Councilmembers present were Daniel E. Griset, Ron May, Patricia A. McGuigan, Rick Norton, and Miguel A. Pulido. Also present were City Manager David N. Ream, City Attorney Edward J. Cooper and Clerk of the Council Janice C. Guy. Mayor Dan Young was absent. The Clerk of the Council announced the City Council was recessing to Closed Session pursuant to Government Code Section 54956.9(a) to confer with the City Attorney regarding pending litigation which had been initiated fomally, and to which the City was a party, to wit, Mack vs. City of Santa Ana. CLOSED SESSION REPORT No action was taken out of Closed Session. PUBLIC CO~4ENTS Larry Hancock, Jr., lO17 E. Virginia, expressd concern to the Council regarding rubberized railroad grade crossings which he felt were an extreme safety hazard under wet conditions. The City Manager indicated he would discuss this issue with railroad personnel. CITY COUNCIL COn, lENTS The Councilmembers wished those in the audience, staff and the listening public a Merry Christmas and Happy New Year. In response to Councilmember Norton's inquiry relative to the denial by the Police Chief to place California Towing on the Santa Aha Police Towing rotation list, the City Attorney explained the matter was not appealable to the Council. In response to Councilmember Pulido and Mayor Pro Tem Acosta, the Police Chief provided an update relative to the City's program regarding illegal of discharge of firearms on New Year's Eve. Councilmember McGuigan cautioned one and all not to drink and drive, especially during the Holiday Seaon. In response to Mayor Pro Tem Acosta, the City Manager explained the City was currently processing an Environmental Impact Report for the proposed sports arena, and that the project had been considered by the Planning Commission.
