, transfer, lease, pledge, or otherwise dispose of its License and Right of Entry without the prior expressed written approval of the undersigned. This instrument conveys no right of entry to existing buildings, This License and Right of Entry shall expire upon completion of said construction work, and in any event, no later than December 31, 2005, unless extended by written agreement between the undersigned and the City. Task 1 - Pre-Field Activities Leighton Consulting will update the current site Health and Safety Plan and prepare a Supplemental Site lnvestigation Workplan for submittal to the City of Santa Ana Fire Department for their comment and approval. Leighton Consulting will mark-out the area of investigation and will contact Underground Service Alert (USA) two days prior to conducting field-work for their identification of utilities in the work area. Leighton Consulting will assist in obtaining the necessary encroachment permit to conduct a hand auger boring in the City sidewalk. Task 2 - Hand Auqer Borinqs Leighton Consulting proposes to advance two hand auger borings, HA-I and HA-2, in the suspected locations of the 5,000-gallon tank (HA-I) and the second 7,500-gallon tank (HA-2) as indicated on Figure 2. ]f present, the tank tops are anticipated to occur at a depth of 4 to 6 feet bgs. Task 3 - Direct Push and Hollow-stem Auqer Borinqs Leighton Consulting proposes to advance up to 6 borings, 13-] through 13-6, to depths of 40 to 115 feet bgs to further define the lateral and vertical e:-:tent of soil contamination. The proposed boring locations are shown in Figure 2. Boring B-1 will be drilled to a sufticient depth to sample groundwater or establish that 20 fcet of clean (non-impacted) soil is present above the first occurrence of groundwater. Borings B-2 through 8-6 will be advanced to 40 feet bgs. The objecti\'es of the borings arc discussed below: Boril1g B-1 Boring B-1 will be installed in the vicinity of the highest concentrations of gasoline impacted soil detected at the site, adjacent to the sidewalk and southwest of the discovered 7,500-gal1on UST. The boring will be advanced to a depth of up to ]] 5 feet bgs, utilizing a CME-95 UT hollo\\-stem auger drill fig. Geotechnical soil samples will be obtained between the depths of 5 to 30 feet bgs. A discrete-depth groundwater sample will be collected by Hydropunch@ sampling if groundwater is encountered. The objective of this boring is to determine if groundwater is impacted as a result of the service station operations and to obtain information necessary for the potential shoring design. Borings B-2 through B-6 Borings B-2 through B-6 are intended to define the lateral and vertical extent of soil contamination for remedial response cost analysis. Boring B.6 will only be installed if gasoline impacted soil is apparent in boring B.4 based on field operations. The borings will be advanced by a direct-push Geoprobe@ sampling rig to depths of approximately 40 feet bgs. Soil samples will be collected at five-foot intervals for environmental analysis beginning at 15 feet bgs. Geotechnical soil samples will be obtained between the depths of 5 to 30 feet bgs from one or more of the borings. Logging and Sampling Analyses All borings will be logged and soils will be described according to the uses soil classification system. Soil samples obtained for environmental analysis will be submitted to a State of California Certified Analy1ical Laboratory for analysis of total petroleum hydrocarbons as gasoline (TPll-g), and benzene, toluene, ethyl benzene and total xylenes (BTEX) by EPA Method 8015/8021. At least two (2) soil samples from each boring will be further analyzed for volatile organic compounds (VOCs) by EPA Method 8260. The additional analysis will be performed on those samples that exhibit the highest concentrations of contaminants as determined by the initial 8015/8021 analyses. Groundwater samples, if any, will be analyzed for TPB-g and BTEX compounds utilizing EPA Method 8015/8021 and VOCs utilizing EPA Method 8260. Leighton Consulting will collect up to four (4) soil samples from depths of 5 to 12 feet bgs and 18 to 22 feel bgs for geotechnical analysis to ascertain the physical soil properties to aid in potential shoring design. These samples ",ill be analyzed for direct shear strength utilizing three points to estimate slope stability. Two bulk samples will be collected utilizing the cuttings from all borings installed as part of this investigation. The bulk samples will be analyzed for maximum density testing utilizing the modified Proctor Compaction with a 4-inch mold. Maximum density testing is required for backfill operations associated with any overexcavation to be performed in accordance with the potential shorinQ activities. ' v . " - "A ", Exh-b.+ /I '?A,.e 3 600701002 Task 4 - Reoort Preoaration Leighton Consulting will prepare an environmental report and geotechnical report for the City of Santa Ana summarizing the findings of this investigation. The environmental report will document the extent of soil contamination and will include an analysis of the environmental response costs and UST removal(s) cost. The geotechnical report will include a slope stability analysis and an active and passive pressure analysis for future use in the preparation of a shoring design, if necessary. Both reports will be prepared under the oversight of a State of California Professional Geologist and/or Professional Engineer. ; " . .
